His Excellency the Governor General in Council, on the recommendation of the Minister of Transport and the Treasury Board, is pleased hereby
(a) pursuant to section 3 of the Aeronautics Act, to authorize the Minister of Transport to enter into agreements
(i) with companies involved in transportation by air whose facilities are at or in the vicinity of the Department of Transport facilities for the provision of electronic maintenance services, and
(ii) with parties outside the Government of Canada for the provision of electronic maintenance services in remote areas of Canada where the only telecommunications and electronic expertise available is that of the Department of Transport, and
(b) pursuant to paragraph 13(b) of the Financial Administration Act, to authorize the Minister of Transport to prescribe by Order, fees or charges to be paid for the services provided in accordance with the agreements referred to in paragraph (a),
subject to the terms and conditions set out in the schedule hereto.
SCHEDULE
1 Any agreement entered into pursuant to this Order must be reviewed by the Minister one year from the date of the agreement and each year thereafter, on the anniversary date, and must contain a provision that all fees or charges will be subject to change by the Minister by Order pursuant to this Order in Council.
2 The fees or charges to be prescribed by the Minister shall be determined as follows:
(a) the labour rate shall be the appropriate salary rate set out in the effective agreement between the Treasury Board and the International Brotherhood of Electrical Workers (I.B.E.W.) Local 2228;
(b) the effective fringe benefits, isolated post and cost of living allowances shall be applied to the salary rate;
(c) vehicle operation shall be charged at the effective rate per mile as set by the Minister of Transport by Order pursuant to this Order in Council;
(d) parts shall be supplied at cost plus shipping; and
(e) the fees or charges described in paragraphs (a) to (d) are subject to the effective Overhead Rate as set by the Minister of Transport by Order pursuant to this Order in Council.
