J-1</Text></Footnote></Provision></Order><Body lims:inforce-start-date="2008-10-01" lims:fid="746637" lims:id="746637"><Heading lims:inforce-start-date="2008-10-01" lims:fid="746638" lims:id="746638" level="1"><TitleText>Applications for Division of Annuity Benefits</TitleText></Heading><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746639" lims:id="746639"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746640" lims:id="746640">To whom application is made</MarginalNote><Label>1</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746641" lims:id="746641"><Label>(1)</Label><Text>Any application for the division of a judge’s annuity benefits between the judge and his or her spouse, former spouse or former common-law partner must be made to the annuity administrator.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746642" lims:id="746642"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746643" lims:id="746643">Annuity administrator</MarginalNote><Label>(2)</Label><Text>If the application relates to a judge of the Supreme Court of Canada, <DefinedTermEn>annuity administrator</DefinedTermEn> means the Registrar of the Supreme Court of Canada appointed under section 12 of the <XRefExternal reference-type="act" link="S-26">Supreme Court Act</XRefExternal>, and if it relates to a judge of any other superior court, <DefinedTermEn>annuity administrator</DefinedTermEn> means the Commissioner for Federal Judicial Affairs appointed under section 73 of the <XRefExternal reference-type="act" link="J-1">Judges Act</XRefExternal> (the “Act”).</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746644" lims:id="746644"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746645" lims:id="746645">Information required</MarginalNote><Label>(3)</Label><Text>The application must contain the following information:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746646" lims:id="746646"><Label>(a)</Label><Text>in respect of the judge,</Text><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746647" lims:id="746647"><Label>(i)</Label><Text>the judge’s name,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746648" lims:id="746648"><Label>(ii)</Label><Text>the judge’s most recent address that is known to the applicant,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746649" lims:id="746649"><Label>(iii)</Label><Text>the judge’s date of birth,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746650" lims:id="746650"><Label>(iv)</Label><Text>the most recent judicial office held by the judge that is known to the applicant, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746651" lims:id="746651"><Label>(v)</Label><Text>the date on which the judge ceased to hold office, if applicable, if that date is known to the applicant; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746652" lims:id="746652"><Label>(b)</Label><Text>in respect of the spouse, former spouse or former common-law partner,</Text><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746653" lims:id="746653"><Label>(i)</Label><Text>the person’s name, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746654" lims:id="746654"><Label>(ii)</Label><Text>the person’s most recent address that is known to the applicant.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746655" lims:id="746655"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746656" lims:id="746656">Documents required</MarginalNote><Label>(4)</Label><Text>The application must be accompanied by the following documents:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746657" lims:id="746657"><Label>(a)</Label><Text>if the interested parties are or were married to each other, the original or a certified true copy of the marriage certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746658" lims:id="746658"><Label>(b)</Label><Text>the original or a certified true copy of the court order or agreement that provides for the division of the annuity benefits; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746659" lims:id="746659"><Label>(c)</Label><Text>if the court order or agreement does not specify the period during which the interested parties cohabited, a statutory declaration by the applicant stating the date on which they began to cohabit and the date on which that cohabitation ceased.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746660" lims:id="746660"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746661" lims:id="746661">Period during which interested parties cohabited</MarginalNote><Label>2</Label><Text>For the purpose of these Regulations, other than subsections <XRefInternal>14</XRefInternal>(2) and (3), and paragraph 52.14(6)(b) of the Act, if the court order or agreement does not specify the period during which the interested parties cohabited, that period is determined on the basis of the documents referred to in subsection <XRefInternal>1</XRefInternal>(4).</Text></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746662" lims:id="746662"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746663" lims:id="746663">Court order or agreement not specific enough</MarginalNote><Label>3</Label><Text>If the terms of the court order or agreement do not permit the determination by the annuity administrator of the amount or the percentage of the judge’s annuity benefits that is to be paid to the spouse, former spouse or former common-law partner, the annuity administrator may not act on the application and must request the interested parties to have the necessary changes made to the order or to make the necessary changes to the agreement.