AERONAUTICS ACT

Regulations Respecting Zoning at Lakehead Airport

Short Title

 These Regulations may be cited as the Lakehead Airport Zoning Regulations.

Interpretation

 In these Regulations,

airport

airport means Lakehead Airport, Thunder Bay, in the Province of Ontario; (aéroport)

airport reference point

airport reference point means the point described in Part I of the schedule; (point de repère de l’aéroport)

approach surface

approach surface means an imaginary inclined plane the lower end of which is a horizontal line at right angles to the centre line of a strip and passing through a point at the strip end on the centre line of the strip; (surface d’approche)

horizontal surface

horizontal surface means an imaginary horizontal plane centering on and located 150 feet above the assigned elevation of the airport reference point; (surface horizontale)

Minister

strip

strip means a rectangular portion of the landing area of the airport, 1,100 feet in width, including the runway, especially prepared for the take-off and landing of aircraft in a particular direction; (bande)

transitional surface

transitional surface means an imaginary inclined plane extending upward and outward from the outer lateral limits of a strip and its approach surface to an intersection with the horizontal surface or other transitional surfaces. (surface de transition)

 For the purposes of these Regulations, the airport reference point is deemed to be 635 feet above sea level.

Application

 These Regulations apply to all lands, including public road allowances, adjacent to or in the vicinity of the airport, as more particularly described in Part II of the schedule.

General

 No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of the highest point any of the surfaces hereinafter set out that project immediately over and above the surface of the land at that location, namely,

  • (a) a horizontal surface, the outer limits of which may be described as follows:

