T-15, s. 4; 1984, c. 40, s. 72</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="451994" lims:id="451994"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="451995" lims:id="451995">Duties of Secretary</MarginalNote><Label>6</Label><Text>The Secretary shall, unless otherwise directed in any case by the Minister,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="451996" lims:id="451996"><Label>(a)</Label><Text>keep separate accounts of the moneys appropriated for and expended on each railway or canal under the management, charge and direction of the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="451997" lims:id="451997"><Label>(b)</Label><Text>submit those accounts to be audited in such manner as is determined by law or by the Governor in Council;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="451998" lims:id="451998"><Label>(c)</Label><Text>have charge of all plans, contracts, estimates, documents, titles, models and other like things relating to any railway or canal under the management, charge and direction of the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="451999" lims:id="451999"><Label>(d)</Label><Text>keep proper accounts with each contractor or other person employed by or under the Department;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452000" lims:id="452000"><Label>(e)</Label><Text>ensure that all contracts are properly drawn up and executed;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452001" lims:id="452001"><Label>(f)</Label><Text>prepare all certificates on which any certificate for the payment of money is to issue;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452002" lims:id="452002"><Label>(g)</Label><Text>keep minutes of all proceedings of the Department;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452003" lims:id="452003"><Label>(h)</Label><Text>prepare reports and conduct, under the direction of the Minister, the correspondence of the Department; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452004" lims:id="452004"><Label>(i)</Label><Text>generally, do and perform all such acts and things appertaining to the business of the Department as are required by the Minister.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452006" lims:id="452006">R.S., c. T-15, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="452007" lims:id="452007" level="1"><TitleText>Powers, Duties and Functions of the Minister</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452008" lims:id="452008"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452009" lims:id="452009">Minister’s responsibilities for canals</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452010" lims:id="452010"><Label>(1)</Label><Text>The Minister has the management, charge and direction of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452011" lims:id="452011"><Label>(a)</Label><Text>all Government canals and works and property pertaining or incidental to them;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452012" lims:id="452012"><Label>(b)</Label><Text>the collection of tolls on the canals and matters incidental to their collection; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452013" lims:id="452013"><Label>(c)</Label><Text>the officers and persons employed on the canals.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452014" lims:id="452014"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452015" lims:id="452015">Idem</MarginalNote><Label>(2)</Label><Text>The Minister has and may exercise and carry out any of the powers, duties and functions vested, immediately prior to November 2, 1936, in the Minister of Marine and with respect to civil aviation in the Minister of National Defence, by any Act, order or regulation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452016" lims:id="452016"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452017" lims:id="452017">Minister to have supervision over boards, etc.</MarginalNote><Label>(3)</Label><Text>The powers, duties and functions of the Minister extend and apply to such boards and other public bodies, subjects, services and properties of the Crown as may be designated or assigned to the Minister by the Governor in Council, over and of which the Minister shall have the control, regulation, management and supervision.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452019" lims:id="452019">R.S., 1985, c. T-18, s. 7; 1996, c. 10, s. 271.1</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452020" lims:id="452020"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452021" lims:id="452021">Inquiries</MarginalNote><Label>7.1</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452022" lims:id="452022"><Label>(1)</Label><Text>The Minister may, with the approval of the Governor in Council, appoint and direct any person to inquire into and report on any matter or thing that the Minister is authorized to deal with under the <XRefExternal reference-type="act" link="C-10.4">Canada Transportation Act</XRefExternal> or under a Special Act as defined in section 87 of that Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452023" lims:id="452023"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452024" lims:id="452024">Powers on inquiries</MarginalNote><Label>(2)</Label><Text>Section 39 of the <XRefExternal reference-type="act" link="C-10.4">Canada Transportation Act</XRefExternal> applies, with such modifications as the circumstances require, in respect of any inquiry under subsection (1) and every person summoned to attend before a person making any such inquiry is entitled to receive the like fees and allowances for so doing as if summoned to attend before the Federal Court.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452026" lims:id="452026">R.S., 1985, c. 28 (3rd Supp.), s. 353; 1996, c. 10, s. 272</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452027" lims:id="452027"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452028" lims:id="452028">Construction or repair of works</MarginalNote><Label>8</Label><Text>The Minister shall direct the construction, maintenance and repair of all railways and canals and of all other works appertaining or incidental thereto that are constructed or maintained at the expense of Canada and are placed under the Minister’s management, charge and direction.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452030" lims:id="452030">R.S., c. T-15, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="452031" lims:id="452031" level="1"><TitleText>Examination Under Oath</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452032" lims:id="452032"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452033" lims:id="452033">Persons and documents</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452034" lims:id="452034"><Label>(1)</Label><Text>The Minister may</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452035" lims:id="452035"><Label>(a)</Label><Text>summon and examine, on oath, all such persons as the Minister deems necessary with respect to any matter on which the Minister’s action is required;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452036" lims:id="452036"><Label>(b)</Label><Text>cause those persons to bring with them such papers, plans, books, documents and things as it is necessary to examine with reference to the matter; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452037" lims:id="452037"><Label>(c)</Label><Text>pay those persons a reasonable compensation for their time and disbursements.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452038" lims:id="452038"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452039" lims:id="452039">Punishment for neglecting to attend</MarginalNote><Label>(2)</Label><Text>Every person summoned by the Minister under subsection (1) who, after due notice of the summons, neglects or refuses to attend and be examined is guilty of an offence and liable on summary conviction to a fine not exceeding twenty dollars.