(<DefinedTermFr>directeur général</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717355" lims:id="717355" generate-in-text="no"><Text><DefinedTermEn>child</DefinedTermEn> means a son or daughter of a person or an individual adopted in fact by a person. (<DefinedTermFr>enfant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717356" lims:id="717356" generate-in-text="no"><Text><DefinedTermEn>community</DefinedTermEn> means any of the following communities in the Province of Newfoundland and Labrador, namely, Birchy Head, Cow Head, Curzon Village, Glenburnie, Neddy Harbour, Norris Point, Rocky Harbour, St. Paul’s, Sally’s Cove, Shoal Brook, Trout River, Winter House Brook and Woody Point. (<DefinedTermFr>collectivité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717357" lims:id="717357" generate-in-text="no"><Text><DefinedTermEn>eligible person</DefinedTermEn> means a person who, at the time of their application for and receipt of a snare permit, is a permanent resident of a community and who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717358" lims:id="717358"><Label>(a)</Label><Text>was, on August 13, 1973, at least 19 years of age and a permanent resident of the park or a community; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717359" lims:id="717359"><Label>(b)</Label><Text>is the child of a person described in paragraph (a). (<DefinedTermFr>admissible</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717360" lims:id="717360" generate-in-text="no"><Text><DefinedTermEn>park</DefinedTermEn> means Gros Morne National Park of Canada. (<DefinedTermFr>parc</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717361" lims:id="717361" generate-in-text="no"><Text><DefinedTermEn>possession</DefinedTermEn> has the same meaning as in subsection 4(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>. (<DefinedTermFr>possession</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717362" lims:id="717362" generate-in-text="no"><Text><DefinedTermEn>season</DefinedTermEn> means the period for which snare permits are issued. (<DefinedTermFr>saison</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717363" lims:id="717363" generate-in-text="no"><Text><DefinedTermEn>snare</DefinedTermEn> means the act of capturing or attempting to capture an animal using a snare. (<DefinedTermFr>chasse au collet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717364" lims:id="717364" generate-in-text="no"><Text><DefinedTermEn>snare permit</DefinedTermEn> means a permit issued under section 8. (<DefinedTermFr>permis de chasse au collet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717365" lims:id="717365" generate-in-text="no"><Text><DefinedTermEn>snowshoe hare</DefinedTermEn> means a member of the species <Language xml:lang="la">Lepus americanus</Language> and includes any part of such an animal. (<DefinedTermFr>lièvre d’Amérique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="717366" lims:id="717366" generate-in-text="no"><Text><DefinedTermEn>superintendent</DefinedTermEn> means the superintendent of the park. (<DefinedTermFr>directeur</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717367" lims:id="717367" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717368" lims:id="717368"><Label>2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717369" lims:id="717369"><Label>(1)</Label><Text>These Regulations apply to Gros Morne National Park of Canada.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717370" lims:id="717370"><Label>(2)</Label><Text>In the event of an inconsistency between these Regulations and any other regulation made under the Act, these Regulations prevail to the extent of the inconsistency.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717371" lims:id="717371"><Label>3</Label><Text>Sections 5 and 6 do not apply to the superintendent, a park warden, an enforcement officer or a peace officer while they are performing functions related to the management of the harvesting of snowshoe hare in the park or to any other person authorized by the superintendent while they are conducting scientific research in the park in respect of the snowshoe hare or the harvesting activity.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717372" lims:id="717372" level="1"><TitleText>Traditional Renewable Resource Harvesting Activity</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717373" lims:id="717373"><Label>4</Label><Text>The snaring of snowshoe hare in the park is hereby specified to be a traditional renewable resource harvesting activity.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717374" lims:id="717374" level="1"><TitleText>General Prohibitions — Snaring and Possession</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717375" lims:id="717375"><Label>5</Label><Text>No person shall snare snowshoe hare in the park unless they are the holder of a snare permit.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717376" lims:id="717376"><Label>6</Label><Text>No person shall possess snowshoe hare in the park unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717377" lims:id="717377"><Label>(a)</Label><Text>the person is the holder of a snare permit and the snowshoe hare was snared in the park; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717378" lims:id="717378"><Label>(b)</Label><Text>the person is the holder of a permit issued by the Province of Newfoundland and Labrador that entitles them to snare snowshoe hare outside the park, and the snowshoe hare was snared outside the park.