Marginal note:Where collective agreement conflicts with Act

  •  (1) In the case of a pension plan that was registered under the Pension Benefits Standards Act immediately before January 1, 1987 and is governed by one or more collective agreements entered into during the period beginning on December 17, 1985 and ending on December 31, 1986, where the terms of the pension plan conflict with the provisions of this Act, the terms of the pension plan prevail until the date of expiration of the collective agreement or the end of December 1988, whichever is earlier, after which time the provisions of this Act prevail.

    (2) In the case of a pension plan that was registered under the Pension Benefits Standards Act immediately before January 1, 1987 and is governed by one or more collective agreements entered into before December 17, 1985, where the terms of the pension plan conflict with the provisions of this Act, the terms of the pension plan prevail until the date of expiration of the collective agreement or the end of December 1990, whichever is earlier, after which time the provisions of this Act prevail.
