(<DefinedTermFr>demandeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889895" lims:id="889895" generate-in-text="no"><Text><DefinedTermEn>beer</DefinedTermEn> means beer or malt liquor as defined in section 4 of the <XRefExternal reference-type="act" link="E-14">Excise Act</XRefExternal>; (<DefinedTermFr>bière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889896" lims:id="889896" generate-in-text="no"><Text><DefinedTermEn>border crossing point</DefinedTermEn> means a place on the international border between Canada and the United States at which there is a customs office; (<DefinedTermFr>poste frontalier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889897" lims:id="889897" generate-in-text="no"><Text><DefinedTermEn>chief officer of customs</DefinedTermEn>, with respect to a duty free shop or a proposed duty free shop, means the manager of the customs office or customs offices that serve the area in which the duty free shop is located or is proposed to be located; (<DefinedTermFr>agent en chef des douanes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889898" lims:id="889898" generate-in-text="no"><Text><DefinedTermEn>Department</DefinedTermEn><Repealed>[Repealed, SOR/2002-218, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889899" lims:id="889899" generate-in-text="no"><Text><DefinedTermEn>excisable goods</DefinedTermEn> means spirits, wine, beer or tobacco products; (<DefinedTermFr>boisson enivrante</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889902" lims:id="889902" generate-in-text="no"><Text><DefinedTermEn>licence</DefinedTermEn> means a licence to operate a place as a duty free shop; (<DefinedTermFr>agrément</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889903" lims:id="889903" generate-in-text="no"><Text><DefinedTermEn>licensee</DefinedTermEn> means a person to whom a licence has been issued; I</Label><TitleText>Licensing of Duty Free Shops</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="889908" lims:id="889908" level="2"><TitleText>Issuance of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-10-21" lims:fid="889909" lims:id="889909"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889910" lims:id="889910"><Label>(1)</Label><Text>For the purposes of section 24 of the Act and subject to subsection (6), a licence may be issued to any qualified person who makes an application in accordance with subsection (2) and who gives the security required under section 4.</Text></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889911" lims:id="1492683"><Label>(2)</Label><Text>The person must submit the application for a licence in the prescribed form by means of the electronic system specified by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889912" lims:id="889912"><Label>(3)</Label><Text>A corporation is qualified to operate a duty free shop at a border crossing point if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889913" lims:id="889913"><Label>(a)</Label><Text>the corporation is incorporated in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889914" lims:id="889914"><Label>(b)</Label><Text>all the shares of the corporation are beneficially owned by</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889915" lims:id="889915"><Label>(i)</Label><Text>a Canadian citizen or permanent resident,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889916" lims:id="889916"><Label>(ii)</Label><Text>another corporation that is incorporated in Canada all of whose shares are beneficially owned by a Canadian citizen or permanent resident, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889917" lims:id="889917"><Label>(iii)</Label><Text>both a Canadian citizen or permanent resident and that other corporation; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889918" lims:id="889918"><Label>(c)</Label><Text>the Canadian citizen or permanent resident referred to in paragraph (b)</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889919" lims:id="889919"><Label>(i)</Label><Text>is of good character,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889920" lims:id="889920"><Label>(ii)</Label><Text>maintains their principal residence in Canada, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889921" lims:id="889921"><Label>(iii)</Label><Text>resided in Canada for at least 183 days of the year before the year in which the corporation makes the application for the licence.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889922" lims:id="889922"><Label>(4)</Label><Text>A person other than a corporation is qualified to operate a duty free shop at a border crossing point if the person</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889923" lims:id="889923"><Label>(a)</Label><Text>is a Canadian citizen or a permanent resident;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889924" lims:id="889924"><Label>(b)</Label><Text>is of good character;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889925" lims:id="889925"><Label>(c)</Label><Text>maintains his principal residence in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889926" lims:id="889926"><Label>(d)</Label><Text>resided in Canada for at least 183 days of the year preceding the year in which the person makes the application for the licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889927" lims:id="889927"><Label>(5)</Label><Text>A person is qualified to operate a duty free shop at an airport or at a border crossing point if the person has been granted a lease or other right to occupy the place proposed as the duty free shop.