</Text></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746664" lims:id="746664"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746665" lims:id="746665">Living separate and apart</MarginalNote><Label>4</Label><Text>For the purpose of paragraph 52.11(2)(b) of the Act,</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746666" lims:id="746666"><Label>(a)</Label><Text>the interested parties are deemed to have lived separate and apart for any period during which they lived separate and apart and one of them manifested the intention not to continue the conjugal relationship;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746667" lims:id="746667"><Label>(b)</Label><Text>a period during which the interested parties have lived separate and apart is not to be considered to have been interrupted or terminated for the sole reason</Text><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746668" lims:id="746668"><Label>(i)</Label><Text>that one of the interested parties has become incapable of forming or having an intention to continue to live separate and apart or of continuing to live separate and apart of the interested party’s own volition, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746669" lims:id="746669"><Label>(ii)</Label><Text>that the interested parties have resumed cohabitation during a period of, or periods totalling, not more than 90 days with reconciliation as its primary purpose; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746670" lims:id="746670"><Label>(c)</Label><Text>if one of the interested parties dies during the year after the day on which the interested parties began to live separate and apart, the parties are deemed to have lived separate and apart throughout that year and that year is deemed to have elapsed at the date of death.</Text></Paragraph></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746671" lims:id="746671"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746672" lims:id="746672">Person incapable of managing own affairs</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746673" lims:id="746673"><Label>(1)</Label><Text>A person’s incapacity to manage his or her own affairs is a circumstance referred to in paragraph 52.22(c) of the Act in which a person may make an application or object to an application on behalf of another person, or may act on behalf of another person in proceeding with an application made by that other person.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746674" lims:id="746674"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746675" lims:id="746675">Document required</MarginalNote><Label>(2)</Label><Text>The person must submit to the annuity administrator the original or a certified true copy of the document that authorizes the person to act.</Text></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746676" lims:id="746676"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746677" lims:id="746677">Application by personal representative or liquidator</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746678" lims:id="746678"><Label>(1)</Label><Text>The fact that the terms of the court order or agreement have not been or are not being satisfied by other means is a circumstance referred to in paragraph 52.22(d) of the Act in which the personal representative or the liquidator of the succession of a judge or of a spouse, former spouse or former common-law partner of a judge may make an application or may proceed with an application that was made by or on behalf of the interested party.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746679" lims:id="746679"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746680" lims:id="746680">Objection to application by personal representative or liquidator</MarginalNote><Label>(2)</Label><Text>The existence of one of the grounds for objection referred to in subsection 52.12(2) of the Act is a circumstance referred to in paragraph 52.22(d) of the Act in which the personal representative or the liquidator of the succession of a judge or of a spouse, former spouse or former common-law partner of a judge may object to an application.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746681" lims:id="746681"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746682" lims:id="746682">Documents required</MarginalNote><Label>(3)</Label><Text>The personal representative or the liquidator of the succession must submit to the annuity administrator</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746683" lims:id="746683"><Label>(a)</Label><Text>the original or a certified true copy of the document that authorizes that representative or liquidator to act in that capacity;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746684" lims:id="746684"><Label>(b)</Label><Text>the original or a certified true copy of the interested party’s death certificate; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746685" lims:id="746685"><Label>(c)</Label><Text>evidence that the terms of the court order or agreement remain in effect or, if the ground for objecting to the application is that the court order or agreement has been varied or is of no force or effect, evidence of that fact.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746686" lims:id="746686"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746687" lims:id="746687">Application after judge’s death</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746688" lims:id="746688"><Label>(1)</Label><Text>The fact that the terms of the court order or agreement have not been or are not being satisfied by other means is a circumstance referred to in paragraph 52.22(f) of the Act in which a spouse, former spouse or former common-law partner of a judge may make an application after the judge’s death.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746689" lims:id="746689"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746690" lims:id="746690">Documents required</MarginalNote><Label>(2)</Label><Text>The application must be accompanied by the following documents:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746691" lims:id="746691"><Label>(a)</Label><Text>the original or a certified true copy of the judge’s death certificate; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746692" lims:id="746692"><Label>(b)</Label><Text>if the application is based on a court order referred to in subparagraph 52.11(2)(b)(i) of the Act or on an agreement and the court order or agreement does not specify the date on which the interested parties began to live separate and apart before the judge’s death, a statutory declaration stating that date and the fact that the parties were still living separate and apart when the judge died and that the terms of the court order or agreement have not been or are not being satisfied by other means.