Canadian Forces Compulsory Early Superannuation Regulations

His Excellency the Governor General in Council, on the recommendation of the Minister of National Defence, pursuant to Vote 56a of the Appropriation Act No. 7, 1964, is pleased hereby to make the annexed Canadian Forces Compulsory Early Superannuation Regulations.

 These Regulations may be cited as the Canadian Forces Compulsory Early Superannuation Regulations.

 In these Regulations all words and expressions have the same meaning as in the Canadian Forces Superannuation Act.

 A contributor who, having served in the forces for ten or more years, is compulsorily retired from the forces before reaching retirement age during the period commencing on the 7th day of May, 1964 and ending two years thereafter due to a reduction in the total number of members of the forces shall, in the event that the Service Pension Board determines that the said retirement

  • (a) was, in fact, by reason of a reduction in the total number of members of the forces arising out of reductions in establishments of the regular forces, and

  • (b) was not by reason of inefficiency in the performance of duties, misconduct or pursuant to a request made by the contributor,

be deemed for the purpose of subsection (3) of section 10 of the Canadian Forces Superannuation Act to have served in the forces for twenty or more years if, except for these Regulations, the contributor would upon his retirement be entitled to a reduced annuity pursuant to clause (A) of subparagraph (ii) of paragraph (c) of subsection (3) of section 10 of that Act.
