(<Emphasis style="italic">acte</Emphasis>)</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="920700" lims:id="920700" level="1"><TitleText>Form of Deeds</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="920701" lims:id="920701"><Label>3</Label><Text>A deed shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920702" lims:id="920702"><Label>(a)</Label><Text>be dated;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920703" lims:id="920703"><Label>(b)</Label><Text>indicate the place at which it was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920704" lims:id="920704"><Label>(c)</Label><Text>name and adequately identify each of the parties; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920705" lims:id="920705"><Label>(d)</Label><Text>precisely describe the property affected.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="920706" lims:id="920706"><Label>4</Label><Text>A deed may be made in authentic form.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="920707" lims:id="920707"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="920708" lims:id="920708"><Label>(1)</Label><Text>Subject to subsection (2), a deed that is not made in authentic form shall be signed by each of the parties.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="920709" lims:id="920709"><Label>(2)</Label><Text>A party who is unable to sign the party’s name to a deed that is not made in authentic form shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920710" lims:id="920710"><Label>(a)</Label><Text>make the party’s mark on the deed and include on the deed a declaration setting out that the party is unable to sign the party’s name; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920711" lims:id="920711"><Label>(b)</Label><Text>have the deed signed, on the party’s behalf, by another person and include on the deed a declaration setting out that the party is unable to sign the party’s name and that the person who signed on the party’s behalf did so in the presence of and according to the instructions of the party.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="920712" lims:id="920712"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="920713" lims:id="920713"><Label>(1)</Label><Text>A deed that is not made in authentic form shall, in respect of each party, be signed by two witnesses who know the party and, where a person signed on a party’s behalf, that person.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="920714" lims:id="920714"><Label>(2)</Label><Text>Each witness for a party to a deed that is not made in authentic form shall attach to the deed an affidavit</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920715" lims:id="920715"><Label>(a)</Label><Text>declaring that the witness knows the party and the person, if any, who signed on the party’s behalf; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="920716" lims:id="920716"><Label>(b)</Label><Text>certifying the signature or mark of the party or the signature of the person, if any, who signed on the party’s behalf.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="920717" lims:id="920717"><Label>(3)</Label><Text>For the purposes of subsections (1) and (2), a person may be a witness for a party only if the person has reached the age of majority, is not mentally incapacitated, has no interest in the deed and is not the spouse, or relative of the first degree, of the party.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="920718" lims:id="920718" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="920719" lims:id="920719"><Label>7</Label><Text>Nothing in these Regulations has the effect of exempting a deed from the provisions of the <XRefExternal reference-type="regulation" link="SOR-86-1070">Cree-Naskapi Land Registry Regulations</XRefExternal>.</Text></Section></Body></Regulation>
