Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands ActFootnote a, hereby makes the annexed Withdrawal from Disposal of Certain Tracts of Territorial Lands in the Northwest Territories (Saoyú–Æehdacho (Grizzly Bear Mountain and Scented Grass Hills) National Historic Site) Order.

Purpose

 The purpose of this Order is to withdraw from disposal certain tracts of territorial lands to facilitate the establishment of the Saoyú–Æehdacho (sow-you/eh-dah-cho) (Grizzly Bear Mountain and Scented Grass Hills) National Historic Site in the Sahtu Region of the Northwest Territories.

Lands Withdrawn from Disposal

 The tracts of territorial lands set out in Schedules 1 to 4, including the subsurface rights to the lands, are withdrawn from disposal on the day on which this Order is made.

Existing Rights and Interests

 For greater certainty, section 2 does not apply to

  • (a) the locating of a mineral claim by the holder of a prospecting permit granted before the day on which this Order is made;

  • (b) the recording of a mineral claim that is referred to in paragraph (a) or that was located before the day on which this Order is made;

  • (c) the granting of a lease under the Northwest Territories and Nunavut Mining Regulations to a person with a recorded claim, if the lease covers an area in the recorded claim;

  • (d) the issuance of a significant discovery licence under the Canada Petroleum Resources Act to a holder of an exploration licence that was issued before the day on which this Order is made, if the significant discovery licence covers an area subject to the exploration licence;

  • (e) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of a significant discovery licence that is referred to in paragraph (d), if the production licence covers an area subject to the significant discovery licence;

  • (f) the issuance of a production licence under the Canada Petroleum Resources Act to a holder of an exploration licence or a significant discovery licence that was issued before the day on which this Order is made, if the production licence covers an area subject to the exploration licence or the significant discovery licence;

  • (g) the granting of a surface lease under the Territorial Lands Act to a holder of a recorded claim under the Northwest Territories and Nunavut Mining Regulations or of an interest under the Canada Petroleum Resources Act, if the surface lease is required to allow the holder to exercise rights under the claim or interest; or

  • (h) the renewal of an interest.

In the Northwest Territories;

All that parcel of land more particularly described as follows, all topographic features hereinafter referred to being according to:

Edition 4 of the Cape MacDonnel National Topographic System (“NTS”) map sheet number 96 J, produced at a scale of 1:250 000;

Edition 3 of the Kilekale Lake National Topographic System (“NTS”) map sheet number 96 J, produced at a scale of 1:250 000;

Edition 2 of the Fort Franklin National Topographic System (“NTS”) map sheet number 96 G, produced at a scale of 1:250 000;

Edition 3 of the Grizzly Bear Mountain National Topographic System (“NTS”) map sheet number 96 H, produced at a scale of 1:250 000.

All boundary monuments and boundary of Lot 1000, Quad 96 G/15 hereinafter referred to being according to Plan 90772 Canada Lands Survey Records (“CLSR”) / 4033 Northwest Territories Land Titles Office (“LTO”);

All coordinates are referred to the 1983 North American Datum, Canadian Spatial Reference System (NAD83 CSRS) and any references to straight lines mean points joined directly on the NAD83 Universal Transverse Mercator (UTM) projection plane surface.

Commencing at boundary monument 75L1000 on Lot 1000, Quad 96 G/15 at approximate latitude 66°05′45″N and approximate longitude 122°46′06″W;

Thence northerly and northwesterly along said lot boundary to the ordinary high-water mark of Mackintosh Bay of Great Bear Lake at approximate latitude 66°08′17″N and approximate longitude 123°00′12″W;

Thence generally northerly, easterly, southerly and westerly along the ordinary high water mark of Mackintosh Bay, Smith Arm, Douglas Bay and Deerpass Bay of Great Bear Lake to a point of intersection with the boundary of Lot 1000, Quad 96 G/15 at approximate latitude 65°59′45″N and approximate longitude 122°27′47″W;

Thence generally northerly and westerly along said lot boundary through boundary monuments 72L1000, 73L1000 and 74L1000 to the point of commencement.

Said parcel containing approximately 1 975 km2 (763 square miles).

In the Northwest Territories;

All that parcel of land more particularly described as follows, all topographic features hereinafter referred to being according to:

Edition 3 of the Kilekale Lake National Topographic System (“NTS”) map sheet number 96 J, produced at a scale of 1:250 000;

Edition 2 of the Fort Franklin National Topographic System (“NTS”) map sheet number 96 G, produced at a scale of 1:250 000.

Thence northerly in a straight line to the intersection of the north boundary of Lot 1000, Quad 96 G/15 at longitude 123°20′35″W and approximate latitude 66°08′18″N being on the ordinary high-water mark of Mackintosh Bay of Great Bear Lake;

Thence easterly along the ordinary high-water mark of Mackintosh Bay of Great Bear Lake and continuing along said lot boundary through boundary monuments 75L1000 through 72L1000;

Thence following said boundary to, and along, the ordinary high-water mark of Deerpass Bay of Great Bear Lake to the point of commencement.

Said parcel containing approximately 680 km2 (262 square miles).

All boundary monuments and boundary of Lot 1000, Quad 96 A/12 hereinafter referred to being according to Plan 81115 Canada Lands Survey Records (“CLSR”) / 3190 Northwest Territories Land Titles Office (“LTO”);

All coordinates are referred to the 1983 North American Datum, Canadian Spatial Reference System (NAD83 CSRS) and any references to straight lines mean points joined directly on the NAD83 Universal Transverse Mercator (UTM) projection plane surface.

Commencing at boundary monument 7L1000 on the north boundary of Lot 1000, Quad 96 A/12 at approximate latitude 65°00′00″N and approximate longitude 121°29′21″W;

Thence westerly along said lot boundary to its point of intersection with the ordinary high-water mark of Keith Arm of Great Bear Lake at approximate latitude 65°00′24″N and approximate longitude 121°48′12″W;

Thence northerly, northeasterly, easterly, southwesterly and southerly along the ordinary high-water mark of Keith Arm and McVicar Arm of Great Bear Lake to its intersection with the north boundary of Lot 1000, Quad 96 A/12 at approximate latitude 65°01′19″N and approximate longitude 120°58′54″W;

Thence continuing northerly, northwesterly and westerly along the north boundary of said lot to the point of commencement.

Said parcel containing approximately 2 475 km2 (956 square miles).

Thence southwesterly along said lot boundary to its intersection with longitude 122°00′00″W at approximate latitude 64°58′24″N;

Thence southerly along the meridian of longitude to the intersection of the boundary of said lot at longitude 122°00′00″W and approximate latitude 64°55′00″N;

Thence easterly and southeasterly along said lot boundary to boundary monument 40L1000 at approximate latitude 64°53′30″N and approximate longitude 121°53′57″W;

Thence easterly along said lot boundary to boundary monument 39L1000 at approximate latitude 64°53′30″N and approximate longitude 121°48′22″W;

Thence easterly in a straight line to a point of intersection with the boundary of said lot at latitude 64°53′30″N and approximate longitude 121°30′45″W, being a point on the ordinary high-water mark of MacVicar Arm of Great Bear Lake;

Thence northerly, northeasterly and westerly along said lot boundary to the point of commencement.

Said parcel containing approximately 435 km2 (168 square miles).
