Order Declaring a Body of Indians at Conne River, Newfoundland, to be a Band for the Purposes of the Indian Act

P.C. 1989-2206  1989-11-02

Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to subsection 73(3) and paragraph (c) of the definition band in subsection 2(1) of the Indian Act, is pleased hereby

  • (a) to revoke Order in Council P.C. 1984-2273, made on June 28, 1984Footnote *; and

  • (b) to make the annexed Order declaring a body of Indians at Conne River, Newfoundland, to be a band for the purposes of the Indian Act, in substitution therefor.

Short Title

 This Order may be cited as the Miawpukek Band Order.

Declaration

 The body of Indians described in section 3, and sometimes known as the Conne River Indian Band, is a band for the purposes of the Indian Act and is to be known as “Miawpukek Mi’Kamawey Mawio’mi” or, in its abbreviated form, the “Miawpukek Band”.

  •  (1) The Miawpukek Band is that body of Indians comprising every person

    • (a) who is of Canadian Indian ancestry;

    • (b) who is not excluded by the operation of section 7 of the Indian Act from entitlement to registration as an Indian; and

    • (c) who

      • (i) was ordinarily resident in the community of Conne River, Newfoundland, on June 28, 1984,

      • (ii) is the child or sibling of a person referred to in subparagraph (i), or

      • (iii) is the child of a sibling of a person referred to in subparagraph (i).

  • (2) For the purposes of subparagraph (1)(c)(i) and without restricting the generality thereof, a person shall be considered to have been ordinarily resident in the community of Conne River, Newfoundland, on June 28, 1984, if the person was absent from the community

    • (a) on June 28, 1984 for reasons of health or education, or

    • (b) for a period not exceeding 12 months during the period beginning on June 28, 1983 and ending on June 28, 1984

    and would, but for that absence, have been ordinarily resident in that community.
