Her Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of Public Safety and Emergency Preparedness and the Treasury Board, pursuant to subsection 23(2.1)Footnote a of the Financial Administration Act, hereby makes the annexed Firearms Fees Remission Order (Licences).

Remission

  •  (1) Remission is granted to an individual who had been issued, on or after December 1, 1998, a possession licence for firearms (other than a possession licence for firearms for individuals who are less than 18 years old) or a possession and acquisition licence for firearms of the fee the individual paid under the Firearms Fees Regulations for

    • (a) the renewal of one of those licences;

    • (b) the issuance of another possession and acquisition licence for firearms; or

    • (c) the issuance of a possession and acquisition licence for firearms if the previously held licence was a possession licence for firearms.

  • (2) Subsection (1) does not apply in respect of

    • (a) a fee paid for a licence issued to an individual if that licence or the licence previously held by the individual had been revoked in circumstances other than those described in subsection 72(1.1) of the Firearms Act and that revocation had not been cancelled; or

    • (b) a fee paid for a licence if the renewal or issuance of the licence has been refused and the refusal has not been overturned.

 Remission of the fee paid under the Firearms Fees Regulations by an individual for the renewal of a possession licence for firearms for individuals who are less than 18 years old is granted to the individual.

Condition

 The remission referred to in section 1 or 2 is granted on the condition that the fee was paid during the period beginning on December 1, 1998 and ending on the day before the day on which this Order comes into force.

Coming into Force

 This Order comes into force on the day on which it is registered.