    COMMENCING at the Northeasterly angle of Lot 6, in Concession 4, North of the river, in the Township of Neebing; THENCE, Southerly along the Eastern boundary of said Lot 6 to the Southeasterly angle of the said Lot; THENCE, Easterly in a straight line across Edward Street to the Northwesterly angle of Lot 5, in Concession 3, North of the river; THENCE, Easterly along the Northern boundary of said Lots 5 and 4 to the Northeasterly angle of said Lot 4; THENCE, Southerly along the Eastern boundary of said Lot 4 to the high water mark of the Southern bank of the Neebing River; THENCE, Westerly along the said high water mark to the intersection thereof with a line drawn parallel to and distant 33 feet perpendicularly Westerly from the Eastern boundary of said Lot 4; THENCE, Southerly along the said parallel line and along the Western limit of Tarbutt Street to the Southern limit of Victoria Avenue; THENCE, Easterly along the Southern limit of Victoria Avenue to the intersection thereof with the Northwestern limit of Waterloo Street; THENCE, Southwesterly along the Northwestern limit of Waterloo Street to the intersection thereof with the Northern limit of Arthur Street; THENCE, Westerly along the Northern limit of Arthur Street to the intersection thereof with the production Northerly of the Easterly boundary of Lot 41 as shown on a plan of subdivision registered in the Registry Office for the Registry Division of the District of Fort William as Plan 723; THENCE, Southerly along that production and along the said Easterly boundary of Lot 41 to the Northwestern limit of the right-of-way land of the Canadian National Railway; THENCE, Southwesterly along the said limit of the said right-of-way land to the Northeasterly angle of Lot 160, as shown on Plan 759; THENCE, Easterly in a straight line to the Northwesterly angle of Lot 2, as shown on Plan 725; THENCE, Easterly along the Northern boundary of Lots 2 and 1, as shown on said Plan 725 to the Northeasterly angle of said Lot 1; THENCE, Southwesterly along the Northwestern limit of Kingsway Street to the Southeasterly angle of Lot 31, as shown on Plan 733; THENCE, Southerly in a straight line across Christina Street to the Northeasterly angle of Lot 32, as shown on the said Plan 733; THENCE, Southerly along the Western limit of Ford Street to the intersection thereof with the Northern boundary of Lot “A”, as shown on Plan 735; THENCE, Easterly along the Northern boundary of Lot “A” to the Northeasterly angle of the said Lot; THENCE, Southerly along the Eastern boundary of Lots “A” and “B”, as shown on the said Plan 735 to the natural high water mark of the North bank of the Kaministiqua River; THENCE, in a general Westerly and Southerly direction along the said high water mark to the intersection thereof with a line drawn South 60 degrees 50 minutes East from a point on the Easterly limit of Neebing Avenue the said point being distant 1,263.8 feet measured Southerly along the said Easterly limit from the Southerly limit of Montreal Street; THENCE, North 60 degrees 50 minutes West along the said line and its production Westerly to the intersection thereof with the Eastern boundary of Lot 11, in Concession 1, North of the river; THENCE, Northerly along the Eastern boundary of the said Lot 11 to the Southern limit of Broadway Street; THENCE, Westerly along the said Southern limit to the Western boundary of the said Lot 11; THENCE, Southerly along the said Western boundary and its production Southerly to the intersection thereof with the natural high water mark of the South bank of the said river; THENCE, Westerly along the Southern boundary of the said Concession to the Southwesterly angle of Lot 20; THENCE, Northerly along the Western boundary of said Lot 20 and the production Northerly thereof, to the natural high water mark of the North bank of the Kaministiqua River; THENCE, in a general Northerly and Westerly direction along the said high water mark of the North bank of the river to the intersection thereof with the production Southerly of the Western boundary of Lot 23, in Concession 1, North of the river; THENCE, Northerly along that production and along the Western boundary of said Lot 23 to the Northwesterly angle of the said Lot; THENCE, Northerly in a straight line across the allowance for road between Concession 1 and 2, North of the river, to the Southwesterly angle of Lot 23, in said Concession 2; THENCE, Northerly along the Western boundary of the said Mineral Location and along the Western boundary of the John C. T. Cochrane Mineral Location to the Northwesterly angle thereof; THENCE, Easterly along the Northern boundary of the John C. T. Cochrane Mineral Location to the Northeasterly angle thereof; THENCE, Northerly along the Western boundary of the J. J. Vickers Mineral Location to the Northwesterly angle thereof; THENCE, Easterly along the Northern boundary of the J. J. Vickers Mineral Location to the Northeasterly angle thereof; THENCE, Easterly along the Northern boundary of Section 55, in the said Township of McIntyre to the Northeasterly angle of the said section; THENCE, Southerly along the Eastern boundary of the said section to the Southeasterly angle thereof; THENCE, Easterly along the Northern limit of the said allowance for road between the said Townships to the intersection thereof with the production Northerly of the Eastern boundary of Lot 6, in Concession 4, North of the river, in the Township of Neebing; THENCE, Southerly along that production to the point of commencement; SAVING AND EXCEPTING thereout and therefrom all of the Kaministiqua River lying within the above described parcel,

  • (b) the approach surface abutting each end of the strip designated as 12-30 and extending outward therefrom, the dimensions of which are five hundred and fifty (550) feet on each side of the centre line of the strip at the strip ends and one thousand two hundred and fifty (1,250) feet on each side of the projected centre line of the strip at the outer ends, the said outer end of approach 12 being two hundred (200) feet, and the outer end of approach 30 being two hundred and fifty (250) feet respectively above the elevation at the strip ends and ten thousand (10,000) feet measured horizontally therefrom; and the approach surface abutting each end of the strip designated as 7-25 and extending outward therefrom, the dimensions of which are five hundred and fifty (550) feet on each side of the centre line of the strip at the strip ends and two thousand (2,000) feet on each side of the projected centre line of the strip at the outer ends, the said outer ends being two hundred (200) feet above the elevation at the strip ends and ten thousand (10,000) feet measured horizontally therefrom, and

  • (c) the several transitional surfaces, other than the transitional surfaces associated with the strip designated as 2-20, each rising at an angle determined on the basis of a ratio of one (1) foot vertically for every seven (7) feet horizontally from the outer lateral limits of the strips and their abutting surfaces,

as shown on plan No. T2173 dated September 16, 1964, of record in the Department of Transport.

