(<DefinedTermFr>bateau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025119" lims:id="1025119" generate-in-text="no"><Text><DefinedTermEn>channel</DefinedTermEn> means the Leamy Lake navigation channel described in Schedule 1. (<DefinedTermFr>chenal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025120" lims:id="1025120" generate-in-text="no"><Text><DefinedTermEn>Commission employee</DefinedTermEn> includes a person acting on behalf of the Commission under a contract or other agreement. (<DefinedTermFr>employé de la Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025121" lims:id="1025121" generate-in-text="no"><Text><DefinedTermEn>control booth operator</DefinedTermEn> means the Commission employee operating the control booth situated at the Gatineau River entrance to the channel. (<DefinedTermFr>préposé du poste de contrôle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025122" lims:id="1025122" generate-in-text="no"><Text><DefinedTermEn>motorboat</DefinedTermEn> means a motorized boat that</Text><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025123" lims:id="1025123"><Label>(a)</Label><Text>is used exclusively for pleasure; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025124" lims:id="1025124"><Label>(b)</Label><Text>is designed to carry fewer than 10 passengers and is ordinarily used to carry them for remuneration. (<DefinedTermFr>bateau à moteur</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025125" lims:id="1025125" generate-in-text="no"><Text><DefinedTermEn>motor fuel</DefinedTermEn> includes gasoline, fuel oil and diesel fuel. (<DefinedTermFr>carburant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025126" lims:id="1025126" generate-in-text="no"><Text><DefinedTermEn>peace officer</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025127" lims:id="1025127"><Label>(a)</Label><Text>a member of the Royal Canadian Mounted Police, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>, designated as a peace officer under paragraph 7(1)(d) of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025128" lims:id="1025128"><Label>(b)</Label><Text>a police officer in the police department of the City of Gatineau, in the Province of Quebec; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025129" lims:id="1025129"><Label>(c)</Label><Text>a supernumerary special constable appointed under paragraph 7(1)(c) of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal> for the purposes of these Regulations and designated as a peace officer under paragraph 7(1)(d) of that Act. (<DefinedTermFr>agent de la paix</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025130" lims:id="1025130" generate-in-text="no"><Text><DefinedTermEn>shuttle boat</DefinedTermEn> means a motorized boat that is designed to carry 10 or more passengers and is ordinarily used to carry them for remuneration. (<DefinedTermFr>bateau-mouche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-05-31" lims:fid="1025131" lims:id="1025131" generate-in-text="no"><Text><DefinedTermEn>waiting area</DefinedTermEn> means the area of the channel described in Schedule 2. (<DefinedTermFr>aire d’attente</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-05-31" lims:fid="1025133" lims:id="1025133">SOR/2007-113, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1025134" lims:id="1025134" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1025135" lims:id="1025135"><Label>2</Label><Text>These Regulations do not apply to peace officers or Commission employees acting in the course of their employment or duties, other than the control booth operator acting under sections 10 to 12.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1025136" lims:id="1025136" level="1"><TitleText>Prohibitions and Obligations</TitleText></Heading><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025137" lims:id="1025137"><Label>3</Label><Text><Repealed>[Repealed, SOR/2007-113, s. 2]</Repealed></Text></Section><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025138" lims:id="1025138"><Label>4</Label><Text>No person may, in the channel,</Text><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025139" lims:id="1025139"><Label>(a)</Label><Text>swim or bathe;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025140" lims:id="1025140"><Label>(b)</Label><Text>do anything that unreasonably interferes with another person’s use of the channel;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025141" lims:id="1025141"><Label>(c)</Label><Text>behave in a manner that endangers public safety;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025142" lims:id="1025142"><Label>(d)</Label><Text>stop a boat anywhere outside the waiting area, except in the case of an emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025143" lims:id="1025143"><Label>(e)</Label><Text>anchor a boat, except in the case of an emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025144" lims:id="1025144"><Label>(f)</Label><Text>dump sewage or other waste;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025145" lims:id="1025145"><Label>(g)</Label><Text>dump motor fuel or motor oil;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025146" lims:id="1025146"><Label>(h)</Label><Text>sell motor fuel or motor oil or supply a motorboat or a shuttle boat with motor fuel or motor oil; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025147" lims:id="1025147"><Label>(i)</Label><Text>fuel a motorboat or a shuttle boat with motor fuel or add motor oil to a motorboat’s engine or a shuttle boat’s engine, except in the case of an emergency.