(<DefinedTermFr>bateau commercial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861593" lims:id="861593" generate-in-text="no"><Text><DefinedTermEn>Director</DefinedTermEn><Repealed>[Repealed, SOR/93-167, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861594" lims:id="861594" generate-in-text="no"><Text><DefinedTermEn>explosive</DefinedTermEn> means gunpowder, blasting powder, nitroglycerine, gun-cotton, dynamite, blasting gelatine, gelignite, fulminates of mercury or other metals, coloured fires and every other substance made, manufactured or used to produce a violent effect by explosion or a pyrotechnic effect and includes fuses, fireworks, rockets, percussion caps, detonators, cartridges, ammunition of all descriptions, railway track torpedoes, fusees and other signals and every other adaptation or preparation of any such substance; (<DefinedTermFr>explosifs</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861595" lims:id="861595" generate-in-text="no"><Text><DefinedTermEn>flora</DefinedTermEn> means any plant matter, living or dead, and includes fungi and moulds; (<DefinitionEnOnly>version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861596" lims:id="861596" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn><Repealed>[Repealed, SOR/93-167, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861597" lims:id="861597" generate-in-text="no"><Text><DefinedTermEn>moor</DefinedTermEn> means to make fast or tie up a watercraft to a wharf or to another watercraft or to use a space or stall at a wharf and includes to dock, beach, store or anchor a watercraft; (<DefinedTermFr>amarrage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861598" lims:id="861598" generate-in-text="no"><Text><DefinedTermEn>natural object</DefinedTermEn> means any natural material, soil, sand, gravel, rock, mineral, fossil or other object of natural phenomenon not included within the terms flora and fauna that is located within a Park; (<DefinedTermFr>matières naturelles</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861599" lims:id="861599" generate-in-text="no"><Text><DefinedTermEn>Park</DefinedTermEn><Repealed>[Repealed, SOR/94-267, s. 1(E)]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861600" lims:id="861600" generate-in-text="no"><Text><DefinedTermEn>public recreational facilities</DefinedTermEn> means a lawn bowling green, golf course, swimming pool and assembly hall in a park; (<DefinedTermFr>installation récréative publique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861601" lims:id="861601" generate-in-text="no"><Text><DefinedTermEn>Superintendent</DefinedTermEn><Repealed>[Repealed, SOR/93-167, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861602" lims:id="861602" generate-in-text="no"><Text><DefinedTermEn>watercourse</DefinedTermEn> means any river, stream, brook, lake, pond, creek or other flowing or standing water in a Park; (<DefinitionEnOnly>version anglaise seulement</DefinitionEnOnly>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861603" lims:id="861603" generate-in-text="no"><Text><DefinedTermEn>watercraft</DefinedTermEn> means any boat, canoe, raft, amphibious craft or other type or class of vessel; (<DefinedTermFr>embarcation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861604" lims:id="861604" generate-in-text="no"><Text><DefinedTermEn>wharf</DefinedTermEn> means any wharf, dock, pier, jetty, quay, landing, breakwater, mole or sea-wall or any floating structure or device that may be used to moor watercraft. SOR/98-252, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2010-02-02" lims:lastAmendedDate="2010-02-02" lims:fid="861611" lims:id="861611"><Label>2.2</Label><Text>Subsections 5(1) and (2), sections 29 to 31, paragraphs 32(1)(a) and (b) and sections 33 to 35, 37 and 39 do not apply in the Town of Jasper.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-02-02" lims:fid="861613" lims:id="861613">SOR/2010-23, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861614" lims:id="861614" level="1"><TitleText>Use of Public Lands or other Public Property Within a Park</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861615" lims:id="861615"><Label>3</Label><Text>A person may use or occupy public lands or other public property within a Park if that person does so in accordance with the Act, the regulations made thereunder and any agreement made between the Government of Canada and the government of the province within which the Park is situated.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861616" lims:id="861616"><Label>4</Label><Text>The Minister may, from time to time, arrange to have public lands in a Park surveyed or resurveyed</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861617" lims:id="861617"><Label>(a)</Label><Text>into lots in townsites or other subdivisions;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861618" lims:id="861618"><Label>(b)</Label><Text>for any right-of-way of the type referred to in subsection 6(2) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861619" lims:id="861619"><Label>(c)</Label><Text>for the purposes of schools, hospitals, churches and the entertainment of persons visiting the Park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861620" lims:id="861620"><Label>(d)</Label><Text>for the purposes of a cemetery.</Text></Paragraph></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861621" lims:id="861621" level="1"><TitleText>Public Recreational Facilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861622" lims:id="861622"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861623" lims:id="861623"><Label>(1)</Label><Text>The superintendent may, by posting notices on or in the immediate vicinity of public recreational facilities, fix the days and the hours of the day during which such facilities shall be open to the public.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861624" lims:id="861624"><Label>(2)</Label><Text>Except with the permission of the superintendent, no person shall enter on or use public recreational facilities when they are closed to the public.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861625" lims:id="861625"><Label>(3) and (4)</Label><Text><Repealed>[Repealed, SOR/94-512, s. 2]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861626" lims:id="861626"><Label>(5)</Label><Text>In Georgian Bay Islands National Park and St. Lawrence Islands National Park, no person shall use firewood supplied by the superintendent unless that person is issued a camping permit pursuant to the <XRefExternal reference-type="regulation">National Parks Camping Regulations</XRefExternal> or is issued a firewood permit.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861627" lims:id="861627"><Label>(6)</Label><Text>In Georgian Bay Islands National Park and St. Lawrence Islands National Park, a shower permit, a firewood permit and a mooring permit may be obtained at designated self-registration sites.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861628" lims:id="861628"><Label>(7) and (8)</Label><Text><Repealed>[Repealed, SOR/94-512, s. 2]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861630" lims:id="861630">SOR/82-949, s. 1(F); SOR/86-582, s. 1; SOR/88-12, s. 2; SOR/89-287, s. 1; SOR/91-560, s. 1; SOR/92-251, s. 1; SOR/93-167, s. 6(E); SOR/94-512, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861631" lims:id="861631" level="1"><TitleText>Hazardous Activities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861632" lims:id="861632"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861633" lims:id="861633"><Label>(1)</Label><Text>The superintendent may require any person to register at the office of the superintendent or at such other place as may be specified by the superintendent prior to and on completing, in a Park, any activity that, in the opinion of the superintendent, may present a hazard to the person.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861634" lims:id="861634"><Label>(2)</Label><Text>The superintendent shall designate any activity in respect of which registration is required pursuant to subsection (1) by posting notices at the office of the superintendent, at all information offices or centres located in a Park and at any place specified by the superintendent pursuant to subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861635" lims:id="861635"><Label>(3)</Label><Text>No person shall, in a Park, undertake any activity designated by the superintendent pursuant to subsection (2) without registering as required by the superintendent</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861636" lims:id="861636"><Label>(a)</Label><Text>prior to undertaking any such activity; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861637" lims:id="861637"><Label>(b)</Label><Text>immediately on completing or returning from such activity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861638" lims:id="861638"><Label>(4)</Label><Text>Where an activity has not been designated by the superintendent pursuant to subsection (2), a person who wishes to do so may, prior to undertaking that activity, register at the office of the superintendent or at such other place as may be specified by the superintendent, on condition that the person register again immediately on completing or returning from that activity.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861640" lims:id="861640">SOR/82-949, s. 1(F); SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861641" lims:id="861641" level="1"><TitleText>Restricted and Prohibited Activities, Uses and Travel</TitleText></Heading><Section lims:inforce-start-date="2017-02-13" lims:lastAmendedDate="2017-02-13" lims:fid="861642" lims:id="861642"><Label>7</Label><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861643" lims:id="861643"><Label>(1)</Label><Text>The superintendent may, where it is necessary for the proper management of the Park to do so, designate certain activities, uses or entry and travel in areas in a Park as restricted or prohibited.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861644" lims:id="861644"><Label>(2)</Label><Text>Notice of a restriction or prohibition referred to in subsection (1) shall be posted by the superintendent at park warden offices and information bureaus in the Park or at entrances to the Park.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861645" lims:id="861645"><Label>(3)</Label><Text>A notice posted in accordance with subsection (2) shall include</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861646" lims:id="861646"><Label>(a)</Label><Text>a description of the activity or use to which the restriction or prohibition applies;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861647" lims:id="861647"><Label>(b)</Label><Text>the extent of restriction, where an activity or use is being restricted;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861648" lims:id="861648"><Label>(c)</Label><Text>a description of the area to which the restriction or prohibition of entry or travel in that area applies; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861649" lims:id="861649"><Label>(d)</Label><Text>a map of the area in which the restriction or prohibition, applies, where that area is not the total area of the Park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861650" lims:id="861650"><Label>(4)</Label><Text>No person shall engage in an activity or use or enter and travel in an area that has been designated as restricted or prohibited pursuant to subsection (1) otherwise than in accordance with the terms and conditions prescribed in a permit issued under subsection (5).</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861651" lims:id="861651"><Label>(5)</Label><Text>The superintendent may, on application to him by any person, in respect of any activity or use restricted or prohibited pursuant to subsection (1) or any entry and travel in an area that has been restricted or prohibited, pursuant to that subsection, issue to that person a permit to</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861652" lims:id="861652"><Label>(a)</Label><Text>engage in that activity or use, or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861653" lims:id="861653"><Label>(b)</Label><Text>enter and travel in that area</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2017-02-13" lims:fid="861654" lims:id="861654"><Text>on such terms and conditions as the superintendent may prescribe in the permit.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861655" lims:id="861655"><Label>(6)</Label><Text>The superintendent may, if it is necessary for the preservation, control and management of the Park, suspend or revoke a permit issued under subsection (5).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-02-13" lims:fid="861657" lims:id="861657">SOR/82-949, ss. 1(F), 2; SOR/93-167, s. 6(E); SOR/2017-21, s. 10</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861658" lims:id="861658" level="1"><TitleText>Authorization</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861659" lims:id="861659"><Label>7.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861660" lims:id="861660"><Label>(1)</Label><Text>In this section,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="861661" lims:id="861661" generate-in-text="no"><Text><DefinedTermEn>authorization</DefinedTermEn> means a pass, licence, ticket or other form of permission authorizing the holder to carry on any designated activity; (<DefinedTermFr>autorisation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="861662" lims:id="861662" generate-in-text="no"><Text><DefinedTermEn>designated activity</DefinedTermEn> means any activity in a park, including travel, entry in an area of a park and the use of any facility in a park, that is designated in accordance with subsection (2). (<DefinedTermFr>activité désignée</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861663" lims:id="861663"><Label>(2)</Label><Text>The superintendent may, where it is necessary for the proper management of the park, designate the activities other than those referred to in section 7 that may be carried on only by the holder of an authorization for that purpose.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861664" lims:id="861664"><Label>(3)</Label><Text>The superintendent shall post a list of designated activities and their description in the park warden offices and information bureaus in the park or at the entrances to the park.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861665" lims:id="861665"><Label>(4)</Label><Text>No person other than the holder of an authorization issued for that purpose in accordance with this section shall engage in a designated activity.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861666" lims:id="861666"><Label>(5)</Label><Text>The superintendent may, on request, issue an authorization and may prescribe terms and conditions in any such authorization, taking into account</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861667" lims:id="861667"><Label>(a)</Label><Text>the natural and cultural resources of the park;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861668" lims:id="861668"><Label>(b)</Label><Text>the safety, health and enjoyment of persons visiting or residing in the park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861669" lims:id="861669"><Label>(c)</Label><Text>the preservation, control and management of the park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861670" lims:id="861670"><Label>(6)</Label><Text>The holder of an authorization shall, at the request of the superintendent or a park warden or other park officer, produce the authorization for inspection.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861671" lims:id="861671"><Label>(7)</Label><Text>The superintendent may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861672" lims:id="861672"><Label>(a)</Label><Text>suspend an authorization, where the holder of it fails to comply with any prescribed term or condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861673" lims:id="861673"><Label>(b)</Label><Text>reinstate the authorization, when the failure referred to in paragraph (a) has been remedied; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861687" lims:id="861687"><Label>(c)</Label><Text>pose a danger to public health or public safety.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="861688" lims:id="861688"><Label>(2)</Label><Text>The permit shall specify the kind and amount of and the location from which flora or natural objects may be removed and set out the terms and conditions.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="861689" lims:id="861689"><Label>(3)</Label><Text>Where natural objects are removed for the purpose of constructing other than a public work within a Park, every person on removal of such natural objects shall pay to the superintendent the sum of 25 cents for each cubic yard of such natural objects or fraction thereof.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-23" lims:fid="861691" lims:id="861691">SOR/82-949, s. 1(F); or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861716" lims:id="861716"><Label>(c)</Label><Text>any Park water supply system other than a waterworks system for a townsite or subdivision.