CANADA PENSION PLAN

Regulations Respecting the Assigning of Social Insurance Numbers

Short Title

 These Regulations may be cited as the Canada Pension Plan (Social Insurance Numbers) Regulations.

Interpretation

 In these Regulations,

Act

Act means the Canada Pension Plan; (Loi)

Card

Card means a Social Insurance Number Card; (carte)

Commission

Commission means the Canada Employment Insurance Commission; (Commission)

local office of the Commission

local office of the Commission means an office established by the Commission in any locality, and includes any office designated as such by the Commission and, in relation to an employer, the nearest local office servicing the area of their place of business and, in relation to any other person, the local office nearest to their residence; (bureau local de la Commission)

Manner of Making Application

  •  (1) Every individual who is required by the Act to file an application with the Minister or to apply to the Minister for the assignment to him of a Social Insurance Number shall do so by delivering or mailing to a local office of the Commission an application, in the form prescribed by the Minister for that purpose, containing

    • (a) their full name;

    • (b) their name at birth if it differs from their name at the time of application;

    • (c) their date of birth;

    • (d) their place of birth;

    • (e) their mother's surname at her birth;

    • (f) the first given name of their father; and

    • (g) any other information required in the form prescribed by the Minister.

  • (2) Every individual who changes their name, by reason of marriage or otherwise, and who is required by the Act to inform the Minister of their new name shall do so by delivering or mailing to a local office of the Commission a notification, in the form prescribed for that purpose, containing

    • (a) the information required by subsection (1) in respect of an application for the assignment of a Social Insurance Number;

    • (b) their Social Insurance Number; and

    • (c) their full name before the change of name.

  • (3) Every individual whose Card has been lost or destroyed may apply to the Minister for a new Card by delivering or mailing to a local office of the Commission an application, in the form prescribed for that purpose, containing

    • (a) the information required by subsection (1) in respect of an application for the assignment of a Social Insurance Number; and

    • (b) their Social Insurance Number, or if it is unknown, a statement that they were previously assigned a Social Insurance Number.

  • (4) Every individual who expects to be an individual required by the Act to file an application with the Minister or to apply to the Minister for the assignment to them of a Social Insurance Number may, if they have not earlier been assigned a Social Insurance Number, make application, on the form and in the manner specified in subsection (1), for the assignment to them of a Social Insurance Number.

Sources of Application Forms

 Applications in the form prescribed by the Minister for the purposes of section 3 may be obtained from

  • (a) any post office;

  • (b) any local office of the Commission;

  • (c) any office of the Department of National Revenue; and

  • (d) any office of the Department of Employment and Social Development.

Duties of Employer

 An employer who requires an employee to inform them of their Social Insurance Number shall provide the employee with the appropriate form to apply for a Social Insurance Number or Card if the employer ascertains that the employee

  • (a) has not had a Social Insurance Number assigned to them;

  • (b) has changed their name since their Social Insurance Number was assigned; or

  • (c) has lost their Social Insurance Card or it has been destroyed.

  •  (1) If an employee fails to inform their employer of their Social Insurance Number within the period set out in subsection 98(6) of the Act, the employer shall, within three days after the expiry of the period, report the circumstances of the failure to the local office of the Commission and provide it with the information necessary to identify the employee.

  • (2) If an employee who has been reported under subsection (1) subsequently informs the employer of their Social Insurance Number, the employer shall immediately notify the local office of the Commission.

Authority of Minister

 The Minister or the Minister of National Revenue may cause a Social Insurance Number to be assigned to an individual who has not been assigned a Social Insurance Number.

 The Minister or the Minister of National Revenue may cause a Card to be issued to an individual to whom a Social Insurance Number was caused to be assigned under section 7.