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-05-31" lims:fid="1025149" lims:id="1025149">SOR/2007-113, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025150" lims:id="1025150"><Label>5</Label><Text>No person may operate a boat in the channel if the dimensions, configuration, draught or condition of the boat or the goods or equipment on it could</Text><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025151" lims:id="1025151"><Label>(a)</Label><Text>endanger public safety; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025152" lims:id="1025152"><Label>(b)</Label><Text>delay or obstruct navigation.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-05-31" lims:fid="1025154" lims:id="1025154">SOR/2007-113, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025155" lims:id="1025155"><Label>6</Label><Subsection lims:inforce-start-date="2007-05-31" lims:fid="1025156" lims:id="1025156"><Label>(1)</Label><Text>Every person operating a boat in the channel shall comply with the instructions of a peace officer, the control booth operator or any other Commission employee acting in the course of their employment or duties in respect of the safe and orderly use of the channel.</Text></Subsection><Subsection lims:inforce-start-date="2007-05-31" lims:fid="1025157" lims:id="1025157"><Label>(2)</Label><Text>Every person operating a motorboat or a shuttle boat in the channel shall obey the signal lights in the channel, unless otherwise instructed by a peace officer, the control booth operator or any other Commission employee acting in the course of their employment or duties.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-05-31" lims:fid="1025159" lims:id="1025159">SOR/2007-113, s. 5, err.(E), Vol. 152, No. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025160" lims:id="1025160"><Label>7</Label><Text>Every person operating a boat in the channel shall control the boat in a manner that minimizes its wake in order to avoid endangering public safety or causing damage to the shoreline, to any other boat or to any structure or object.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-05-31" lims:fid="1025162" lims:id="1025162">SOR/2007-113, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1025163" lims:id="1025163" level="1"><TitleText>Permission to Enter Channel</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1025164" lims:id="1025164"><Label>8</Label><Text>Sections 9 to 12 apply during the hours of operation of the control booth set out by the Commission on a sign posted on the booth.</Text></Section><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025165" lims:id="1025165"><Label>9</Label><Text>No person operating a motorboat or a shuttle boat may enter the channel from the Gatineau River unless the control booth operator has given the person permission to enter the channel.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2007-05-31" lims:fid="1025167" lims:id="1025167">SOR/2007-113, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1025168" lims:id="1025168"><Label>10</Label><Text>Subject to section 12, the control booth operator shall give a person operating a motorboat permission to enter the channel if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1025169" lims:id="1025169"><Label>(a)</Label><Text>there are fewer than 20 motorboats in the channel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1025170" lims:id="1025170"><Label>(b)</Label><Text>there are fewer than 25 motorboats in total in the channel and Lac de la Carrière.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1025171" lims:id="1025171"><Label>11</Label><Text>Subject to section 12, the control booth operator shall give a person operating a shuttle boat permission to enter the channel if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1025172" lims:id="1025172"><Label>(a)</Label><Text>there are no shuttle boats in the channel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1025173" lims:id="1025173"><Label>(b)</Label><Text>there is not more than one shuttle boat in Lac de la Carrière.</Text></Paragraph></Section><Section lims:inforce-start-date="2007-05-31" lims:lastAmendedDate="2007-05-31" lims:fid="1025174" lims:id="1025174"><Label>12</Label><Text>The control booth operator shall deny a person operating a boat permission to enter the channel if</Text><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025175" lims:id="1025175"><Label>(a)</Label><Text>the control booth operator believes, on reasonable grounds, that the person is impaired by alcohol or drugs;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025176" lims:id="1025176"><Label>(b)</Label><Text>the person is behaving in a manner that endangers public safety;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-05-31" lims:fid="1025177" lims:id="1025177"><Label>(c)</Label><Text>the channel is blocked by a disabled boat;
