Regulations Respecting Zoning at the New Montreal International Airport (Mirabel)
Short Title
1 These Regulations may be cited as the New Montreal International Airport (Mirabel) Zoning Regulations.
Interpretation
2 In these Regulations,
- airport
airport means the New Montreal International Airport (Mirabel), in Mirabel, County of Deux-Montagnes, in the Province of Quebec; (aéroport)
- airport reference point
airport reference point means the airport reference points Alpha and Bravo described in Part I of the schedule; (point de repère de l’aéroport)
- approach surface
approach surface means an imaginary inclined plane extending upward and outward from each end of a strip along and at right angles to the projected centre line thereof, which approach surface is more particularly described in Part III of the schedule; (surface d’approche)
- Minister
Minister means the Minister of Transport; (ministre)
- outer surface
outer surface means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (surface extérieure)
- strip
strip means the rectangular portion of the landing area of the airport, including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (bande)
- transitional surface
transitional surface means an imaginary inclined plane extending upward and outward from the lateral limits of a strip and its approach surface, which transitional surface is more particularly described in Part VI of the schedule. (surface de transition)
3 For the purposes of these Regulations, the airport reference points are deemed to be 234 feet above sea level.
Application
4 These Regulations apply to all the lands and lands under water, including public road allowances, adjacent to or in the vicinity of the airport, the outer limits of which lands are described in Part II of the schedule, other than such lands as from time to time form part of the airport.
General
5 No person shall erect or construct, on any land or any land under water to which these Regulations apply, any building, structure or object, or any addition to any existing building, structure or object the highest point of which will exceed in elevation at the location of that point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,
(a) the approach surfaces;
(b) the outer surface; or
(c) the transitional surfaces.
Natural Growth
6 No owner or occupier of any land to which these Regulations apply shall permit any object of natural growth to exceed in elevation any of the surfaces set out in paragraphs 5(a) to (c) that project immediately over and above the surface of the land at the location of the object.
7 Where an owner or occupier referred to in section 6 permits an object of natural growth to exceed in elevation any of the surfaces set out in paragraphs 5(a) to (c) contrary to section 6, the Minister may make a direction that any person enter upon the land on which the object is growing and remove the excessive growth thereof.
SCHEDULE
PART IAirport Reference Points
The coordinates mentioned hereinafter are in the M.T.M. system in which the central meridian of the zone is 73°30′ West.
The airport reference point “Alpha” is situated at survey marker number 268 and its coordinates are E. 267 656.86 metres (878,139.31 feet) and N. 5 062 987.78 metres (16,610,852.30 feet), latitude 45°42′28″ and longitude 73°58′37″.
The airport reference point “Bravo” is situated at survey marker number 312 and its coordinates are E. 260 582.32 metres (854,928.87 feet) and N. 5 057 524.66 metres (16,592,928.68 feet), latitude 45°39′29″ and longitude 74°04′03″.
PART IIDescription of the Outer Limits of Lands
Each and all of the lands built up or not built up, registry division of Deux-Montagnes, including part of the official cadastre of Mirabel, parts of the parishes of Saint-Jérusalem, Saint-Jérôme, Sainte-Anne-des-Plaines, Saint-Janvier, Sainte-Thérèse-de-Blainville, Saint-Augustin, Sainte-Scholastique, Saint-Benoît, Saint-Canut, Saint-Colomban, Saint-Hermas, registry division of Argenteuil, including part of the parish of Saint-Jérusalem, registry division of Terrebonne, including parts of the parishes of Saint-Jérôme, Sainte-Sophie, Sainte-Anne-des-Plaines, Saint-Janvier, Sainte-Thérèse-de-Blainville and parts of the villages of Saint-Jérôme and Sainte-Thérèse.
