Ontario Fishery Regulations, 1989

Version of section 29 from 2006-03-22 to 2007-12-31:

  •  (1) No person shall, unless the fish is being prepared for immediate consumption,

    • (a) skin, cut or pack any fish taken by sport fishing in such a manner that

      • (i) the species cannot readily be identified, or

      • (ii) the number cannot readily be counted; or

    • (b) be in possession of any fish that are skinned, cut or packed in contravention of paragraph (a).

  • (2) A person who is in possession of any fish taken by sport fishing for which there is an applicable length limit shall keep the fish in a manner that allows the length to be readily measured, unless the fish

    • (a) are being prepared for immediate consumption;

    • (b) are prepared at an overnight accommodation for storage;

    • (c) are being transported on the water from a temporary overnight accommodation to that person’s primary residence and that person is not engaged in sport fishing; or

    • (d) are being transported overland.

  • (3) Subsection (2) does not apply to a person who is in possession of

    • (a) fish from which samples have been collected for scientific purposes by an employee authorized by the Provincial Minister or a person authorized pursuant to a licence issued under section 36.1; and

    • (b) documentation given by the authorized person or employee and containing information on the samples and their collection including the original size of the fish.