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717379" lims:id="717379" level="1"><TitleText>Snare Permits</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="717380" lims:id="717380" level="2"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717381" lims:id="717381"><Label>7</Label><Text>An application for a snare permit shall be submitted to the superintendent on the form provided by the superintendent and must include the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717382" lims:id="717382"><Label>(a)</Label><Text>the name and date of birth of the applicant and the address of their permanent residence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717383" lims:id="717383"><Label>(b)</Label><Text>written evidence that the applicant is an eligible person.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717384" lims:id="717384" level="2"><TitleText>Issuance</TitleText></Heading><Section lims:inforce-start-date="2009-12-03" lims:lastAmendedDate="2009-12-03" lims:fid="717385" lims:id="717385"><Label>8</Label><Subsection lims:inforce-start-date="2009-12-03" lims:fid="717386" lims:id="717386"><Label>(1)</Label><Text>Subject to any other provisions of these Regulations and any determinations made under sections 15 to 17, the superintendent shall issue a permit to snare snowshoe hare in the park to an eligible person on application by that person in accordance with section 7.</Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="717387" lims:id="717387"><Label>(2)</Label><Text>No person is entitled to obtain a snare permit for a given season if they are already the holder of a valid or suspended snare permit for that season or if, during the 12 months preceding the submission of the application, a snare permit previously issued to them was revoked.</Text></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="717388" lims:id="717388"><Label>(3)</Label><Text>The permit holder shall sign the snare permit on receipt.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-12-03" lims:fid="717390" lims:id="717390">SOR/2009-322, s. 26</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717391" lims:id="717391" level="2"><TitleText>Contents</TitleText></Heading><Section lims:inforce-start-date="2009-12-03" lims:lastAmendedDate="2009-12-03" lims:fid="717392" lims:id="717392"><Label>9</Label><Subsection lims:inforce-start-date="2009-12-03" lims:fid="717393" lims:id="717393"><Label>(1)</Label><Text>Every snare permit shall contain the name and date of birth of the permit holder, the address of their permanent residence and</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717394" lims:id="717394"><Label>(a)</Label><Text>a statement that the transfer or assignment of the permit is prohibited;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717395" lims:id="717395"><Label>(b)</Label><Text>a description of the duties of the permit holder as set out in sections 12 to 14;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717396" lims:id="717396"><Label>(c)</Label><Text>a statement that contravention of a condition of the permit constitutes an offence under subsection 24(3) of the Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717397" lims:id="717397"><Label>(d)</Label><Text>any standard conditions that are specified by the superintendent, in accordance with sections 15 to 17, in respect of</Text><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="717398" lims:id="717398"><Label>(i)</Label><Text>the duration of the permit,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="717399" lims:id="717399"><Label>(ii)</Label><Text>the areas in the park in which the permit holder may snare snowshoe hare,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="717400" lims:id="717400"><Label>(iii)</Label><Text>all or part of any of those areas, identified on the permit as areas in which the permit holder may snare snowshoe hare, in which the snaring of snowshoe hare is restricted for part of the duration of the permit,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="717401" lims:id="717401"><Label>(iv)</Label><Text>the maximum number of snowshoe hare that may be snared and possessed by the permit holder in the season, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="717402" lims:id="717402"><Label>(v)</Label><Text>the method to be used by the permit holder to indicate their snares, snaring lines and trails.</Text></Subparagraph><Subparagraph lims:inforce-start-date="2009-12-03" lims:fid="717403" lims:id="717403"><Label>(vi) and (vii)</Label><Text><Repealed>[Repealed, SOR/2009-322, s. 27]</Repealed></Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-12-03" lims:fid="717404" lims:id="717404"><Label>(2)</Label><Text>The superintendent may, when necessary to ensure the protection of snowshoe hare in the park and the preservation, control and management of the park, including the maintenance or restoration of its ecological integrity, include in all snare permits to be issued for a given season any supplementary conditions that may be required.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-12-03" lims:fid="717406" lims:id="717406">SOR/2009-322, s. 27</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717407" lims:id="717407" level="2"><TitleText>Expiry</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717408" lims:id="717408"><Label>10</Label><Text>A snare permit expires on the earliest of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717409" lims:id="717409"><Label>(a)</Label><Text>the expiry date stated on the permit,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717410" lims:id="717410"><Label>(b)</Label><Text>the day on which the permit is revoked, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717411" lims:id="717411"><Label>(c)</Label><Text>the day on which the permit holder is no longer a permanent resident of the park or a community.