COMMENCING at a point situated at the intersection of the lot line between lots 135 and 137 with the southerly limit of a public road (without cadastral designation), registry division of Terrebonne, parish of Saint-Jérôme; THENCE, in a southeasterly direction, along the said lot line to a point situated at the intersection of the said line and the northwesterly limit of the approach surface of strip 06L-24R; THENCE, following the said limit in a direction N. 36°47′59″ E. to a point, which point has as coordinates N. 5 077 579.56 metres and E. 274 385.55 metres; THENCE, following a line having a direction S. 44°40′10″ E., a distance of eighteen thousand five hundred (18,500) feet to a point; which point has as coordinates N. 5 073 569.70 metres and E. 278 349.42 metres; THENCE, following a line having as direction S. 53°51′41″ W., a distance of one thousand nine hundred and seventy-two and three hundredths (1,972.03) feet to a point having as coordinates N. 5 073 215.22 metres and E. 277 864.00 metres; THENCE, following a line having as direction S. 44°40′10″ E., a distance of twelve thousand two hundred and ninety-three (12,293) feet to a point having as coordinates N. 5 070 550.64 metres and E. 280 498.06 metres; THENCE, following a line having as direction S. 53°51′41″ W. to a point situated on the lot line between lot 125 of the parish of Saint-Janvier, registry division of Terrebonne and lot 4 of the cadastre of Mirabel, registry division of Deux-Montagnes; THENCE, following the said lot line and its extension, in a southeasterly direction up to the centre line of rivière Sainte-Marie; THENCE, following the curves of the centre line of the said river, in northwesterly and westerly directions to the intersection of the northwest extension of the lot line between lots 286 and 287, parish of Saint-Janvier, registry division of Terrebonne; THENCE, in a general southeasterly direction, following the said lot line and crossing a public road to a point, which point is the easterly corner of lot 286; THENCE, in a general southwesterly direction, following the boundary line between the parishes of Saint-Janvier and Sainte-Thérèse-de-Blainville, registry division of Terrebonne, to a point, which point is situated at the intersection of the lot line between lots 280 and 281 of the parish of Saint-Janvier and the lot line between lots 875 and 876 of the parish of Sainte-Thérèse-de-Blainville; THENCE, following the said lot line, in a general southeasterly direction to a point, which point is the southerly corner of lot 876; THENCE, in a southwesterly direction, following the lot line between lots 875 and 874 and part of lots 867 and 773 of the parish of Sainte-Thérèse-de-Blainville to a point; THENCE, following the same direction and crossing lot 950 of the parish of Sainte-Thérèse-de-Blainville to a point; THENCE, following the lot line between lots 873, 872, 871, 870, 869 and part of lot 773 of the parish of Sainte-Thérèse-de-Blainville, registry division of Terrebonne to the southerly corner of lot 869; THENCE, following the same direction and crossing a public road (route 117) to the southwesterly right-of-way of the said public road; THENCE, following the said right-of-way, in a general southeasterly direction to the intersection with the northwesterly right-of-way of another public road (Notre-Dame Road), part of lot 770, parish of Sainte-Thérèse-de-Blainville, registry division of Terrebonne; THENCE, following a line having as direction S. 89°41′24″ E. to a point having as coordinates N. 5 058 281.16 metres and E. 278 897.96 metres; THENCE, following a line having as direction S. 08°50′27″ W., a distance of twenty-one thousand (21,000) feet to a point having as coordinates N. 5 051 956.81 metres and E. 277 914.42 metres; THENCE, following a line having as direction N. 72°37′42″ W. to a point, which point is situated on the lot line between lots 362, parish of Saint-Augustin, and 2 of the cadastre of Mirabel, registry division of Deux-Montagnes; THENCE, following a line being the boundary line between the cadastres of Mirabel and Saint-Augustin, in a general westerly direction, to a point, which point is the northeast corner of lot 234; THENCE, following a line, in a general southerly direction, the said line being the lot line between part of lot 234 and lot 228 to a point; THENCE, following the same general direction and crossing a public road (without cadastral designation) to a point; THENCE, in the same general direction, following the lot line between part of lot 234 and lots 229 and 231 to the southeast corner of lot 234 of the parish of Saint-Augustin, registry division of Deux-Montagnes; THENCE, in a general westerly direction, following the lot line between lots 234, 236, 239, 241, 242-103, 243-170, 245, 246 and lots 233, 235, 240, 174, 173, 172, 170, 169 and 168 of the parish of Saint-Augustin, registry division of Deux-Montagnes to a point, which point is the northwest corner of lot 168 of the parish of Saint-Augustin, registry division of Deux-Montagnes; THENCE, following the boundary line between the parishes of Saint-Augustin and Saint-Benoît, registry division of Deux-Montagnes, to a point situated on the north shore of Belle Rivière; THENCE, following the said shore, in a general northwesterly direction to a point situated on the boundary line between the parishes of Saint-Augustin and Sainte-Scholastique; THENCE, following the said boundary line, in a general northwesterly direction to a point, which point is the north corner of lot 298 of the parish of Sainte-Scholastique, registry division of Deux-Montagnes; THENCE, in a southwesterly direction, following the lot line between part of lots 298 and 299 of the same parish and crossing the Belle Rivière to a point situated on the southwest shore of the said river; THENCE, following the said shore, in a general northwesterly direction to a point, which point is situated on the southeasterly limit of the approach surface of strip 06R-24L; THENCE, following the said limit, in a direction S. 36°47′59″ W., to a point having as coordinates N. 5 045 825.06 metres and E. 255 485.58 metres; THENCE, following a line having as direction N. 44°40′10″ W., a distance of eighteen thousand five hundred (18,500) feet to a point having as coordinates N. 5 049 834.87 metres and E. 251 521.62 metres; THENCE, following a line having as direction N. 53°51′41″ E. to a point having as coordinates N. 5 050 189.36 metres and E. 252 007.06 metres; THENCE, following a line having as direction N. 44°40′10″ W. to a point, which