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746693" lims:id="746693"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746694" lims:id="746694">Notice of receipt of application</MarginalNote><Label>8</Label><Text>The notice of the receipt of an application referred to in subsection 52.11(3) of the Act that is sent to an interested party who is not the applicant must be accompanied by a copy of the court order or agreement and any marriage certificate, death certificate or statutory declaration that was submitted in support of the application.</Text></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746695" lims:id="746695"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746696" lims:id="746696">Notice of objection</MarginalNote><Label>9</Label><Text>A notice of objection to the division of annuity benefits referred to in subsection 52.12(1) of the Act must be sent to the annuity administrator.</Text></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746697" lims:id="746697"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746698" lims:id="746698">Notice of division</MarginalNote><Label>10</Label><Text>The notice of the division of annuity benefits referred to in subsection 52.14(9) of the Act must contain the following information:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746699" lims:id="746699"><Label>(a)</Label><Text>the date on which the division was approved;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746700" lims:id="746700"><Label>(b)</Label><Text>the valuation day, as determined in accordance with section <XRefInternal>19</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746701" lims:id="746701"><Label>(c)</Label><Text>the share of the annuity benefits referred to in subsection 52.14(1) of the Act, expressed as a percentage;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746702" lims:id="746702"><Label>(d)</Label><Text>the proportion of the value of the annuity referred to in subsection 52.14(2) of the Act, expressed as a percentage;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746703" lims:id="746703"><Label>(e)</Label><Text>an estimate of the amount to be paid to the spouse, former spouse or former common-law partner as payment of his or her share of the annuity benefits, made in accordance with sections <XRefInternal>19</XRefInternal> and <XRefInternal>21</XRefInternal> to <XRefInternal>23</XRefInternal>, with any modifications that the circumstances require; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746704" lims:id="746704"><Label>(f)</Label><Text>if the judge still holds office, the judge’s expected date of retirement, determined in accordance with section <XRefInternal>19</XRefInternal> and paragraph <XRefInternal>21</XRefInternal>(d), with any modifications that the circumstances require.</Text></Paragraph></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746705" lims:id="746705"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746706" lims:id="746706">Election to wait for share of annuity benefits</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746707" lims:id="746707"><Label>(1)</Label><Text>To make an election under subsection 52.14(4) of the Act, a judge’s spouse, former spouse or former common-law partner must send to the annuity administrator a notice indicating that person’s election to receive at the time described in that subsection a share of the annuity referred to in that subsection, to be paid in lieu of the share of the judge’s annuity benefits referred to in subsection 52.14(3) or (3.1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746708" lims:id="746708"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746709" lims:id="746709">Time for sending notice</MarginalNote><Label>(2)</Label><Text>The notice must be sent no later than the 30th day after the day on which the notice of the division of annuity benefits referred to in subsection 52.14(9) of the Act is sent.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746710" lims:id="746710"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746711" lims:id="746711">Cancellation of election</MarginalNote><Label>(3)</Label><Text>The spouse, former spouse or former common-law partner may, within the same period and in the same manner, cancel the election.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746712" lims:id="746712"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746713" lims:id="746713">Notice to judge</MarginalNote><Label>(4)</Label><Text>The annuity administrator must notify the judge of the election and cancellation.</Text></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746714" lims:id="746714"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746715" lims:id="746715">Withdrawal of application</MarginalNote><Label>12</Label><Text>An application may be withdrawn by sending a notice to the annuity administrator no later than the 30th day after the day on which the notice of the division of annuity benefits referred to in subsection 52.14(9) of the Act is sent.</Text></Section><Heading lims:inforce-start-date="2008-10-01" lims:fid="746716" lims:id="746716" level="1"><TitleText>Provision of Information</TitleText></Heading><Heading lims:inforce-start-date="2008-10-01" lims:fid="746717" lims:id="746717" level="2"><TitleText>Provision of Information to Spouse, Common-law Partner, Former Spouse or Former Common-law Partner</TitleText></Heading><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746718" lims:id="746718"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746719" lims:id="746719">To whom request for information is made</MarginalNote><Label>13</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746720" lims:id="746720"><Label>(1)</Label><Text>A request by a spouse, common-law partner, former spouse or former common-law partner of a judge under section 52.21 of the Act to obtain information concerning the benefits that are or may become payable to or in respect of the judge under the Act must be made to the annuity administrator.