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861717" lims:id="861717"><Label>(2)</Label><Text>Notwithstanding subsection (1), a superintendent shall not issue a permit to any person to take water unless the person submits to the superintendent</Text><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861718" lims:id="861718"><Label>(a)</Label><Text>a statement specifying the purpose for which the water is required;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861719" lims:id="861719"><Label>(b)</Label><Text>a description of the method to be used to take the water;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861720" lims:id="861720"><Label>(c)</Label><Text>a statement specifying the location of any equipment to be installed in taking the water;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861721" lims:id="861721"><Label>(d)</Label><Text>a document setting out the results of a water quality test that show that the quality of the water to be taken is suitable for the purpose for which it is required; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-02-13" lims:fid="861722" lims:id="861722"><Label>(e)</Label><Text>a description of any impairment to the resources of the Park that may result from the installation of the equipment referred to in paragraph (c).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861723" lims:id="861723"><Label>(3)</Label><Text>The superintendent shall revoke a permit issued under subsection (1) if its holder is convicted of a contravention of these Regulations.</Text></Subsection><Subsection lims:inforce-start-date="2017-02-13" lims:fid="861724" lims:id="861724"><Label>(4)</Label><Text>On the expiry or revocation of a permit issued under subsection (1), the person who was issued that permit shall immediately remove any equipment installed in taking the water and restore the site of the equipment to the extent possible to its original state.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-02-13" lims:fid="861726" lims:id="861726">SOR/82-949, s. 5; SOR/80-166, s. 2; SOR/82-949, s. 1(F); SOR/88-12, s. 4; SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861759" lims:id="861759" level="1"><TitleText>Prevention of Nuisances</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861760" lims:id="861760"><Label>27</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861761" lims:id="861761"><Label>(1)</Label><Text>Where, in the opinion of the superintendent or of a Park Medical Officer or a medical or sanitary inspector, a nuisance exists on any premises in a Park, the superintendent may order the owner, lessee, licencee or any other occupier of the premises to abate the nuisance and cleanse the premises.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861762" lims:id="861762"><Label>(2)</Label><Text>Where the owner, lessee, licencee or any other occupier of any premises where a nuisance exists fails, after reasonable notice from the superintendent, to abate the nuisance and cleanse the premises, the superintendent may take such steps as are necessary to abate the nuisance and to cleanse the premises.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861763" lims:id="861763"><Label>(3)</Label><Text>The owner, lessee, licencee or other occupier of the premises shall pay the costs of abating the nuisance and cleansing any premises referred to in subsection (2) that are incurred by the superintendent.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861765" lims:id="861765">SOR/82-949, s. 1(F); SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861774" lims:id="861774"><Label>30</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861775" lims:id="861775"><Label>(1)</Label><Text>All buildings in a Park used for the purpose of residence, business or tourist accommodation shall have a plumbing system including an adequate supply of potable water and suitable sanitary fixtures, except that such buildings in outlying areas not serviced by a Park water supply and sewer system shall have sanitary privies, chemical closets or other such conveniences as the superintendent may approve.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861776" lims:id="861776"><Label>(2)</Label><Text>Where there is no Park water supply and sewer system in a Park, sewage or water waste shall be drained into a septic tank or other disposal system approved by the superintendent, which shall, where considered necessary by the superintendent, be equipped to chlorinate or otherwise treat the effluent.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861778" lims:id="861778">SOR/82-949, s. 1(F); and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="861782" lims:id="861782"><Label>(b)</Label><Text>when vacating the area, restore the area to its natural condition as nearly as possible.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-06-17" lims:fid="861783" lims:id="861783"><Label>(2)</Label><Text>Where incinerators or trash receptacles are provided in a Park, all refuse, waste paper or other material being discarded shall be placed therein.