point has as coordinates N. 5 052 853.96 metres and E. 249 373.03 metres; THENCE, following a line having as direction N. 53°51′41″ E. to a point having as coordinates N. 5 056 635.90 metres and E. 254 552.01 metres, which point is situated on the arc of a circle with a radius of twenty thousand (20,000) feet and whose centre is the reference point BRAVO, described in Part I of the schedule; THENCE, following the said circle arc, in a general northerly direction to a point whose coordinates are N. 5 057 300.91 metres and E. 254 490.98 metres; THENCE, following a line having as direction N. 89°41′24″ W. to a point whose coordinates are N. 5 057 362.24 metres and E. 243 161.54 metres; THENCE, following a line having as direction N. 08°50′27″ E., a distance of twenty-one thousand (21,000) feet to a point whose coordinates are N. 5 063 686.56 metres and E. 244 145.07 metres; THENCE, following a line having as direction S. 72°37′42″ E., the said line being the northeasterly limit of approach surface 11L-29R to a point situated on a line ninety (90) feet southeast of a proposed power line, the said power line being identified by the following coordinates: at the west end, the coordinates are N. 5 059 181.54 metres and E. 254 844.84 metres and at the northeast end, the coordinates are N. 5 060 216.06 metres and E. 255 891.82 metres; THENCE, in a general northeasterly direction, along a line situated ninety (90) feet southeast of the said power line to a point situated on the southwesterly limit of Poste Lafontaine. The said power line is identified by the following coordinates:
THENCE, in general southeasterly, northeasterly, northwesterly and southwesterly directions, along the limits of Poste Lafontaine to a point situated ninety (90) feet northeast of an existing power line; THENCE, in a general northwesterly direction, along a line parallel to the existing power line at a distance of ninety (90) feet to a point situated on the centre line of Rivière du Nord; THENCE, following the curves of the centre line, in a general northeasterly direction to a point, which point is situated at the intersection of the boundary line between the parish of Saint-Jérôme de Terrebonne and the parish of Saint-Canut des Deux-Montagnes and the centre line of the said river; THENCE, following the said boundary line, in a general northwesterly direction to a point situated on the southeast right-of-way of a public road (without cadastral designation); THENCE, following the said right-of-way, in a general northeasterly direction to a point situated at the intersection of the said right-of-way with the lot line between lots 455 and 456; THENCE, following the said lot line, in a general southeasterly direction, a distance of one thousand eight hundred (1,800) feet to a point; THENCE, following a line at right angles with the foregoing, in a northeasterly direction to a point situated at the intersection of the said line with the lot line between lots 445 and 446; THENCE, following the said lot line, in a general southeasterly direction, a distance of one thousand (1,000) feet to a point; THENCE, following a line at right angles with the foregoing, in a general northeasterly direction to a point, which point is situated on the southwest limit of a public road (route 117); THENCE, following the said limit, in a general southeasterly direction to a point situated at the east corner of lot 116-26; THENCE, following a line crossing the public road, in a general northeasterly direction to a point situated at the intersection of the southerly limit of another public road (without cadastral designation) and the northeast limit of route 117; THENCE, following the southerly limit of the said public road, in a general easterly direction to the point of commencement.

PART IIIDescription of Each Approach Surface
Being imaginary surfaces consisting of
(a) a surface abutting each end of the strips associated with the runways designated 06L-24R, 06R-24L, 06LC-24RC, 06RC-24LC, 11L-29R and 11R-29L, consisting of an inclined plane having a ratio of one (1) foot measured vertically to sixty (60) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of each strip at one hundred and sixty-six and sixty-six hundredths (166.66) feet measured vertically above the elevation at the end of each strip, and ten thousand (10,000) feet measured horizontally from the end of the strip, the outer ends of each imaginary horizontal line being two thousand (2,000) feet from each projected centre line, and
(b) an extension of the surface described in paragraph (a), consisting of an inclined plane having a ratio of one (1) foot measured vertically to fifty (50) feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of each strip at nine hundred and sixty-six and sixty-six hundredths (966.66) feet measured vertically above the elevation at the end of each strip, and fifty thousand (50,000) feet measured horizontally from the end of the strip, the outer ends of each imaginary horizontal line being eight thousand (8,000) feet from each projected centre line,
which approach surfaces are shown on Department of Public Works Plan No. M-4050 dated October 18, 1974.
PART IVDescription of the Outer Surface
Being an imaginary surface consisting of
(a) a common plane established at a constant elevation of one hundred and fifty (150) feet above the assigned elevation of the airport reference point, and
(b) where the common plane described in paragraph (a) is less than thirty (30) feet above the surface of the ground, an imaginary surface located thirty (30) feet above the surface of the ground,
which outer surface is shown on Department of Public Works Plan No. M-4050, dated October 18, 1974.
PART VDescription of Each Strip
The strips measure one thousand (1,000) feet in width, five hundred (500) feet being on each side of the centre line of the runway, and fifteen thousand four hundred (15,400) feet in length, which strips are shown on Department of Public Works Plan No. M-4050, dated October 18, 1974.
PART VIDescription of Each Transitional Surface
Being a surface consisting of an inclined plane rising at a ratio of one (1) foot measured vertically to seven (7) feet measured horizontally at right angles to the centre line and centre line produced of each strip and extending upward and outward from the lateral limits of each strip and its approach surfaces to an intersection with the outer surface or another transitional surface of an adjoining strip, all as shown on Department of Public Works Plan No. M-4050, dated October 18, 1974.