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889928" lims:id="889928"><Label>(6)</Label><Text>The Minister shall not issue a licence to an applicant unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889929" lims:id="889929"><Label>(a)</Label><Text>the applicant meets the qualifications referred to in subsection (3) or (4) and subsection (5) in the case of a duty free shop at a border crossing point, or subsection (5) in the case of a duty free shop at an airport;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889930" lims:id="889930"><Label>(b)</Label><Text><Repealed>[Repealed, SOR/96-153, s. 2]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="889931" lims:id="1187523"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/2019-259, s. 1]</Repealed></Text></Paragraph><Paragraph service is not provided by, any duty free shop already located in the area in which the proposed duty free shop is to be located;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889934" lims:id="889934"><Label>(f)</Label><Text>the establishment of a duty free shop will not impede the flow of traffic in the vicinity in which the proposed duty free shop is to be located; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889935" lims:id="889935"><Label>(g)</Label><Text>the Agency is able to provide customs services with respect to the proposed duty free shop.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889936" lims:id="889936"><Label>(7)</Label><Text><Repealed>[Repealed, SOR/96-153, level="2"><TitleText>Security</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-10-21" lims:fid="889940" lims:id="889940"><Label>4</Label><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889941" lims:id="1492685"><Label>(1)</Label><Text>An applicant must, before a licence is issued to them, give security in accordance with the requirements of the <XRefExternal reference-type="regulation" link="SOR-2024-42">Financial Security (Electronic Means) Regulations</XRefExternal> and in an amount that is determined by the Minister and that is not less than $10,000.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889942" lims:id="889942"><Label>(2)</Label><Text>The Minister may at any time require a licensee to increase the amount of security given under subsection (1) to an amount sufficient to ensure the payment of any duties payable in respect of the goods in the duty free shop.</Text></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889943" lims:id="1492686"><Label>(3)</Label><Text><Repealed>[Repealed, level="2"><TitleText>Term of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2019-06-25" lims:fid="889957" lims:id="889957"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889958" lims:id="889958"><Label>(1)</Label><Text>Subject to subsection (2), a licence is valid for a period beginning on the date indicated on the licence as being the date on which the licence becomes effective and ending on the date indicated on the licence as being the date on which the licence expires.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="889959" lims:id="1187541"><Label>(2)</Label><Text>No licence shall be valid for more than 10 years.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="1187543" lims:id="1187543" lims:enactId="1178996">SOR/2019-259, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889960" lims:id="889960" level="2"><TitleText>Amendment of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889961" lims:id="889961"><Label>7</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889962" lims:id="889962"><Label>(1)</Label><Text>The Minister may amend a licence only for the following purposes:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889963" lims:id="889963"><Label>(a)</Label><Text>subject to subsection (2),</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889964" lims:id="889964"><Label>(i)</Label><Text>to change a restriction specified in the licence as to the classes of goods that may be received in the duty free shop, or to specify such a restriction,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889965" lims:id="889965"><Label>(ii)</Label><Text>to change the circumstances specified in the licence in which goods may be received in the duty free shop, or to specify such circumstances; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889966" lims:id="889966"><Label>(b)</Label><Text>to change the name of the licensee, where the name of the licensee is changed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889967" lims:id="889967"><Label>(2)</Label><Text>The Minister may amend a licence for the purposes set out in subparagraph (1)(a)(i) or (ii) only where he has given 90 days notice of the proposed amendment.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889968" lims:id="889968" level="2"><TitleText>Cancellation or Suspension of Licences</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889969" lims:id="889969"><Label>8</Label><Text>The Minister may cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889970" lims:id="889970"><Label>(a)</Label><Text>no longer owns or leases the place that is licensed as a duty free shop;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889971" lims:id="889971"><Label>(b)</Label><Text>requests the Minister in writing to cancel the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889972" lims:id="889972"><Label>(c)</Label><Text>is bankrupt.