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-06-17" lims:fid="861785" lims:id="861785">SOR/93-167, s. 6(E); SOR/2010-140, s. 12(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861786" lims:id="861786" level="1"><TitleText>Prohibited Conduct</TitleText></Heading><Section lims:inforce-start-date="2010-06-17" lims:lastAmendedDate="2010-06-17" lims:fid="861787" lims:id="861787"><Label>32</Label><Subsection lims:inforce-start-date="2010-06-17" lims:fid="861788" lims:id="861788"><Label>(1)</Label><Text>No person shall, in a Park,</Text><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="861789" lims:id="861789"><Label>(a)</Label><Text>cause any excessive noise;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="861790" lims:id="861790"><Label>(b)</Label><Text>conduct or behave in a manner that unreasonably disturbs other persons in the Park or unreasonably interferes with their enjoyment of the Park; or</Text></Paragraph><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="861791" lims:id="861791"><Label>(c)</Label><Text>carry out any action that unreasonably interferes with fauna or the natural beauty of the Park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-06-17" lims:fid="861792" lims:id="861792"><Label>(2)</Label><Text>The superintendent may remove or have removed from a Park any person who by his disorderly conduct, behaviour or action is in violation of subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2010-06-17" lims:fid="861793" lims:id="861793"><Label>(3)</Label><Text>No person who has been removed from a Park under subsection (2) shall enter or attempt to enter that Park for one year following the date of removal unless that person applies for and obtains permission from the superintendent to enter the Park.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-06-17" lims:fid="861795" lims:id="861795">SOR/82-949, ss. 1(F), 7; SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-11-23" lims:lastAmendedDate="2018-11-23" lims:fid="861799" lims:id="861799"><Label>33.1</Label><Subsection lims:inforce-start-date="2018-11-23" lims:fid="861800" lims:id="861800"><Label>(1)</Label><Text>The superintendent shall, on application, issue a permit authorizing the permit holder to display or distribute any promotional or informational material in a park if it</Text><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861801" lims:id="861801"><Label>(a)</Label><Text><Repealed>[Repealed, SOR/2018-250, s. 8]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861802" lims:id="861802"><Label>(b)</Label><Text>does not contravene any Act or regulation that applies in respect of the park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861803" lims:id="861803"><Label>(c)</Label><Text>does not promote the contravention of an Act or regulation that applies in respect of the park.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-11-23" lims:fid="861804" lims:id="861804"><Label>(2)</Label><Text>The superintendent shall set out the following terms and conditions in respect of promotional or informational material in the permit:</Text><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861805" lims:id="861805"><Label>(a)</Label><Text>the areas where it may be distributed or displayed;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861806" lims:id="861806"><Label>(b)</Label><Text>the period during which it may be displayed or the date and time at which it may be distributed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-11-23" lims:fid="861807" lims:id="861807"><Label>(c)</Label><Text>the permit holder’s obligation to take reasonable care to ensure that the material is not littered in the park and that, if it is posted, it is removed immediately after the end of the period identified in the permit.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-11-23" lims:fid="861809" lims:id="861809">SOR/2010-140, s. 13; SOR/2018-250, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861810" lims:id="861810" level="1"><TitleText>Cleaning of Sidewalks</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861811" lims:id="861811"><Label>34</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861812" lims:id="861812"><Label>(1)</Label><Text>The owner, lessee, licensee or other occupier of any lot in a townsite in a Park on which residence or the operation of a business is permitted shall remove snow, leaves or other material that has accumulated on any sidewalk bordering the lot in accordance with subsections (2) and (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861813" lims:id="861813"><Label>(2)</Label><Text>Any snow required to be removed by subsection (1) shall be removed within a period of 12 hours after it has fallen or within such longer period as may be specified by the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861814" lims:id="861814"><Label>(3)</Label><Text>Any leaves or other material required to be removed by subsection (1) shall be removed whenever such leaves or other material interferes with or endangers pedestrian traffic or creates an obstructive, dangerous or unsightly condition or whenever removal is directed by the superintendent.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861816" lims:id="861816">SOR/82-949, s. 1(F); SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861817" lims:id="861817" level="1"><TitleText>Explosives</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861818" lims:id="861818"><Label>35</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861819" lims:id="861819"><Label>(1)</Label><Text>Subject to subsection (4), no person shall, without an appropriate permit issued by the superintendent pursuant to subsection (2), bring into a Park or, in a Park, have in his possession, store, use, sell or offer for sale, any explosive.