AGRICULTURAL PRODUCTS MARKETING ACT
Regulations Respecting the Licensing in Interprovincial and Export Trade of Persons Engaged in the Marketing of Flue-Cured Tobacco Produced in Ontario
Short Title
1 These Regulations may be cited as the Ontario Flue-Cured Tobacco Licensing (Interprovincial and Export) Regulations.
Interpretation
2 In these Regulations,
- Act
Act means The Farm Products Marketing Act of Ontario; (Loi)
- Commodity Board
Commodity Board means The Ontario Flue-Cured Tobacco Growers’ Marketing Board established pursuant to the Act and the Plan; (Office de commercialisation)
- Plan
Plan means The Ontario Flue-Cured Tobacco Growers’ Marketing Plan established pursuant to the Act and any regulations made thereunder to give effect to the Plan; (Plan)
- tobacco
tobacco means unmanufactured flue-cured tobacco produced in Ontario. (tabac)
Application
3 These Regulations apply only to the marketing of tobacco in interprovincial and export trade and to persons and property situated in the Province of Ontario.
Licence to Buy Tobacco
4 (1) No person shall act as a buyer of tobacco unless he holds a licence issued by the Commodity Board in the form set out in the schedule.
(2) A licence referred to in subsection (1) shall expire on June 30th of the year next following the year in which the licence was issued.
5 (1) A licence to buy tobacco may be refused where the applicant is not qualified by experience, financial responsibility and equipment to engage in the business of buying tobacco.
(2) A licence to buy tobacco may be suspended, revoked or refused for failure to observe, perform or carry out the provisions of the Act, the regulations made pursuant to the Act or any order or direction of the Commodity Board.