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746721" lims:id="746721"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746722" lims:id="746722">Documents required</MarginalNote><Label>(2)</Label><Text>The request must be accompanied by the following documents:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746723" lims:id="746723"><Label>(a)</Label><Text>if there is a court order or agreement, the original or a certified true copy of the court order or agreement, and if the appeal or review proceedings referred to in paragraph 52.12(2)(c) of the Act has been commenced in respect of the period during which the judge and the spouse, common-law partner, former spouse or former common-law partner cohabited, a statutory declaration by the spouse, common-law partner, former spouse or former common-law partner that meets the requirements set out in subsection (3); and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746724" lims:id="746724"><Label>(b)</Label><Text>if the court order or agreement does not specify the period during which the judge and the spouse, common-law partner, former spouse or former common-law partner cohabited or if there is no court order or agreement, a statutory declaration by the spouse, common-law partner, former spouse or former common-law partner that meets the requirements set out in subsection (3).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746725" lims:id="746725"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746726" lims:id="746726">Content of statutory declaration</MarginalNote><Label>(3)</Label><Text>The statutory declaration must state the date on which the judge and the spouse, common-law partner, former spouse or former common-law partner began to cohabit and the date on which they ceased to cohabit or, if they have not ceased to cohabit, that it is the intention of the spouse or common-law partner to cease to cohabit.</Text></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2019-04-15" lims:fid="746727" lims:id="746727"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746728" lims:id="746728">Information to be provided</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746729" lims:id="746729"><Label>(1)</Label><Text>The information that the Minister is to provide in response to a request is the following:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746730" lims:id="746730"><Label>(a)</Label><Text>the date on which the information is prepared;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="746731" lims:id="1124728"><Label>(b)</Label><Text>the date on which the judge</Text><Subparagraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124729" lims:id="1124729"><Label>(i)</Label><Text>would be granted or paid an annuity under subsection 42(1) or (1.1) of the Act if he or she ceased to hold office,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124730" lims:id="1124730"><Label>(ii)</Label><Text>would have been granted or paid an annuity under paragraph 42(1)(a), (b) or (c) or 42(1.1)(a) of the Act if he or she had ceased to hold office and had not been granted an earlier annuity under paragraph 42(1.1)(b) of the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124731" lims:id="1124731"><Label>(iii)</Label><Text>was granted or paid an annuity under subsection 42(1) or (1.1) or section 43.1 of the Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746735" lims:id="746735"><Label>(c)</Label><Text>the period subject to division;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="746736" lims:id="1124732"><Label>(d)</Label><Text>if, on the date on which the information is prepared, the judge would not be granted or paid an annuity if he or she ceased to hold office or if, on valuation day, as determined in accordance with section 19, the judge would not have been granted or paid an annuity if he or she had ceased to hold office, the amount of contributions made by him or her under section 50 of the Act during the period subject to division and the interest on the contributions calculated under subsection 51(4) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="746737" lims:id="1124733"><Label>(e)</Label><Text>an estimate of the amount of the annuity that the judge would be granted or paid if he or she ceased to hold office on the last day of the period subject to division or that he or she would have been granted or paid if he or she had ceased to hold office on valuation day, as determined in accordance with section 19; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746738" lims:id="746738"><Label>(f)</Label><Text>an estimate of the share of annuity benefits that would be determined in accordance with subsection 52.14(1) of the Act on valuation day, as determined in accordance with section <XRefInternal>19</XRefInternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746739" lims:id="746739"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746740" lims:id="746740">Period during which interested parties cohabited</MarginalNote><Label>(2)</Label><Text>For the determination of the period subject to division referred to in paragraph (1)(c), if no division of annuity benefits between the interested parties has been approved by the Minister and if the period during which the interested parties cohabited is not specified in a court order or agreement, the period during which the interested parties cohabited begins and ends on the dates stated in the statutory declaration referred to in subsection <XRefInternal>13</XRefInternal>(3). If the judge and the spouse, former spouse or common-law partner have not ceased to cohabit, the period ends on the last day of the month before the month in which the request is made.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746741" lims:id="746741"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746742" lims:id="746742">Approval of division of annuity benefits</MarginalNote><Label>(3)</Label><Text>If a division of annuity benefits between the interested parties has been approved by the Minister, the period during which the interested parties cohabited is the period that was determined for the purposes of the division.