SCHEDULE(Sections 2 and 4)

PART IAirport Reference Point

COMMENCING at the intersection of the Eastern boundary of Lot Eleven (11), in Concession Three (3), North of the Kaministiqua River, in the Township of Neebing, in the District of Thunder Bay, with the Southern limit of the King’s Highway Number 17, as widened, the said intersection being distant seventeen feet (17′) measured Southerly along the said Eastern boundary from the Northeasterly angle of the said Lot; THENCE, Southerly along the said Eastern boundary of Lot Eleven (11), a distance of one thousand four hundred and eighty-four and twenty-five one-hundredths feet (1,484.25′) to the intersection thereof with the production Northeasterly of the centre line of runway 7-25 of Lakehead Airport; THENCE, Southwesterly along that production and along the said centre line of the said runway, a distance of four thousand and twelve and sixty-four one-hundredths feet (4,012.64′); THENCE, Northwesterly at right angles to the said centre line, a distance of eight hundred feet (800′), to a point henceforth designated as the airport reference point, the said point have an assigned elevation of six hundred and thirty-five feet (635′) above sea level.

ALL AND SINGULAR, those certain parcels or tracts of land and premises, situated, lying and being in the Township of Neebing, in the District of Thunder Bay and Province of Ontario, and which said parcels may be more particularly described hereinafter as Parcels “A” and “B”.

PARCEL “A”: Concession One (1) South of the Kaministiqua River.

Being composed of Lots Eleven (11), Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), Sixteen (16), Seventeen (17), Eighteen (18), Nineteen (19) and Twenty (20), in Concession One (1) South of the Kaministiqua River; part of the Allowance for Road along the South bank of the Kaministiqua River; all of the Allowance for Road between Lots Fifteen (15) and Sixteen (16), in the said Concession; and all of the plans of subdivisions registered in the Registry Office for the Registry Division of the District of Fort William as Plan Numbers 689 and 695, the outermost limits of the said parcel may be more particularly described as follows:

  • (3) All of Lot Twenty-three (23), in said Concession Three (3) as registered in the said Land Titles Office as Parcel 948 (Neebing).

  • (4) Part of Lot Twelve (12), in said Concession Four (4) which may be more particularly described as follows:

    COMMENCING at a point in the Northern limit of the King’s Highway, as widened, according to a plan deposited in the said Registry Office as 3563, distant seven hundred and seventy-nine and eight tenths feet (779.8′) measured South eighty-nine degrees fifty-five minutes thirty seconds East (S89°55′30″E) along the said limit from the intersection thereof with the Western boundary of said Lot Twelve (12); THENCE, North nineteen degrees forty-two minutes thirty seconds West (N19°42′30″W), a distance of four hundred and twenty-five and sixty-six one-hundredths feet (425.66′), more or less, to the High Water Mark of the South bank of the Neebing River; THENCE, Northeasterly along the said High Water Mark to a point thereon perpendicularly distant one hundred and fifty feet (150′) from the production Northerly of the last described courses; THENCE, South nineteen degrees forty-two minutes thirty seconds East (S19°42′30″E) to the said limit of the said Highway; THENCE, North eighty-nine degrees fifty-five minutes thirty seconds West (N89°55′30″W) along the said limit, a distance of one hundred and fifty-nine and four tenths feet (159.4′) to the point of commencement.

    PREMISING that the bearings hereinafter mentioned are astronomical and are referred to the Southern limit of the King’s Highway No. 17, as widened, in Lot Eighteen (18), in Concession Three (3), North of the River, as having a bearing of South eighty-nine degrees fifty-three minutes East (S89°53′E.);

COMMENCING at the intersection of the Eastern boundary of Lot Twelve (12), in Concession Three (3), North of the River, with the Southern limit of the King’s Highway, as widened, according to a plan deposited in the said Registry Office as Number 3563;   • (10) Parcel 2733 being composed of part of Lot Ten (10), in Concession One (1), North of the River, and which may be more particularly described as follows:
