Regulations Respecting Zoning at North Battleford Airport

Whereas, pursuant to section 5.5 of the Aeronautics Act, a copy of the proposed Zoning Regulations respecting North Battleford Airport, substantially in the form set out in the schedule hereto, was published in two successive issues of the Canada Gazette Part I, on March 16 and 23, 1991 and in two successive issues of the News Optimist on June 26 and July 3, 1991, and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect thereto;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Acting Minister of Transport, pursuant to section 5.4 of the Aeronautics Act, is pleased hereby to make the annexed Regulations respecting zoning at North Battleford Airport.
Short Title
1 These Regulations may be cited as the North Battleford Airport Zoning Regulations.
Interpretation
2 (1) In these Regulations,
- airport
airport means the North Battleford Airport, in the vicinity of North Battleford, in the Province of Saskatchewan; (aéroport)
- airport reference point
airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)
- approach surface
approach surface means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part II of the schedule; (surface d’approche)
- Minister
Minister means the Minister of Transport; (ministre)
- outer surface
outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part III of the schedule; (surface extérieure)
- strip
strip means the rectangular portion of the landing area of the airport, including the runway, prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part IV of the schedule; (bande)
- transitional surface
transitional surface means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part V of the schedule. (surface de transition)
(2) For the purposes of these Regulations, the elevation of the airport reference point is 54l.9 m above sea level.
Application
3 These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, which lands are more particularly described in Part VI of the schedule.
General
4 No person shall erect or construct on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point
(a) the approach surfaces;
(b) the outer surface; or
(c) the transitional surfaces.
Natural Growth
5 Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may require that the owner or occupier of the land on which that object is growing remove the excessive growth.
Disposal of Waste
6 No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste that is edible by or attractive to birds.
SCHEDULE(Sections 2 and 3)
PART IDescription of the Airport Reference Point
The airport reference point shown on North Battleford Airport Zoning Plan No. E.2745 dated November 30, 1989 is described as follows:
Premising that the bearings hereinafter mentioned are astronomical and are referred to the centre line of runway 12-30 of the North Battleford Airport, North Battleford, Saskatchewan, as South 44°10′06″ East;
Commencing at the threshold of runway 12; thence South 44°10′06″ East a distance of 738.8 m; thence South 45°49′54″ West a distance of 203.4 m to the airport reference point.
PART IIDescription of the Approach Surfaces
The approach surfaces, shown on North Battleford Airport Zoning Plan No. E.2745 dated November 30, 1989, are surfaces abutting each end of the strips associated with runways designated 06-24 and 12-30, and are described as follows:
(a) a surface abutting the end of the strip associated with runway approach 06 consisting of an inclined plane having a ratio of l m measured vertically to 20 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 280 m from the projected centre line; said imaginary horizontal line being 125 m above the elevation at the end of the strip;
(b) a surface abutting the end of the strip associated with runway approach 24 consisting of an inclined plane having a ratio of l m measured vertically to 20 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 2 500 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 280 m from the projected centre line; said imaginary horizontal line being 125 m above the elevation at the end of the strip;
(c) a surface abutting the end of the strip associated with runway approach 12 consisting of an inclined plane having a ratio of l m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the strip; the outer ends of the imaginary horizontal line being 525 m from the projected centre line; said imaginary horizontal line being 75 m above the elevation at the end of the strip; and
(d) a surface abutting the end of the strip associated with runway approach 30 consisting of an inclined plane having a ratio of 1 m measured vertically to 40 m measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip and distant 3 000 m measured horizontally from the end of the strip; the outer ends of the imaginary horizontal line being 525 m from the projected centre line; said imaginary horizontal line being 75 m above the elevation at the end of the strip.
PART IIIDescription of the Outer Surface
The outer surface, shown on North Battleford Airport Zoning Plan No. E.2745 dated November 30, 1989, is an imaginary surface located at a common plane established at a constant elevation of 45 m above the elevation of the airport reference point, except that, where that common plane is less than 9 m above the surface of the ground, the outer surface is an imaginary surface located at 9 m above the surface of the ground.
PART IVDescription of the Strips
The strips, shown on North Battleford Airport Zoning Plan No. E.2745 dated November 30, 1989, are described as follows:
(a) the strip associated with runway 06-24 is 60 m in width, 30 m being on each side of the centre line of the runway and 842 m in length; and
(b) the strip associated with runway 12-30 is 150 m in width, 75 m being on each side of the centre line of the runway and l 644 m in length.
PART VDescription of Each Transitional Surface
The transitional surfaces, shown on North Battleford Airport Zoning Plan No. E.2745 dated November 30, 1989, are described as follows:
(a) the transitional surfaces associated with runway 06-24 are inclined planes rising at a ratio of 1 m measured vertically to 5 m measured horizontally at right angles to the centre line and projected centre line of the strip and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or with another transitional surface of an adjoining strip; and
(b) the transitional surfaces associated with runway 12-30 are inclined planes rising at a ratio of 1 m measured vertically to 7 m measured horizontally at right angles to the centre line and projected centre line of the strip and extending upward and outward from the lateral limits of the strip and its approach surfaces to an intersection with the outer surface or with another transitional surface of an adjoining strip.
