(<DefinedTermFr>travailleur migrant</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="874900" lims:id="874900" generate-in-text="no"><Text><DefinedTermEn>conveyance</DefinedTermEn> means any vehicle, aircraft or other contrivance that is used to move persons or goods, but does not include water-borne craft; (<DefinedTermFr>moyen de transport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="874901" lims:id="874901" generate-in-text="no"><Text><DefinedTermEn>hire or reward</DefinedTermEn> means any payment, consideration, gratuity or benefit directly or indirectly charged, demanded, received or collected by a person for the carriage of passengers or goods; (<DefinedTermFr>rémunération ou salaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="874902" lims:id="874902" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of National Revenue; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="874903" lims:id="874903" generate-in-text="no"><Text><DefinedTermEn>resident</DefinedTermEn> means a person who, in the settled routine of the person’s life, makes that person’s home, resides and is ordinarily present in Canada. SOR/99-233, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="874906" lims:id="874906" level="1"><TitleText>Terms and Conditions of Importation of Conveyances</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="874907" lims:id="874907"><Label>3</Label><Text>A conveyance may be imported if,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874908" lims:id="874908"><Label>(a)</Label><Text>the conveyance, while in Canada is to be used solely for the transportation of a resident and accompanying persons from the point of arrival in Canada directly to a specified destination in Canada and from the specified destination to a destination outside Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874909" lims:id="874909"><Label>(b)</Label><Text>in the case of a commuter, the conveyance while in Canada is to be used for the personal transportation of the commuter and accompanying persons from the point of arrival in Canada to specified destinations in Canada and from a specified destination in Canada to a destination in the United States;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874910" lims:id="874910"><Label>(c)</Label><Text>in the case of a resident other than a commuter, the conveyance is to be imported only for the purpose of transporting his household or personal effects into or out of Canada, or for personal transportation as a result of an emergency or unforeseen contingency;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874911" lims:id="874911"><Label>(d)</Label><Text>in the case of a commuter, the conveyance is to be imported for the purpose of personal transportation of the commuter and accompanying persons between his place of residence in Canada and a point in the United States or for the purpose of visiting clients in Canada on behalf of his employer;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874912" lims:id="874912"><Label>(e)</Label><Text>the conveyance is not to be used in Canada for the purpose of</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="874913" lims:id="874913"><Label>(i)</Label><Text>touring or other leisure activity,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="874914" lims:id="874914"><Label>(ii)</Label><Text>carrying passengers or goods for hire or reward,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="874915" lims:id="874915"><Label>(iii)</Label><Text>transporting goods for sale, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="874916" lims:id="874916"><Label>(iv)</Label><Text>soliciting sales or subscriptions on behalf of an employer who operates a business in Canada;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874917" lims:id="874917"><Label>(f)</Label><Text>at the time of importation, the person importing the conveyance specifies to the customs officer the date on which the person intends to export the conveyance from Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874918" lims:id="874918"><Label>(g)</Label><Text>the conveyance is exported from Canada within the time limit specified in section 5.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="874920" lims:id="874920">SOR/88-84; SOR/93-42, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="874921" lims:id="874921"><Label>4</Label><Text><Repealed>[Repealed, SOR/88-84]</Repealed></Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="874922" lims:id="874922" level="1"><TitleText>Time Limits</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="874923" lims:id="874923"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="874924" lims:id="874924"><Label>(1)</Label><Text>A conveyance may remain in Canada until the expiration of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874925" lims:id="874925"><Label>(a)</Label><Text>the intended date of exportation specified pursuant to paragraph 3(f), or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="874926" lims:id="874926"><Label>(b)</Label><Text>30 days from the date of its importation,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="874927" lims:id="874927"><Text>whichever is the earlier.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="874928" lims:id="874928"><Label>(2)</Label><Text>Where it is impossible or impracticable for a resident to comply with the requirements referred to in subsection (1), the Minister may extend the time during which a conveyance may remain in Canada for any additional period not exceeding 60 days from the date of its importation into Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="874930" lims:id="874930">SOR/88-84</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="874931" lims:id="874931"><Label>6</Label><Text>The Minister may require security with respect to a conveyance that is temporarily imported in the form of cash or a certified cheque in an amount not exceeding the duties that would be payable if tariff item No. 9802.00.00 did not apply to that conveyance.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="874933" lims:id="874933">SOR/88-84;
