Ontario Grapes-for-Processing Marketing Levies Order

The Grape Growers of Ontario, formerly known as The Ontario Grape Growers’ Marketing Board, pursuant to section 3 and paragraph 4(b) of the Ontario Grapes-for-Processing OrderFootnote a, hereby makes the annexed Ontario Grapes-for-Processing Marketing Levies Order.

Interpretation

 The following definitions apply in this Order.

buyer

buyer means a person that buys grapes. (acheteur)

Commodity Board

Commodity Board means the Grape Growers of Ontario, formerly known as The Ontario Grape Growers’ Marketing Board, established under the Farm Products Marketing Act, R.S.O. 1990, c. F.9. (Office de commercialisation)

producer

producer means a person that

  • (a) is engaged in the production or marketing of grapes;

  • (b) employs a person referred to in paragraph (a);

  • (c) is entitled under any lease or agreement

    • (i) to a share of the grapes produced or marketed by a person referred to in paragraph (a), or

    • (ii) to the proceeds from the sale of those grapes; or

  • (d) takes possession of any grapes under any form of security or legal proceedings for a debt. (producteur)

Levies

 Every producer situated in Ontario must pay to the Commodity Board, for all grapes of a variety set out in column 3 of the schedule that are marketed by that producer in interprovincial and export trade, the total of the General Levy and the Research and Industry Development Levy set out respectively in columns 4 and 5 of that item.

  •  (1) Every buyer must deduct the levies referred to in section 2 from every payment made to a producer for grapes.

  • (2) The buyer must forward the levies to the Commodity Board not later than 30 days after the end of the month in which they are deducted, together with a statement on a form provided by the Commodity Board that sets out

    • (a) the amount and variety of grapes bought from the producer;

    • (b) the amount of the levies being forwarded on the producer’s behalf;

    • (c) the producer’s name; and

    • (d) the producer’s Commodity Board licence number.

Coming into Force

 This Order comes into force on the day on which it is registered.