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889974" lims:id="889974">SOR/96-153, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889975" lims:id="889975"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889976" lims:id="889976"><Label>(1)</Label><Text>Subject to section 10, the Minister may suspend or cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889977" lims:id="889977"><Label>(a)</Label><Text>is the subject of a receivership in respect of his debts;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889978" lims:id="889978"><Label>(b)</Label><Text>fails to comply with any Act of Parliament, or any regulation made pursuant thereto, that prohibits, controls or regulates the importation or exportation of goods, or that relates to customs and excise;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889979" lims:id="889979"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/96-153, s. 4]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889980" lims:id="889980"><Label>(d)</Label><Text>has, in the course of his operation of the duty free shop, acted dishonestly in his business dealings with customers, suppliers, customs brokers, carriers, Her Majesty or servants of Her Majesty; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889981" lims:id="889981"><Label>(e)</Label><Text>has failed to carry out, within a reasonable time and in a reasonable manner, any proposal made in the application for the licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889982" lims:id="889982"><Label>(2)</Label><Text>Subject to section 10, the Minister may suspend or cancel a licence where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889983" lims:id="889983"><Label>(a)</Label><Text>the volume of goods sold in the duty free shop is no longer sufficient to warrant the continued operation of the duty free shop;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889984" lims:id="889984"><Label>(b)</Label><Text>there is no longer a need for a duty free shop in the area in which the duty free shop is located;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889985" lims:id="889985"><Label>(c)</Label><Text>the Agency is no longer able to provide customs services with respect to the duty free shop; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889986" lims:id="889986"><Label>(d)</Label><Text>the licensee has altered the structure of the duty free shop in a manner that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889987" lims:id="889987"><Label>(i)</Label><Text>contravenes a requirement related to the storage or sale of goods set out in the Act or in these Regulations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889988" lims:id="889988"><Label>(ii)</Label><Text>impedes the flow of traffic in the vicinity in which the duty free shop is located, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889989" lims:id="889989"><Label>(iii)</Label><Text>detrimentally affects the immediate export of goods.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889990" lims:id="889990"><Label>(3)</Label><Text>Subject to section 10, the Minister may cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889991" lims:id="889991"><Label>(a)</Label><Text>has made a misrepresentation in the application for the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889992" lims:id="889992"><Label>(b)</Label><Text>no longer qualifies under these Regulations for a licence.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889995" lims:id="889995"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889996" lims:id="889996"><Label>(1)</Label><Text>The Minister shall, immediately after suspending a licence, give to the licensee a notice confirming the suspension and providing all relevant information concerning the grounds on which the Minister has suspended the licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889997" lims:id="889997"><Label>(2)</Label><Text>The licensee may, within 30 days after the day on which the licence is suspended, make representations to the Minister regarding why the licence should be reinstated.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889998" lims:id="889998"><Label>(3)</Label><Text>The Minister shall, before cancelling a licence under section 9, give the licensee 90 days notice of the proposed cancellation and provide the licensee with all relevant information concerning the grounds on which the Minister proposes to cancel the licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889999" lims:id="889999"><Label>(4)</Label><Text>The licensee may, within 90 days after the day on which the notice referred to in subsection (3) is given, make representations to the Minister regarding why the licence should not be cancelled.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:fid="890002" lims:id="890002" level="2"><TitleText>Reinstatement and Renewal of Licences</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="890003" lims:id="890003"><Label>11</Label><Text>The Minister may reinstate a suspended licence where the Minister is satisfied that the cause for the suspension no longer exists.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="890004" lims:id="890004"><Label>12</Label><Text>The Minister may renew a licence on the expiration of its term on condition that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890005" lims:id="890005"><Label>(a)</Label><Text>in the case of a duty free shop at a border crossing point, the licensee submits an application in the prescribed form to the Commissioner at least 90 days before the date on which the licence is to expire;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890006" lims:id="890006"><Label>(b)</Label><Text>in the case of a duty free shop at an airport, the licensee has been granted a new lease, an extension of the existing lease or a new right to occupy the place operated as a duty free shop; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890007" lims:id="890007"><Label>(c)</Label><Text>no grounds exist for the Minister to suspend or cancel the licence.