General Permit Authorizing the Exportation of Certain Eligible Industrial Goods

The Secretary of State for External Affairs, pursuant to subsection 6(1) of the Export Permit Regulations, C.R.C., c. 602, hereby issues the annexed General permit authorizing the exportation of certain eligible industrial goods.

Short Title

 This Permit may be cited as General Export Permit No. Ex. 29 — Eligible Industrial Goods.

Interpretation

 In this Permit,

eligible goods

eligible goods means the goods set out in the schedule; (marchandises admissibles)

Guide

Guide has the same meaning as in section 1 of the Export Control List. (Guide)

General

 Subject to sections 4 and 5, any resident of Canada may, under the authority of this Permit, export eligible goods from Canada.

 This Permit does not authorize the exportation of

  • (a) eligible goods that are described in an item of the Guide other than the item referred to in the schedule;

  • (b) eligible goods to Iran, Iraq, North Korea or any country listed in the Area Control List; or

  • (c) eligible goods to any eligible country or territory within the meaning of section 2 of General Export Permit No. Ex. 30 — Export of Certain Industrial Goods to Eligible Countries and Territories, namely,

    • (i) Australia,

    • (ii) Austria,

    • (iii) Belgium,

    • (iv) Denmark,

    • (v) Finland,

    • (vi) France,

    • (vii) Germany,

    • (viii) Greece,

    • (ix) Hong Kong,

    • (x) Ireland,

    • (xi) Italy,

    • (xii) Japan,

    • (xiii) Luxembourg,

    • (xiv) the Netherlands,

    • (xv) New Zealand,

    • (xvi) Norway,

    • (xvii) Portugal,

    • (xviii) Spain,

    • (xix) Sweden,

    • (xx) Switzerland,

    • (xxi) Turkey, or

    • (xxii) the United Kingdom.

 It is a condition of this Permit that

  • (a) the exporter keep, at the exporter’s place of business or residence, the documents in respect of each export made under this Permit for a period of six years after the date of the export; and

  • (b) on request, make the documents referred to in paragraph (a) available to an officer of the Export Controls Division of the Department of External Affairs.

 Where any goods exported under the authority of this Permit are required to be reported in the prescribed form under the Customs Act, that form shall contain the statement “Exported under the authority of General Export Permit No. Ex. 29 — Eligible Industrial Goods" or "Exporté en vertu de la Licence générale d’exportation no Ex. 29 — Marchandises industrielles admissibles".

SCHEDULE(Section 2)Eligible Goods

  • 1 Industrial goods referred to in Group 1 of the schedule to the Export Control List that are described in the following items of the Guide:

    • (a) item 1014.1., where the software is for equipment described in items 1012.1.d.4. or 1012.1.f.;

    • (b) item 1014.2.;

    • (c) item 1021.;

    • (d) item 1022.1.c.1., except for machine tools for export to aerospace or nuclear end-users or machine tools described in items 1022.1.c.1.b.1., 1022.1.c.1.b.4., 1022.1.c.1.b.5. and 1022.1.c.1.b.6.;

    • (e) item 1022.3.a.;

    • (f) item 1022.6.b.1., except for export to aerospace or nuclear end-users;

    • (g) item 1031.1.a.4.a.;

    • (h) item 1031.1.a.4.b.;

    • (i) item 1031.2.a.1., where

      • (i) the bandwidth does not exceed

        • (A) 4 MHz per track and the equipment has up to 28 tracks, or

        • (B) 2 MHz per track and the equipment has up to 42 tracks,

      • (ii) the tape speed does not exceed 6.1 m/s,

      • (iii) the equipment is not designed for underwater use,

      • (iv) the equipment is not ruggedized for military use, and

      • (v) the recording density does not exceed 653.2 magnetic flux sine waves per mm;

    • (j) item 1031.2.b., where the synthesised output frequency is 2.6 GHz or less and the “frequency switching time” is 0.3 ms or more;

    • (k) item 1031.2.d.2., where the synthesised output frequency is 2.6 GHz or less and the “frequency switching time” is 0.3 ms or more;

    • (l) item 1031.2.h.;

    • (m) item 1032.1.a., except equipment described in items 1032.1.b. and 1032.1.c.;

    • (n) item 1033.2.a., where the resists are not optimized for use with wavelengths of less than 365 nm and are not resists described in items 1033.2.b. to 1033.2.d.;

    • (o) item 1041.3.b., where the “CTP” of the “digital computer” does not exceed 500 Mtops;

    • (p) item 1041.3.c., where the aggregation of “CE” does not create a “digital computer” with a “CTP” exceeding 500 Mtops;

    • (q) item 1041.3.d., where the “three dimensional (3-D) vector rate” does not exceed 3 million;

    • (r) item 1041.3.f.;

    • (s) item 1041.3.g., where the total data transfer rate of the equipment does not exceed 400 MByte/second, unless the equipment is exported for use in interconnecting equipment peripheral to “digital computers” whose “CTP” does not exceed 500 Mtops;

    • (t) item 1044.1., where the “software” is associated with computers that may be exported under this Permit;

