General Permit Authorizing the Exportation of Certain Industrial Goods to Eligible Countries and Territories

The Secretary of State for External Affairs, pursuant to subsection 6(1) of the Export Permit Regulations, C.R.C., c. 602, hereby issues the annexed General permit authorizing the exportation of certain industrial goods to eligible countries and territories.

Short Title

 This Permit may be cited as General Export Permit No. Ex. 30 — Certain Industrial Goods to Eligible Countries and Territories.

Interpretation

 In this Permit,

eligible country or territory

  • (a) Australia,

  • (b) Austria,

  • (c) Belgium,

  • (d) Denmark,

  • (e) Finland,

  • (f) France,

  • (g) Germany,

  • (h) Greece,

  • (i) Hong Kong,

  • (j) Ireland,

  • (k) Italy,

  • (l) Japan,

  • (m) Luxembourg,

  • (n) the Netherlands,

  • (o) New Zealand,

  • (p) Norway,

  • (q) Portugal,

  • (r) Spain,

  • (s) Sweden,

  • (t) Switzerland,

  • (u) Turkey, or

  • (v) the United Kingdom; (pays ou territoire admissible)

Guide

Guide has the same meaning as in section 1 of the Export Control List. (Guide)

General

 Subject to sections 4 to 6, any resident of Canada may, under the authority of this Permit, export from Canada industrial goods referred to in Group 1 of the schedule to the Export Control List to an eligible country or territory.

 This Permit does not authorize the exportation of industrial goods referred to in Group 1 of the schedule to the Export Control List that are described in the following items of the Guide:

  • (a) item 1031.2.g.;

  • (b) item 1041.3.b., where the “CTP” of the computers exceeds 1,500 Mtops;

  • (c) item 1044.1., where the software is specially designed or modified for computers that may not be exported under this Permit;

  • (d) item 1044.2., where the software is specially designed or modified to support technology for computers that may not be exported under this Permit;

  • (e) item 1045.1., where the technology is required for the “development”, “production” or “use” of computers that may not be exported under this Permit;

  • (f) item 1045.2.a., where the “CTP” of the associated computer exceeds 1,500 Mtops;

  • (g) item 1045.2.b., where the “CTP” of the associated computer exceeds 1,500 Mtops;

  • (h) item 1151., other than equipment described in subsection 5(1) of this Permit;

  • (i) item 1152.;

  • (j) item 1154., other than equipment described in subsection 5(2) of this Permit;

  • (k) item 1155.;

  • (l) item 1061.1.;

  • (m) item 1061.2.a.1.;

  • (n) item 1061.2.a.2.;

  • (o) item 1061.2.a.3.;

  • (p) item 1061.2.c.;

  • (q) item 1065.1.; and

  • (r) item 1065.2..

  •  (1) This Permit authorizes the exportation of the following equipment described in item 1151 of the Guide:

    • (a) access control equipment, including automatic teller machines, self-service statement printers and point of sale terminals, that protects password or personal identification numbers (PIN) or similar data to prevent unauthorized access to facilities, but that does not allow for encryption of files or text, except as directly related to the protection of the password or PIN;

    • (b) data authentication equipment that calculates a Message Authentication Code (MAC) or similar result to ensure that no alteration of text has taken place or to authenticate users, but that does not allow for encryption of data, text or other media, other than that needed for the authentication; and

    • (c) cryptographic equipment, specially designed, developed or modified for use in machines for banking or money transactions, such as automatic teller machines, self-service statement printers and point of sale terminals.

  • (2) This Permit authorizes the export of software described in item 1154 of the Guide that is required for the use of, or provides the functions of, the equipment described in subsection (1).

 It is a condition of this Permit that

  • (a) the documents in respect of each export made under this permit identify the final consignee;

  • (b) the exporter keep, at the exporter’s place of business or residence, the documents referred to in paragraph (a) for a period of six years after the date of export; and

  • (c) on request, make the documents referred to in paragraph (a) available to an officer of the Export Controls Division of the Department of External Affairs.

 Where any goods exported under the authority of this Permit are required to be reported in the prescribed form under the Customs Act, that form shall contain the statement “Exported under the authority of General Export Permit No. Ex. 30 — Export of Certain Industrial Goods to Eligible Countries and Territories” or “Exporté en vertu de la Licence générale d’exportation no Ex. 30 — Marchandises industrielles vers les pays et territoires admissibles”.
