AGRICULTURAL PRODUCTS MARKETING ACT

Regulations Respecting the Information Required from Persons Engaged in the Production in Prince Edward Island of Certain Vegetables and the Marketing of them in Interprovincial and Export Trade

Short Title

 These Regulations may be cited as the P.E.I. Vegetable Information (Interprovincial and Export) Regulations.

Interpretation

 In these Regulations,

Commodity Board

Commodity Board means the Prince Edward Island Vegetable Commodity Marketing Board; (Office de commercialisation)

person

person means any individual, firm, partnership, association or corporation that grows or markets the vegetable and includes any servants or agents thereof; (personne)

vegetable

vegetable means any turnip produced in the Province of Prince Edward Island. (légumes)

Application

 These Regulations apply only to vegetable when marketed in interprovincial and export trade and to persons and property situated in the Province of Prince Edward Island.

Records

  •  (1) Every person engaged in the production or marketing of vegetable shall keep complete and accurate records of all matters relating to such production or marketing.

  • (2) Every person referred to in subsection (1) shall, upon the request of the Commodity Board or any member or authorized representative of the Commodity Board, produce to the Commodity Board, member or representative all records referred to in that subsection.

Inspection and Information

  •  (1) Any member or authorized representative of the Commodity Board may at any reasonable time inspect any place or premises used for the production or marketing of vegetable.

  • (2) Every person in possession or control of any place or premises referred to in subsection (1) shall

    • (a) permit any member or authorized representative of the Commodity Board to inspect the place or premises; and

    • (b) furnish any member or authorized representative of the Commodity Board with such information in respect of the production and marketing of vegetable as he may reasonably require.

Appeal

 Any person aggrieved by any act or decision of any member or authorized representative of the Commodity Board may appeal to the Commodity Board and, if not satisfied with the decision of the Commodity Board, may appeal to the Prince Edward Island Marketing Board.