    • (u) item 1051.b., except equipment described in items 1051.b.8. and 1051.b.9.;

    • (v) item 1051.c.;

    • (w) item 1051.d.;

    • (x) item 1051.e.;

    • (y) item 1051.f.;

    • (z) item 1052., except equipment related to equipment described in items 1051.a., 1051.b.8. and 1051.b.9.;

    • (z.1) item 1053.;

    • (z.2) item 1054., except “software” related to equipment described in items 1051.a., 1051.b.8. and 1051.b.9.;

    • (z.3) item 1055., but limited to “use” technology for other goods that may be exported under this Permit;

    • (z.4) item 1151., but limited to

      • (i) access control equipment, including automatic teller machines, self-service statement printers and point of sale terminals, that protects password or personal identification numbers (PIN) or similar data to prevent unauthorized access to facilities, but that does not allow for encryption of files or text, except as directly related to the protection of the password or PIN,

      • (ii) data authentication equipment that calculates a Message Authentication Code (MAC) or similar result to ensure that no alteration of text has taken place or to authenticate users, but that does not allow for encryption of data, text or other media other than that needed for the authentication, and

      • (iii) cryptographic equipment specially designed, developed or modified for use in machines for banking or money transactions, such as automatic teller machines, self-service statement printers and point of sale terminals;

    • (z.5) item 1154., but limited to

      • (i) “software” required for the use of equipment that may be exported under this Permit, and

      • (ii) “software” that provides any of the functions of equipment that may be exported under this Permit;

    • (z.6) item 1061.1.a.1.b.4., but limited to systems for use in civil research or civil exploration work;

    • (z.7) item 1061.1.b.;

    • (z.8) item 1061.3.a.1.;

    • (z.9) item 1061.3.a.2., where the goods are designed for non-nuclear use, with a framing speed of not more than 2 million frames per second;

    • (z.10) item 1061.4.f.;

    • (z.11) item 1061.5.a.3., where the CW maximum rated single or multimode output power does not exceed 10 kW;

    • (z.12) item 1061.5.a.4., where the “lasers”

      • (i) are in CW multiple-transverse mode and have a CW output power not exceeding 15 kW, or

      • (ii) have an output wavelength in the range of 9,000 to 11,000 nm, a pulsed output not exceeding 2 J per pulse and a maximum rated average single or multimode output power not exceeding 5 kW;

    • (z.13) item 1061.5.c.2.a.;

    • (z.14) item 1061.5.c.2.c.2.b., where the “peak power” does not exceed 400 MW;

    • (z.15) item 1061.5.c.2.c.3.b., where the average power does not exceed 2 kW;

    • (z.16) item 1061.5.c.2.c.4.b., where the average or CW output power does not exceed 2 kW;

    • (z.17) item 1061.5.d., except goods described in item 1061.5.d.2.;

    • (z.18) item 1061.5.d.2., where the “pulse duration” does not exceed 100 ns or the peak output power does not exceed 15 MW;

    • (z.19) item 1061.5.e.;

    • (z.20) item 1061.5.g., where the goods are for use with “lasers” that are not included in the Export Control List or “lasers” the export of which has been previously authorized;

    • (z.21) item 1061.8.b.;

    • (z.22) item 1061.8.c.;

    • (z.23) item 1061.8.l.1.;

    • (z.24) item 1062.4.b.;

    • (z.25) item 1062.5.;

    • (z.26) item 1063.2.c.;

    • (z.27) item 1063.4.h.;

    • (z.28) item 1064.3.h.;

    • (z.29) item 1081.2.e.2.;

    • (z.30) item 1081.2.i.2., where the manipulators have a maximum 5 degrees of freedom of movement;

    • (z.31) item 1092.1.a.;

    • (z.32) item 1092.1.b.;

    • (z.33) item 1092.1.f.;

    • (z.34) item 1092.1.h.;

    • (z.35) item 1092.5.; and

    • (z.36) 1092.6., except vibration test equipment.

  • 2 Industrial goods referred to in Group 1 of the schedule of the Export Control List that are described in the following items of the Guide, where the goods are shipped for installation and use at ground-based bona fide academic or civilian astronomical research sites or in international air-based or space-based bona fide academic or civilian astronomical research projects and are exported in the following quantities:

    • (a) item 1061.4.a.1., to a maximum quantity of three optical mirrors per project;

    • (b) item 1061.4.a.2., to a maximum quantity of three optical mirrors per project;

    • (c) item 1061.4.a.4., to a maximum quantity of three optical mirrors per project;

    • (d) item 1061.4.b., to a maximum quantity of three optical components per project;

    • (e) item 1061.4.d.1.a., to a maximum quantity of ten optical filters per project;

    • (f) item 1061.4.e.2., to a maximum quantity of one piece of optical control equipment per operational mirror;

    • (g) item 1061.4.e.4., to a maximum quantity of four pieces of optical control equipment per project;

    • (h) item 1063.4.a., to a maximum quantity of three “substrate blanks” per project;

    • (i) item 1063.4.e.2., in the quantity of bulk fluoride glass necessary for each project; and

    • (j) item 1063.4.f., in the quantity of glass necessary for each project.