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124735" lims:id="1124735">SOR/2019-103, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746743" lims:id="746743"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746744" lims:id="746744">Request may be refused</MarginalNote><Label>15</Label><Text>The Minister may refuse a request for information if a similar request made by the same person has been responded to within the preceding 12 months unless, since that previous request,</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746745" lims:id="746745"><Label>(a)</Label><Text>the judge and that person have ceased to cohabit;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746746" lims:id="746746"><Label>(b)</Label><Text>the judge or that person has begun proceedings in relation to separation, divorce or annulment of marriage;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746747" lims:id="746747"><Label>(c)</Label><Text>the judge and that person have entered into an agreement or have obtained a court order; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746748" lims:id="746748"><Label>(d)</Label><Text>the years of service as a judge included in the period subject to division have been amended.</Text></Paragraph></Section><Heading lims:inforce-start-date="2008-10-01" lims:fid="746749" lims:id="746749" level="2"><TitleText>Administrative Error or Erroneous Information</TitleText></Heading><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746750" lims:id="746750"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746751" lims:id="746751">Notice of error — interested party or common-law partner</MarginalNote><Label>16</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746752" lims:id="746752"><Label>(1)</Label><Text>If the judge, spouse, common-law partner, former spouse or former common-law partner believes that an administrative error has been committed or that erroneous information has been provided to him or her in the administration of these Regulations or sections 52.1 to 52.21 of the Act and that the error or the erroneous information is likely to affect his or her rights under the Act, he or she may notify the annuity administrator of the error or erroneous information.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746753" lims:id="746753"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746754" lims:id="746754">Notice of error — annuity administrator</MarginalNote><Label>(2)</Label><Text>If the annuity administrator agrees — or becomes aware — that an administrative error has been committed or that erroneous information has been provided in the administration of these Regulations or sections 52.1 to 52.21 of the Act and if the error or the erroneous information is likely to affect the judge’s, spouse’s, common-law partner’s, former spouse’s or former common-law partner’s rights under the Act, the annuity administrator must without delay notify the following persons:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746755" lims:id="746755"><Label>(a)</Label><Text>if a request for information has been made under section 52.21 of the Act, the person who made it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746756" lims:id="746756"><Label>(b)</Label><Text>if an application has been made, the interested parties.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746757" lims:id="746757"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746758" lims:id="746758">Correction</MarginalNote><Label>(3)</Label><Text>The notice by the annuity administrator must contain the corrected information. It must also be accompanied by a revised notice of the division of annuity benefits if the notice of the division of annuity benefits referred to in subsection 52.14(9) of the Act has been sent already, but no share of the annuity benefits has been accorded under subsection 52.15(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746759" lims:id="746759"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746760" lims:id="746760">According of share delayed</MarginalNote><Label>(4)</Label><Text>No share of the annuity benefits may be accorded under subsection 52.15(1) of the Act after the revised notice of the division is sent and before the expiry of the time period set out in section <XRefInternal>17</XRefInternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746761" lims:id="746761"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746762" lims:id="746762">Withdrawal of application or cancellation of election</MarginalNote><Label>17</Label><Text>Within 30 days after the day on which the revised notice of the division of annuity benefits is sent</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746763" lims:id="746763"><Label>(a)</Label><Text>the applicant may withdraw the application by sending a notice to the annuity administrator; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746764" lims:id="746764"><Label>(b)</Label><Text>a spouse, former spouse or former common-law partner may, by sending a notice to the annuity administrator, cancel the election that he or she made under subsection 52.14(4) of the Act before the revised notice was received or make an election under that subsection.</Text></Paragraph></Section><Heading lims:inforce-start-date="2008-10-01" lims:fid="746765" lims:id="746765" level="1"><TitleText>Valuation of the Share of Annuity Benefits to Be Accorded to Spouse, Former Spouse or Former Common-law Partner</TitleText></Heading><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746766" lims:id="746766"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746767" lims:id="746767">Date share of annuity benefits is to be accorded</MarginalNote><Label>18</Label><Text>As soon as the annuity administrator has received all of the necessary documents and information, he or she must set the earliest practicable date for according the share of the annuity benefits to the spouse, former spouse or former common-law partner.</Text></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746768" lims:id="746768"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746769" lims:id="746769">Valuation day</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746770" lims:id="746770"><Label>(1)</Label><Text>For the purposes of sections <XRefInternal>20</XRefInternal> to <XRefInternal>23</XRefInternal>, <XRefInternal>25</XRefInternal>, <XRefInternal>27</XRefInternal> and <XRefInternal>28</XRefInternal>, valuation day is the day on which the share of the annuity benefits to be accorded to the spouse, former spouse or former common-law partner is determined and it corresponds, in the following cases, to the earlier of the expected date for according the share and the 90th day after the approval of the division of annuity benefits by the Minister:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746771" lims:id="746771"><Label>a)</Label><Text>the judge’s spouse, former spouse or former common-law partner does not make the election under subsection 52.14(4) of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746772" lims:id="746772"><Label>b)</Label><Text>the judge’s spouse, former spouse or former common-law partner makes that election and the time described in that subsection falls no later than the 90th day after the approval by the Minister.