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452041" lims:id="452041">R.S., c. T-15, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="452042" lims:id="452042" level="1"><TitleText>Contracts, Tender and Security</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452043" lims:id="452043"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452044" lims:id="452044">Security to be required</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452045" lims:id="452045"><Label>(1)</Label><Text>The Minister, in all cases in which any public work under the Minister’s control is being carried out by contract, shall take all reasonable care that good and sufficient security is given to and in the name of Her Majesty for the due performance of the work within the amount and time specified for its completion.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452046" lims:id="452046"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452047" lims:id="452047">Passing by lowest tender</MarginalNote><Label>(2)</Label><Text>In all cases in which it seems to the Minister not to be expedient to let any work described in subsection (1) to the lowest tenderer, the Minister shall report the same and obtain the authority of the Governor in Council before passing by the lowest tender.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452049" lims:id="452049">R.S., c. T-15, s. 17</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="452071" lims:id="452071" level="1"><TitleText>Tolls on Canals</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452072" lims:id="452072"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452073" lims:id="452073">Imposition of tolls</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452074" lims:id="452074"><Label>(1)</Label><Text>The Governor in Council may impose and authorize the collection of tolls and dues on any canal, alter and change them and declare exemptions therefrom.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452075" lims:id="452075"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452076" lims:id="452076">Tolls payable in advance</MarginalNote><Label>(2)</Label><Text>The tolls and dues imposed under subsection (1) are, if so demanded by the collector thereof, payable before the right to the use of the canal in respect of which they are incurred accrues.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452077" lims:id="452077"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452078" lims:id="452078">Recovery</MarginalNote><Label>(3)</Label><Text>All tolls and dues imposed under this Act may be recovered, with costs, in any court of competent jurisdiction by the collector or person appointed to receive them, in the name of the collector or of that person or in the name of Her Majesty, and by any form of proceeding by which debts to the Crown are recoverable.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452079" lims:id="452079"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452080" lims:id="452080">Goods on board liable</MarginalNote><Label>(4)</Label><Text>The goods on board any steamboat, vessel, raft, crib or other craft, to whomever they belong, are liable for any tolls, dues or fines imposed and levied under this Act and may be seized, detained and sold in the same manner as the steamboat, vessel, raft, crib or other craft in which they are, and as if they belonged to the person contravening any regulation in that respect, saving the recourse of the real owner thereof against the person who is deemed the owner for the purposes of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452081" lims:id="452081"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452082" lims:id="452082">Tolls on the upper St. Lawrence</MarginalNote><Label>(5)</Label><Text>The same tolls are payable on steamboats or vessels of any kind, and passengers, taken down the St. Lawrence River past any of the canals between Montreal and Kingston, as would be payable on those steamboats, vessels or passengers, if they had been taken through the canal or canals past which they are so taken down, and those tolls shall be levied in like manner and under the like fines and forfeitures for the non-payment thereof.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452084" lims:id="452084">R.S., c. T-15, s. 24</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="452089" lims:id="452089" level="1"><TitleText>Regulations for Use of Canals</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452090" lims:id="452090"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452091" lims:id="452091">Management of canals and tolls</MarginalNote><Label>16</Label><Text>The Governor in Council may make such regulations as the Governor in Council deems necessary for the management, maintenance, proper use and protection of the canals or other works under the management, charge and direction or the control of the Minister, and for the ascertaining and collection of the tolls, dues and revenues thereon.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452093" lims:id="452093">R.S., c. T-15, s. 25</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="452094" lims:id="452094"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452095" lims:id="452095">Fines and enforcement</MarginalNote><Label>17</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452096" lims:id="452096"><Label>(1)</Label><Text>The Governor in Council may, by the regulations mentioned in section 16,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452097" lims:id="452097"><Label>(a)</Label><Text>impose such fines, not exceeding in any one case four hundred dollars, for any contravention of a regulation, as the Governor in Council deems necessary for ensuring its observance and the payment of the tolls and dues imposed;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452098" lims:id="452098"><Label>(b)</Label><Text>provide for the non-passing or detention and seizure at the risk of the owner of any steamboat, vessel, raft, crib or other craft, timber or goods</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="452099" lims:id="452099"><Label>(i)</Label><Text>on which tolls or dues have accrued and have not been paid,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="452100" lims:id="452100"><Label>(ii)</Label><Text>in respect of which a regulation has otherwise been contravened or any injury done to a canal and not paid for, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="452101" lims:id="452101"><Label>(iii)</Label><Text>for or on account of which a fine remains unpaid; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="452102" lims:id="452102"><Label>(c)</Label><Text>provide for the sale of anything detained or seized under a regulation pursuant to paragraph (b) if the tolls, dues, damages or fine are not paid by the time fixed therefor, and for the payment of the amounts due out of the proceeds of the sale.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452103" lims:id="452103"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452104" lims:id="452104">Surplus proceeds</MarginalNote><Label>(2)</Label><Text>The surplus proceeds, if any, of a sale referred to in paragraph (1)(c) shall be returned to the owner or the owner’s agent.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="452105" lims:id="452105"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="452106" lims:id="452106">Crown’s rights not impaired</MarginalNote><Label>(3)</Label><Text>No regulation made under section 16 and this section impairs the right of the Crown to recover in the ordinary course of law unpaid tolls, dues, fines or damages.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="452108" lims:id="452108">R.S., c.
