AGRICULTURAL PRODUCTS MARKETING ACT
Regulations Respecting the Licensing in Interprovincial and Export Trade of Persons Engaged in The Marketing of Hogs Produced in Saskatchewan
Short Title
1 These Regulations may be cited as the Saskatchewan Hog Licensing (Interprovincial and Export) Regulations.
Interpretation
2 In these Regulations,
- Act
Act means The Natural Products Marketing Act, 1972 of Saskatchewan; (Loi)
- assembly yard
assembly yard means premises to which producers may deliver their hogs; (parc de groupage)
- assembly yard operator
assembly yard operator means the owner or operator of an assembly yard; (exploitant d’un parc de groupage)
- Commission
Commission means the Saskatchewan Hog Marketing Commission established pursuant to the Act and the Plan; (Commission)
- hog
hog means any member of the species Sus Scrofa L. (domestic pig) produced in Saskatchewan; (porc)
- order buyer
order buyer means any person buying sows at a public auction in an assembly yard for the purpose of reselling to, or on behalf of another person; (courtier en truies)
- Plan
Plan means the Saskatchewan Hog Marketing Plan established and amended from time to time pursuant to the Act; (Plan)
- processor
processor means any person engaged in the business of processing hogs or using hogs in manufacturing; (transformateur)
- producer
producer means
(a) any person engaged in producing or feeding hogs and making them available for slaughter and includes the employer of any such person,
(b) any person who, under any lease or agreement is entitled to a share of the hogs produced or fed by a person referred to in paragraph (a), and
(c) any person who takes possession of any hogs from any person under any form of security for a debt; (producteur)
- purchaser
purchaser means any person purchasing hogs in the province, other than a producer, a processor, a consumer or a livestock dealer licensed in Saskatchewan and includes an order buyer; (acheteur)
- trucker
trucker means a person who operates a vehicle for the transport of hogs on a continued commercial basis. (camionneur)
Application
3 These Regulations apply only to the marketing of hogs in interprovincial and export trade and to persons and property situated in the Province of Saskatchewan.
Licensing
4 (1) No person shall act as a purchaser, a processor, an assembly yard operator or a trucker unless he holds a licence issued by the Commission authorizing such an action.
(2) A licence referred to in subsection (1) shall expire on December 31st next following the day of issue.
Fees and Financial Requirements
5 A licence referred to in section 4 shall be issued upon payment of a fee of
(a) $20 in the case of a purchaser;
(b) $20 per plant in the case of a processor;
(c) $20 per assembly yard, in the case of an assembly yard operator; and
(d) $10 per vehicle, in the case of a trucker.
6 No purchaser, processor, assembly yard operator or trucker shall hold a licence referred to in section 4 unless he is properly bonded and gives to the Commission adequate proof of financial responsibility.
Requirements for Assembly Yards
7 No licence shall be issued to an assembly yard operator unless each assembly yard that he proposes to operate provides the following:
(a) adequate protection from wind and sun;
(b) a concrete floor;
(c) bedding;
(d) water readily available;
(e) adequate pens;
(f) adequate loading facilities during all weather conditions; and
(g) tattooing equipment capable of producing tattoos that are clearly legible.