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-10-01" lims:fid="746773" lims:id="746773"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746774" lims:id="746774">Valuation day — election under subsection 52.14(4) of the Act</MarginalNote><Label>(2)</Label><Text>If the judge’s spouse, former spouse or former common-law partner makes the election under subsection 52.14(4) of the Act and the time described in that subsection falls after the 90th day after the approval of the division of annuity benefits by the Minister, valuation day corresponds to the earlier of the expected date for according the share and the 30th day after the time described in that subsection.</Text></Subsection></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746775" lims:id="746775"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746776" lims:id="746776">Interest</MarginalNote><Label>20</Label><Text>The share of the annuity benefits to be accorded to the spouse, former spouse or former common-law partner bears interest from the 31st day after valuation day until the day before the day on which it is accorded at the rate prescribed under the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> for amounts payable by the Minister of National Revenue as refunds of overpayments of tax under that Act.</Text></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2008-10-01" lims:fid="746777" lims:id="746777"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746778" lims:id="746778">Rules to be followed</MarginalNote><Label>21</Label><Text>The following rules apply to the valuation of the share of the annuity benefits to be accorded to the spouse, former spouse or former common-law partner:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746779" lims:id="746779"><Label>(a)</Label><Text>the actuarial valuation report is the actuarial report on the pension plan for federally appointed judges most recently laid before Parliament under section 9 of the <XRefExternal reference-type="act" link="P-31.4">Public Pensions Reporting Act</XRefExternal> before valuation day or, if that report was laid before Parliament in the month in which valuation day falls or in the preceding month, the preceding report that was laid before Parliament;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746780" lims:id="746780"><Label>(b)</Label><Text>prior divisions of annuity benefits are not taken into account;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746781" lims:id="746781"><Label>(c)</Label><Text>the date on which payment of the annuity is expected to begin and the dates on which the judge might cease to hold office are determined in accordance with the actuarial assumptions that were used in the preparation of the actuarial valuation report;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746782" lims:id="746782"><Label>(d)</Label><Text>the judge’s expected date of retirement is determined as of valuation day on the basis of the retirement rates that were used in the preparation of the actuarial valuation report, and this rule also applies for the purposes of subsection 52.14(2) of the Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746783" lims:id="746783"><Label>(e)</Label><Text>the salary annexed to the office held by the judge on the last day of the period subject to division is the salary that is actually annexed to the office held by the judge on that day or, if applicable, the salary referred to in subsection 43(1) or (2) of the Act, and it includes any annual adjustment or revision that is to apply on or before that day under an Act that comes into force no later than valuation day.</Text></Paragraph></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2019-04-15" lims:fid="746784" lims:id="746784"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746785" lims:id="746785">Annuity attributed to period subject to division</MarginalNote><Label>22</Label><Text>For the purposes of paragraph 52.14(1)(a) of the Act, the annuity that is attributed to the period subject to division is equal to</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746786" lims:id="746786"><Label>(a)</Label><Text>if the judge holds office on valuation day, the total of</Text><Subparagraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="746787" lims:id="1124736"><Label>(i)</Label><Text>the amount of the annuity that would be granted or paid to him or her on retirement, if that annuity were determined on the basis of the dates on which he or she might cease to hold office and the salary annexed to the office held by him or her on the last day of the period subject to division, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746788" lims:id="746788"><Label>(ii)</Label><Text>the amount of the supplementary retirement benefits that would be added to that annuity under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> from the day after the last day of the period subject to division until the date on which payment of the annuity is expected to begin, if that Act applied to the judge during that time;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746789" lims:id="746789"><Label>(b)</Label><Text>if the judge ceased to hold office after the last day of the period subject to division but before valuation day, the total of</Text><Subparagraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="746790" lims:id="1124739"><Label>(i)</Label><Text>the amount of the annuity that would have been granted or paid to him or her on the day on which he or she ceased to hold office, if that annuity had been determined on the basis of the salary annexed to the office held by him or her on the last day of the period subject to division, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746791" lims:id="746791"><Label>(ii)</Label><Text>the amount of the supplementary retirement benefits that would have been added to that annuity under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> from the day after the last day of the period subject to division until valuation day, if that Act had applied to the judge during that entire time;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746792" lims:id="746792"><Label>(c)</Label><Text lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124340" lims:id="1124740">if the period subject to division ended as a result of the judge ceasing to hold office for a reason other than the infirmity referred to in paragraph 42(1.1)(b) of the Act, the total of</Text><Subparagraph lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="746793" lims:id="1124741"><Label>(i)</Label><Text>the amount of the annuity that was granted or paid to him or her on the day on which he or she ceased to hold office, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746794" lims:id="746794"><Label>(ii)</Label><Text>the amount of the supplementary retirement benefits that were added to that annuity under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> from the day after the last day of the period subject to division until valuation day;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746795" lims:id="746795"><Label>(d)</Label><Text lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124341" lims:id="1124742">if the period subject to division ended as a result of the judge ceasing to hold office by reason of the infirmity referred to in paragraph 42(1.1)(b) of the Act, the total of</Text><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746796" lims:id="746796"><Label>(i)</Label><Text>the amount referred to in subparagraph (c)(i), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746797" lims:id="746797"><Label>(ii)</Label><Text>the amount of the supplementary retirement benefits that were or would have been added to the annuity under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> from the day after the last day of the period subject to division until the later of valuation day and the day that would have been the judge’s expected date of retirement had the infirmity not occurred; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746798" lims:id="746798"><Label>(e)</Label><Text lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124342" lims:id="1124743">if the judge ceased to hold office after the last day of the period subject to division, but before valuation day by reason of the infirmity referred to in paragraph 42(1.1)(b) of the Act, the total of</Text><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746799" lims:id="746799"><Label>(i)</Label><Text>the amount referred to in subparagraph (b)(i), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-10-01" lims:fid="746800" lims:id="746800"><Label>(ii)</Label><Text>the amount of the supplementary retirement benefits referred to in subparagraph (d)(ii).</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-15" lims:enacted-date="2019-04-15" lims:fid="1124738" lims:id="1124738">SOR/2019-103, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-10-01" lims:lastAmendedDate="2019-04-15" lims:fid="746801" lims:id="746801"><MarginalNote lims:inforce-start-date="2008-10-01" lims:fid="746802" lims:id="746802">Value of annuity attributed to period subject to division</MarginalNote><Label>23</Label><Text>For the purposes of paragraph 52.14(1)(a) of the Act, the value of the annuity attributed to the period subject to division is equal to the actuarial present value of the annuity on valuation day, determined in accordance with the following rules and taking into account the death benefit provided for in subsection 51(3) of the Act:</Text><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746803" lims:id="746803"><Label>(a)</Label><Text>in respect of the period during which the judge holds office, the rates of disability, retirement and mortality, including mortality projection factors, are those that were used in the preparation of the actuarial valuation report;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746804" lims:id="746804"><Label>(b)</Label><Text>in respect of the period beginning on the day after the day on which the judge ceases to hold office, the rates of mortality are those set out in an appendix to the actuarial valuation report;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746805" lims:id="746805"><Label>(c)</Label><Text>the interest rates are the interest rates for fully indexed pensions, determined in accordance with the section entitled “Pension Commuted Values” of the <XRefExternal reference-type="standard">Standard of Practice — Practice-Specific Standards for Pension Plans</XRefExternal>, published by the Canadian Institute of Actuaries, as amended from time to time;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746806" lims:id="746806"><Label>(d)</Label><Text>any benefits that are or may become payable to the judge’s spouse, common-law partner or children on the judge’s death are excluded;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-10-01" lims:fid="746807" lims:id="746807"><Label>(e)</Label><Text>if the judge died after the end of the period lims:id="746808"><Label>(f)</Label><Text>if the judge ceased to hold office before valuation day, the determination must take into account only the annuity benefits payable to him or her beginning on that day and, if the judge still holds office on valuation day, only those payable to him or her beginning on the dates on which he or she might cease to hold office; and</Text></Paragraph><Paragraph that would have been added to that annuity under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> from the day after that day until the day on lims:id="746900"><Label>(ii)</Label><Text>the amount of the annuity to which the judge is entitled, together with the amount of the supplementary retirement benefits that were added to that annuity under the <XRefExternal reference-type="act" link="S-24">Supplementary Retirement Benefits Act</XRefExternal> from the day after the day on which he or she ceased to hold office until the day on which
