Marginal note:Failure to exercise

• 29 (1) A participant who has not exercised the entitlement to make a transfer value earnings election before the expiry of the period to exercise it, loses it.

• Marginal note:Ceasing to be a participant

  (2) The entitlement is not lost and the participant is deemed not to have been advised of it if the participant has ceased to be a participant before the expiry of the period.
