lims:inforce-start-date="2016-06-14" lims:fid="1012358" lims:id="1012358" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1012359" lims:id="1413575" generate-in-text="no"><Text><DefinedTermEn>advance ruling</DefinedTermEn> means an advance ruling referred to in Article 509 of NAFTA, Article 5.8 of CIFTA, Article E-09 of CCFTA, Article V.9 of CCRFTA, Article 28 of Annex C of CEFTA, Article 419 of CPFTA, Article 419 of CCOFTA, Article 5-9 of CJFTA, Article 4.10 of CPAFTA or Article 5.10 of CHFTA. (<DefinedTermFr>décision anticipée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="1012360" lims:id="1012360" generate-in-text="no"><Text><DefinedTermEn>commercial goods</DefinedTermEn> means goods exported for sale or for any industrial, occupational, commercial, institutional or other like use. (<DefinedTermFr>marchandises commerciales</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="1012361" lims:id="1012361" generate-in-text="no"><Text><DefinedTermEn>indirect material</DefinedTermEn> means a good used in the production, testing or inspection of a good but not physically incorporated into the good, or a good used in the maintenance of buildings or the operation of equipment associated with the production of a good, including</Text><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012362" lims:id="1012362"><Label>(a)</Label><Text>fuel and energy;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012363" lims:id="1012363"><Label>(b)</Label><Text>tools, dies and moulds;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012364" lims:id="1012364"><Label>(c)</Label><Text>spare parts and materials used in the maintenance of equipment and buildings;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012365" lims:id="1012365"><Label>(d)</Label><Text>lubricants, greases, compounding materials and other materials used in production or used to operate equipment and buildings;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012366" lims:id="1012366"><Label>(e)</Label><Text>gloves, glasses, footwear, clothing, safety equipment and supplies;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012367" lims:id="1012367"><Label>(f)</Label><Text>equipment, devices and supplies used for testing or inspecting the goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012368" lims:id="1012368"><Label>(g)</Label><Text>catalysts and solvents; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-06-14" lims:fid="1012369" lims:id="1012369"><Label>(h)</Label><Text>any other goods that are not incorporated into the good but whose use in the production of the good can reasonably be demonstrated to be part of that production. (<DefinedTermFr>matière indirecte</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="1012370" lims:id="1012370" generate-in-text="no"><Text><DefinedTermEn>material</DefinedTermEn> means a good used in the production of another good, and includes a part or an ingredient. (<DefinedTermFr>matière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="1012371" lims:id="1012371" generate-in-text="no"><Text><DefinedTermEn>producer</DefinedTermEn> means a person who grows, mines, harvests, fishes, traps, hunts, manufactures, processes or assembles a good. (<DefinedTermFr>producteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-06-14" lims:fid="1012372" lims:id="1012372" generate-in-text="no"><Text><DefinedTermEn>production</DefinedTermEn> means growing, mining, harvesting, fishing, trapping, hunting, manufacturing, processing or assembling a lims:inforce-start-date="2006-03-22" lims:fid="1012375" lims:id="1012375" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012376" lims:id="1012376"><Label>2</Label><Text>Every person who exports or causes to be exported commercial goods and who is required by subsection 97.2(1) of the Act to keep records in respect of those commercial goods shall keep, for the period of six years following the exportation of the commercial goods, all records that relate to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012377" lims:id="1012377"><Label>(a)</Label><Text>the origin, purchase, importation, costs and value of the commercial goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012378" lims:id="1012378"><Label>(b)</Label><Text>payment for the commercial goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012379" lims:id="1012379"><Label>(c)</Label><Text>the usage to which the commercial goods are put in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012380" lims:id="1012380"><Label>(d)</Label><Text>the exportation of the commercial goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012381" lims:id="1012381"><Label>(e)</Label><Text>the source of all materials, including indirect materials, used in the production of the commercial Partner</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1012386" lims:id="1012386">SOR/97-330, s. 3</HistoricalNoteSubItem></HistoricalNote></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="1012387" lims:id="1012387" level="2"><TitleText>Exporter</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012388" lims:id="1012388"><Label>3</Label><Text>Every exporter of commercial goods who has completed and signed a certificate in accordance with subsection 97.1(1) of the Act and who is required by subsection 97.2(1) of the Act to keep records in respect of those commercial goods shall keep, for the period of six years following the date on which the certificate was signed, in addition to the records described in section 2,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012389" lims:id="1012389"><Label>(a)</Label><Text>all records that relate to an application for, or receipt of, any advance ruling by the customs administration of the applicable free trade partner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012390" lims:id="1012390"><Label>(b)</Label><Text>if the exporter is not a producer, all written representations received from the producer of the commercial goods that state that the commercial goods meet the rules of origin set out in or contemplated by the applicable free trade 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1012393" lims:id="1012393" level="2"><TitleText>Producer</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012394" lims:id="1012394"><Label>4</Label><Text>Every producer of commercial goods who has completed and signed a certificate in accordance with subsection 97.1(1) of the Act and who is required by subsection 97.2(1) of the Act to keep records in respect of those commercial goods shall keep, for the period of six years following the date on which the certificate was signed, all records that relate to the production of the commercial goods, including all records that relate to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012395" lims:id="1012395"><Label>(a)</Label><Text>the purchase, cost and value of, and payment for, the commercial goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012396" lims:id="1012396"><Label>(b)</Label><Text>the purchase, cost and value of, and payment for, all materials and indirect materials used in the production of the commercial goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1012397" lims:id="1012397"><Label>(c)</Label><Text>an application for, or receipt level="2"><TitleText>Inspection of Records</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012401" lims:id="1012401"><Label>5</Label><Text>Every person who is required to keep records in accordance with sections 2 to 4 shall, where that person has received written notification from the customs administration of a free trade partner wishing to conduct a verification visit in accordance with a free trade agreement and has given written consent to the making of such a visit, make those records available for inspection by an officer of the customs administration of that free trade partner at all reasonable times and shall provide a facility for the inspection of those level="1"><TitleText>Electronic or other Format</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012406" lims:id="1012406"><Label>7</Label><Text>The records required to be kept under these Regulations may be kept on machine-sensible data media if the media can be related back to the supporting source documents and are supported by a system capable of producing accessible and readable copy.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012407" lims:id="1012407"><Label>8</Label><Text>The records required to be kept under these Regulations may be kept on microfilm by means of any photographic or microphotographic process that is in accordance with National Standard of Canada CAN2-72.11-79, <XRefExternal reference-type="other">Microfilm as Documentary Evidence</XRefExternal>, published by the Canadian General Standards Board in August 1979, as amended from time to time.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1012408" lims:id="1012408" level="1"><TitleText>Repeal</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1012409"
