Remission Order Concerning Interest Accruing on Certain Unemployment Insurance Overpayments

Her Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of Human Resources Development and the Treasury Board, pursuant to subsection 23(2.1)Footnote a of the Financial Administration Act, hereby makes the annexed Remission Order Concerning Interest Accruing on Certain Unemployment Insurance Overpayments.

Interpretation

 The following definitions apply in this Order.

misrepresentation

misrepresentation means fraud, falsification of documents, wilful misrepresentation or any other offence committed by a person or by any other person acting on behalf of that person that results in that person receiving an unemployment insurance overpayment. (fausse déclaration)

Regulations

Regulations means the Interest and Administrative Charges Regulations. (Règlement)

unemployment insurance overpayment

unemployment insurance overpayment means an overpayment established under the Unemployment Insurance Act, R.S.C. 1985, c. U-1 (the former Act) in accordance with section 159 of the Employment Insurance Act, S.C. 1996, c. 23 and relating to a claim for benefits during a benefit period beginning before the former Act was repealed. (trop-payé d’assurance-chômage)

Remission

 Remission is hereby granted to any person of the interest, including interest on penalties, payable by that person under the Regulations, during the period beginning on April 1, 1996 and ending on June 30, 2002, in respect of unemployment insurance overpayments.

 Except for unemployment insurance overpayments arising from misrepresentation, remission is hereby granted to any person of the interest, including interest on penalties, payable by that person under the Regulations, beginning on July 1, 2002, in respect of unemployment insurance overpayments.

Coming into Force

 This Order comes into force in July 1, 2002.