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861820" lims:id="861820"><Label>(2)</Label><Text>The superintendent may, on any conditions that he may prescribe, issue a permit to have in possession, store, use or sell any explosive in a Park to a person described in subsection (3) who is authorized under the <XRefExternal reference-type="act" link="E-17">Explosives Act</XRefExternal> to have in possession, store, use, make, manufacture or sell such an explosive in any other part of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861821" lims:id="861821"><Label>(3)</Label><Text>For the purposes of subsection (2), the following persons are described:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861822" lims:id="861822"><Label>(a)</Label><Text>a person engaged in construction or demolition work who requires the explosive for his work;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861823" lims:id="861823"><Label>(b)</Label><Text>a person representing a fraternal organization, service or other group that is sponsoring recreational or sport activities and requires the explosive in order to present a fireworks display on the occasion of a public holiday or celebration; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861824" lims:id="861824"><Label>(c)</Label><Text>a person who is licensed under the <XRefExternal reference-type="regulation">National Parks Businesses Regulations</XRefExternal><FootnoteRef idref="fn1_e">*</FootnoteRef> to sell small arms ammunition.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861825" lims:id="861825"><Label>(4)</Label><Text>Any person may, without obtaining a permit under this section,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861826" lims:id="861826"><Label>(a)</Label><Text>transport any explosive through a Park by railway in a manner authorized by the <XRefExternal reference-type="act">Railway Act</XRefExternal> or a regulation or order under that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861827" lims:id="861827"><Label>(b)</Label><Text>transport explosives through a Park in accordance with the <XRefExternal reference-type="act" link="E-17">Explosives Act</XRefExternal> or any provincial regulation respecting explosives;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861828" lims:id="861828"><Label>(c)</Label><Text>be in possession of flares or fuses for use as safety equipment for motor vehicles, trains or boats in accordance with any provincial or federal requirements; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861829" lims:id="861829"><Label>(d)</Label><Text>be in possession of small arms ammunition for his personal use.</Text></Paragraph></Subsection><Footnote id="fn1_e" placement="section" status="editorial"><Label>*</Label><Text>[<Emphasis style="bold">Note:</Emphasis> The <XRefExternal reference-level="federal" reference-type="regulation">National Parks Businesses Regulations</XRefExternal>, referred to in paragraph 35(3)(c), have been replaced by the <XRefExternal reference-level="federal" reference-type="regulation">National Parks Businesses Regulations, 1998</XRefExternal> (SOR/98-455). SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861832" lims:id="861832" level="1"><TitleText>Closing of Areas and Ways</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861833" lims:id="861833"><Label>36</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861834" lims:id="861834"><Label>(1)</Label><Text>Where the superintendent deems it necessary for the prevention of any seasonal or temporary danger to persons, flora, fauna or natural objects in a Park, he may by notice in writing close to public use or traffic any area in the Park for the period he considers the danger will continue.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861835" lims:id="861835"><Label>(2)</Label><Text>A notice referred to in subsection (1) shall be displayed on each approach road, trail or other way of access to the area in the Park closed to public use or traffic.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="861836" lims:id="861836"><Label>(3)</Label><Text>No person shall enter any area in a Park during the period that it is closed to public use or traffic pursuant to subsection (1) except with the permission of the superintendent.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861838" lims:id="861838">SOR/82-949, s. 1(F); SOR/93-167, s. 6(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861839" lims:id="861839"><Label>37</Label><Text>Where the Minister is of the opinion that any road, street, sidewalk, trail, wharf, bridge or other way or portion thereof in a Park has been rendered unnecessary for public use or traffic, he may by order close to public use or traffic that way or portion thereof.</Text></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861840" lims:id="861840" level="1"><TitleText>Utilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="861841" lims:id="861841"><Label>38</Label><Text>The Minister may enter into an agreement with a province or any person for the development, operation and maintenance in a Park of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861842" lims:id="861842"><Label>(a)</Label><Text>telephone, telegraph, electrical, other than hydro-electrical, and natural gas services for use only in the Park; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="861843" lims:id="861843"><Label>(b)</Label><Text>hydro-electrical power, pursuant to the <XRefExternal reference-type="act" link="W-4">Dominion Water Power Act</XRefExternal>, for the use of such power only in the Park.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="861845" lims:id="861845">SOR/81-563, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2010-06-17" lims:fid="861846" lims:id="861846" level="1"><TitleText>Miscellaneous</TitleText></Heading><Section lims:inforce-start-date="2010-06-17" lims:lastAmendedDate="2010-06-17" lims:fid="861847" lims:id="861847"><Label>39</Label><Text>No person shall sell any intoxicating beverage in a Park unless he has obtained a licence for such a sale under the <XRefExternal reference-type="regulation">National Parks Businesses Regulations</XRefExternal><FootnoteRef idref="fn2_e">*</FootnoteRef> and the sale</Text><Paragraph lims:inforce-start-date="2010-06-17" lims:fid="861848" lims:id="861848"><Label>(a)</Label><Text>is in accordance with the laws of the province in which the Park is situated;