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="890018" lims:id="890018"><Label>(i)</Label><Text>that the goods sold in the duty free shop are for immediate exportation only and must be reported under the Act if they are returned to Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="890019" lims:id="890019"><Label>(ii)</Label><Text>the circumstances in which goods imported into the United States by individuals are exempt from duties, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="890020" lims:id="890020"><Label>(iii)</Label><Text>the circumstances in which goods imported into Canada by individuals are exempt from duties.</Text></Subparagraph></Paragraph><Paragraph lims:id="890030"><Label>(b)</Label><Text>the goods received in the duty free shop are held in an area designated by the chief officer of customs until, in the case of imported goods, those goods have been accounted for under the Act or, in the case of domestic goods, those goods have been approved by an officer for entry into the licensee’s inventory;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890031" lims:id="890031"><Label>(c)</Label><Text>the duty free shop may be locked and sealed by an officer where the chief officer of customs requests that the duty free shop be locked and sealed, for the purpose of enabling an officer to check the goods therein against the licensee’s records of inventory;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890032" lims:id="890032"><Label>(d)</Label><Text>the duty free shop may be locked and sealed by an officer in the event that the licensee’s licence expires or is cancelled or suspended and may be kept locked and sealed until</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="890033" lims:id="890033"><Label>(i)</Label><Text>in the case of goods in it other than excisable goods, the duties and taxes payable on the goods have been paid or the goods have been disposed of in accordance with the laws relating to customs and excise, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="890034" lims:id="890034"><Label>(ii)</Label><Text>in the case of goods in it that are excisable goods, the goods have been disposed of in accordance with the laws relating to customs and excise or, in the case of intoxicating liquor, in accordance with the laws relating to intoxicating liquor of the province in which the duty free shop is located; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890035" lims:id="890035"><Label>(e)</Label><Text>the duty free shop is kept suitable for the safe-keeping of the goods stored in it.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="890037" in a province unless the licensee has obtained written approval to sell intoxicating liquor from the board, commission or agency that is authorized by the laws of the province to sell or to authorize the sale of intoxicating liquor in that province.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="890040" lims:id="890040"><Label>(2)</Label><Text>Unless a licensee has obtained written approval for the transfer from the board, commission or agency described in subsection (1), an intoxicating liquor shall not be transferred within the same province</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890041" lims:id="890041"><Label>(a)</Label><Text>in the case of intoxicating liquors, from a duty free shop to another duty free shop;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890042" lims:id="890042"><Label>(b)</Label><Text>in the case of beer, from a duty free shop to a bonded warehouse; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="890043" lims:id="890043"><Label>(c)</Label><Text>in the case of wine or spirits,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="890044" lims:id="890044"><Label>(i)</Label><Text>from a duty free shop to a bonded warehouse or an excise warehouse, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="890045" lims:id="890045"><Label>(ii)</Label><Text>from an excise warehouse to a duty free carrier, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="890053" lims:id="1187566"><Label>(ii)</Label><Text>endorsing the document by which the licensee accounts for inventory.</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="890054" lims:inforce-start-date="2006-03-22" lims:fid="890067" lims:id="890067"><Label>(1)</Label><Text>Subject to subsections (2) to (4), the ownership of goods in a duty free shop may be transferred only by sale to persons who are about to leave Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="890068" lims:id="890068"><Label>(2)</Label><Text>The ownership of goods in a duty free shop may be transferred to the person who sold them to the licensee, on condition that the goods are dealt with in accordance with the laws relating to customs and excise.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="890069" lims:id="890069"><Label>(3)</Label><Text>The ownership of goods in a duty free shop may be transferred to a person having a licence in respect of another duty free shop, on condition that the goods are dealt with in accordance with any law relating to customs and excise, and, in the case of intoxicating liquor, in accordance with section 15.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="890070" lims:id="890070"><Label>(4)</Label><Text>Where a licensee’s licence is about to expire or be cancelled and a new licensee is to be licensed to operate a duty free shop on the same premises as the premises of the licensee, the ownership of the goods in the duty free shop