PART VIDescription of the Lands to Which These Regulations Apply
The boundary of the outer limits of lands, shown on North Battleford Airport Zoning Plan No. E.2745 dated November 30, 1989, is described as follows:
COMMENCING at the intersection of the easterly limit of Section 12, Township 44, Range 16, West of the 3rd Meridian with the southerly limit of Registered Plan 87B16724;
THENCE southerly along the easterly limits of Sections 12, 1 and the northeast quarter of Section 36, Township 43, Range 16 West of the 3rd Meridian and across the intervening road allowance to the southeast corner of said northeast quarter of Section 36;
THENCE westerly along the southerly limit of said northeast quarter of Section 36 to the southwest corner thereof;
THENCE southerly along the easterly limit of the southwest quarter of Section 36 to the southeasterly corner thereof;
THENCE westerly along the southerly limit of said southwest quarter of Section 36 and across the intervening road allowance to the northeast corner of the northeast quarter of Section 26;
THENCE southerly along the easterly limit of said northeast quarter of Section 26 to the southeast corner thereof;
THENCE westerly along the southerly limit of the north half of Section 26 and across the intervening road allowance to the northeast corner of the southeast quarter of Section 27;
THENCE southerly along the easterly limit of the said southeast quarter of Section 27 to the southeast corner thereof;
THENCE westerly along the southerly limit of Section 27 and the production thereof to a point where it intersects the left bank of the North Saskatchewan River;
THENCE northwesterly along the said left bank of the North Saskatchewan River to a point where it intersects the circumference of a circle having a radius of 4 000 metres and centered at the airport reference point as described in Part I of the schedule;
THENCE northwesterly following the circumference of the said circle clockwise to a point where it intersects the left bank of the North Saskatchewan River;
THENCE northwesterly in a straight line to a point being the intersection of the northeasterly limit of River Valley Drive, Registered Plan 84B16176 with the northwesterly limit of Registered Plan 67B02317;
THENCE in a northeasterly and northwesterly direction along the northwesterly and southwesterly limits of Registered Plan 67B02317 to an intersection with the southwesterly limit of Registered Plan 84B11949;
THENCE northeasterly in a straight line to a point being the intersection of the westerly limit of Parcel 1, Registered Plan M.3738 with Registered Plan 67B02317;
THENCE northerly along the westerly limits of Parcel 1 to the most northwesterly corner thereof;
THENCE northeasterly in a straight line to the southeasterly corner of Parcel B, Registered Plan C.1887;
THENCE southeasterly along the southwesterly limit of Parcel B to the southeast corner thereof;
THENCE northerly along the easterly limits of Parcel B and 97th Street to the southerly limit of 15th Avenue;
THENCE easterly along the southerly limit of 15th Avenue to the easterly limit of 98th Street;
THENCE northerly along the easterly limit of 98th Street to the southerly limit of 16th Avenue;
THENCE easterly along the southerly limit of 16th Avenue to the easterly limit of 99th Street;
THENCE northerly along the easterly limit of 99th Street to the southerly limit of 18th Avenue;
THENCE easterly along the southerly limit of 18th Avenue to the Easterly limit of 100th Street;
THENCE northerly along the easterly limit of 100th Street to the southerly limit of 19th Avenue;
THENCE easterly along the southerly limit of 19th Avenue to the easterly limit of 101st Street;
THENCE northerly along the easterly limit of 101st Street to the southerly limit of 20th Avenue;
THENCE easterly along the southerly limit of 20th Avenue to the easterly limit of 102nd Street;
THENCE northerly and easterly respectively along the easterly limit of 102nd Street and southerly limit of 102nd Crescent and its production easterly to the easterly limit of MacDonald Drive;
THENCE northerly along the easterly limit of MacDonald Drive and the production thereof to the northerly limit of Douglas Avenue;
THENCE easterly along the northerly limit of Douglas Avenue to the westerly limit of Bennett Crescent;
THENCE northerly and easterly respectively along the westerly and northerly limits of Bennett Crescent to the southwesterly corner of Lot 55, Block 17, Registered Plan 84B08020;
THENCE northerly along the westerly limit of Lot 55, Block 17 and the production thereof to an intersection with the northerly limit of Parcel B1, Registered Plan 81B14786;
THENCE easterly along the northerly limit of Parcel B1 to an intersection with the southerly production of the westerly limit of Lots 3, 4 and 5, Block 315, Registered Plan 87B08069;
THENCE northerly along the westerly limit of said lots and the production thereof to an intersection with the southerly limit of Parcel E, Registered Plan 65B03131;
THENCE easterly along the southerly limit of Parcel E to the southeasterly corner thereof;
THENCE northerly along the easterly limit of Parcel E to the northeasterly corner thereof;
THENCE northeasterly in a straight line to the northwesterly corner of Parcel B, Registered Plan J.4853;
THENCE easterly along the northerly limit of Parcel B and across the intervening road allowance to the southwest corner of the southwest quarter of Section 21, Township 44, Range 16, West of the 3rd Meridian;
THENCE northerly along the westerly limit of the southwest quarter of Section 21 to the northwest corner thereof;
THENCE easterly along the northerly limits of the south halves of Sections 21, 22 and 23 and across the intervening road allowances to the northeast corner of the southeast quarter of Section 23;
THENCE southerly along the easterly limit of the southeast quarter of Section 23 to the southeast corner thereof;
THENCE easterly across the road allowance and along the northerly limit of the northwest quarter of Section 13 to the northeast corner thereof;
THENCE southerly along the easterly limit of the west half of Section 13 and its production to an intersection with the southerly limit of Registered Plan 87B16724;
THENCE easterly along the southerly limit of Registered Plan 87B16724 to the point of commencement.