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717412" lims:id="717412" level="1"><TitleText>Prohibitions — Holders of Snare Permits</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717413" lims:id="717413"><Label>11</Label><Text>No holder of a snare permit shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717414" lims:id="717414"><Label>(a)</Label><Text>transfer or assign their snare permit;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717415" lims:id="717415"><Label>(b)</Label><Text>use a snare other than one that is constructed of metallic wire;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717416" lims:id="717416"><Label>(c)</Label><Text>set a snare in a manner capable of capturing an animal other than a snowshoe hare;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717417" lims:id="717417"><Label>(d)</Label><Text>subject to paragraph 12(e), set more snares than the maximum number of snowshoe hare that may be snared as set out in their snare permit;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717418" lims:id="717418"><Label>(e)</Label><Text>bait a snare with any bait other then naturally occurring flora;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717419" lims:id="717419"><Label>(f)</Label><Text>cut any flora with a trunk diameter that is greater than 7.5 cm measured at a height of 15 cm above the ground, for use in snaring snowshoe hare;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717420" lims:id="717420"><Label>(g)</Label><Text>cut or damage white pine (<Language xml:lang="la">Pinus strobus</Language>), yellow birch <Language xml:lang="la">(Betula alleghaniensis)</Language>, black ash (<Language xml:lang="la">Fraxinus nigra</Language>) or red maple (<Language xml:lang="la">Acer rubrum</Language>);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717421" lims:id="717421"><Label>(h)</Label><Text>leave a snare unattended for more than 48 hours;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717422" lims:id="717422"><Label>(i)</Label><Text>snare snowshoe hare in an area of the park that has been closed to the snaring of snowshoe hare by the superintendent under section 16; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717423" lims:id="717423"><Label>(j)</Label><Text>use snowshoe hare snared under their snare permit for any purpose other than for their own personal use — including as gifts — or the use of their household.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717424" lims:id="717424" level="1"><TitleText>Duties of Holders of Snare Permits</TitleText></Heading><Section lims:inforce-start-date="2009-12-03" lims:lastAmendedDate="2009-12-03" lims:fid="717425" lims:id="717425"><Label>12</Label><Text>The holder of a snare permit shall</Text><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717426" lims:id="717426"><Label>(a)</Label><Text>carry their snare permit when they are snaring or in possession of snowshoe hare in the park;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717427" lims:id="717427"><Label>(b)</Label><Text>on request by the superintendent, a park warden, an enforcement officer or a peace officer, immediately produce for examination, as applicable, their snare permit, snares and any snowshoe hare in their possession;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717428" lims:id="717428"><Label>(c)</Label><Text>notify the superintendent, in writing as soon as possible, of any change in the address of their permanent residence;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717429" lims:id="717429"><Label>(d)</Label><Text>report, without delay, to a park warden, any accidental capture by the permit holder in any of their snares of an animal other than a snowshoe hare if that animal is wounded or dead; and</Text></Paragraph><Paragraph lims:inforce-start-date="2009-12-03" lims:fid="717430" lims:id="717430"><Label>(e)</Label><Text>after they snare one half of the limit of snowshoe hare specified in their permit, reduce the number of their snares so that the number of their snares does not at any subsequent time exceed the remainder of that limit.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-12-03" lims:fid="717432" lims:id="717432">SOR/2009-322, s. 28(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717433" lims:id="717433"><Label>13</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717434" lims:id="717434"><Label>(1)</Label><Text>The holder of a snare permit shall remove their snares, snaring line indicators and trail indicators when the limit of snowshoe hare specified in the snare permit has been reached or, if that limit is not reached, before the expiry of the permit.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717435" lims:id="717435"><Label>(2)</Label><Text>If the permit holder fails to comply with subsection (1), the superintendent shall remove and dispose of the snares, snaring line indicators and trail indicators.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717436" lims:id="717436"><Label>(3)</Label><Text>The permit holder shall be responsible for all expenses incurred by the superintendent under subsection (2).</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717437" lims:id="717437"><Label>14</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717438" lims:id="717438"><Label>(1)</Label><Text>Within 30 days after the expiry of a snare permit, the permit holder shall return the permit to a park warden.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717439" lims:id="717439"><Label>(2)</Label><Text>The permit holder shall state the following information on the back of their snare permit before returning it:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717440" lims:id="717440"><Label>(a)</Label><Text>the number of snares set by the permit holder;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717441" lims:id="717441"><Label>(b)</Label><Text>the number of snowshoe hare snared by the permit holder;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717442" lims:id="717442"><Label>(c)</Label><Text>the areas in which the snowshoe hare were snared;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717443" lims:id="717443"><Label>(d)</Label><Text>the number of days during which the permit holder carried on the snaring activity under the permit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717444" lims:id="717444"><Label>(e)</Label><Text>any other information that the permit holder was required to record under a condition of the permit.