Metal and Diamond Mining Effluent Regulations

Version of section 31 from 2006-03-22 to 2006-10-02:

  •  (1) Any person required by subsection 38(4) of the Act to report the occurrence of a deposit out of the normal course of events of a deleterious substance within the meaning of subsection 34(1) of the Act, or to report if there is a serious and imminent danger of such a deposit, shall without delay report the occurrence or danger to an inspector or to an authority prescribed in section 29 and shall, if a deposit has occurred, submit a written report to the inspector or the authority as soon as possible in the circumstances and in any event not later than 30 days after the deposit occurred.

  • (2) The written report shall contain

    • (a) the name, description and concentration of the deleterious substance deposited;

    • (b) the estimated quantity of the deposit and how the estimate was achieved;

    • (c) the quantity of any deleterious substance that was deposited at a place other than through a final discharge point;

    • (d) the quantity of any deleterious substance that was deposited through a final discharge point; and

    • (e) the circumstances of the deposit, the measures that were taken to mitigate the effects of the deposit and, if the emergency response plan was implemented, details concerning its implementation.