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717445" lims:id="717445" level="1"><TitleText>Powers of Superintendent</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717446" lims:id="717446"><Label>15</Label><Text>The superintendent shall, for the purposes of the conservation of snowshoe hare and the maintenance of the ecological integrity of the park, in respect of each season, determine those areas in the park in which the snaring of snowshoe hare will be permitted or restricted.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717447" lims:id="717447"><Label>16</Label><Text>The superintendent may, at any time, for purposes of management of the park, public safety or the conservation of natural resources, close areas of the park to the snaring of snowshoe hare for any period that the superintendent determines necessary.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717448" lims:id="717448"><Label>17</Label><Text>Based on the determinations made under sections 15 and 16, the superintendent shall, in respect of each season, determine</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717449" lims:id="717449"><Label>(a)</Label><Text>the limit of snowshoe hare that may be snared under a snare permit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717450" lims:id="717450"><Label>(b)</Label><Text>the maximum number of snare permits to be issued for each area where the snaring of snowshoe hare will be permitted.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717451" lims:id="717451" level="1"><TitleText>Suspension and Revocation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717452" lims:id="717452"><Label>18</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717453" lims:id="717453"><Label>(1)</Label><Text>The superintendent may suspend a snare permit if the permit holder contravenes any provision of these Regulations or any condition of their permit.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717454" lims:id="717454"><Label>(2)</Label><Text>The superintendent shall reinstate a suspended snare permit</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717455" lims:id="717455"><Label>(a)</Label><Text>if the contravention that led to the suspension has been corrected;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717456" lims:id="717456"><Label>(b)</Label><Text>after a period of 30 days from the date of the suspension, unless proceedings have been instituted before the end of that period in respect of the alleged contravention; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717457" lims:id="717457"><Label>(c)</Label><Text>if proceedings are instituted, after the permit holder has been found not guilty of an offence in respect of the alleged contravention or after the proceedings against them have been discontinued.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717458" lims:id="717458"><Label>(3)</Label><Text>The superintendent shall revoke the snare permit if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717459" lims:id="717459"><Label>(a)</Label><Text>the permit holder is convicted of an offence in respect of a contravention of any provision of these Regulations or any condition of the permit; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717460" lims:id="717460"><Label>(b)</Label><Text>except when the permit was reinstated under paragraph (2)(b) or (c), the permit has been suspended twice during the period for which it was issued.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717461" lims:id="717461" level="1"><TitleText>Decisions of the Superintendent</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="717462" lims:id="717462" level="2"><TitleText>Notice</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717463" lims:id="717463"><Label>19</Label><Text>If the superintendent refuses to issue a snare permit or suspends or revokes a snare permit, the superintendent shall, as soon as possible after making their decision, provide written notice of their decision, including reasons, to the applicant or permit holder, as applicable.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="717464" lims:id="717464" level="2"><TitleText>Review</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="717465" lims:id="717465"><Label>20</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717466" lims:id="717466"><Label>(1)</Label><Text>Any person to whom the superintendent has refused to issue a snare permit, or whose snare permit has been suspended or revoked by the superintendent, may request a review of the superintendent’s decision by submitting a request in writing to the Chief Executive Officer within 30 days after receipt by that person of the notice referred to in section 19.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717467" lims:id="717467"><Label>(2)</Label><Text>On receipt of the written request for review, the Chief Executive Officer shall require that the superintendent issue or reinstate the snare permit if the Chief Executive Officer reaches a decision that differs from the superintendent’s decision with respect</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717468" lims:id="717468"><Label>(a)</Label><Text>in the case of a refusal, to the requirements and matters to be considered under sections 7 and 8; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="717469" lims:id="717469"><Label>(b)</Label><Text>in the case of a suspension or revocation, to the reasons set out in section 18.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="717470" lims:id="717470"><Label>(3)</Label><Text>The Chief Executive Officer shall provide written notice
