His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 23(a) of the Territorial Lands Act, hereby repeals the Withdrawal from Disposal of Certain Lands Order, made by Order in Council P.C. 1994-1248 dated July 19, 1994a, and makes the annexed Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories.SI/94-95Short TitleThis Order may be cited as the Withdrawal from Disposal Order Aulavik (Banks Island) National Park, Northwest Territories.PurposeThe purpose of this Order is to withdraw certain lands from disposal to establish the Aulavik (Banks Island) National Park.Lands Withdrawn from DisposalSubject to section 4, the lands described in the schedule are withdrawn from disposal for the period beginning on the date of registration and ending on June 1, 2002.ExceptionsSection 3 does not apply in respect ofexisting located or recorded mineral claims or prospecting permits in good standing acquired under the Canada Mining Regulations;existing rights in good standing created pursuant to section 8 of the Territorial Lands Act or under the Territorial Lands Regulations;rights to obtain a surface lease on existing located or recorded mineral claims acquired pursuant to section 8 of the Territorial Lands Act or under the Territorial Lands Regulations;existing permits, special renewal permits and leases in good standing acquired under the Canada Oil and Gas Land Regulations;existing permits in good standing acquired under the Territorial Quarrying Regulations;existing rights, permits and interests granted under the Canada Petroleum Resources Act;existing rights issued pursuant to the Territorial Coal Regulations or the Territorial Dredging Regulations or pursuant to the Forest Management Act of the Northwest Territories; andinterests in lands described in Exhibit 2 of the Acquisition Agreement, dated May 5, 1988, among Her Majesty in right of Canada, the Northern Canada Power Commission, the Government of the Northwest Territories and the Northwest Territories Power Corporation.SI/2001-32, s. 14(Sections 3 and 4)Lands Withdrawn from DisposalIn the Northwest Territories;on Banks Island;All that parcel being more particularly described as follows:All topographic features hereinafter referred to being according to the First Edition of the Cape M’Clure map sheet, and the Second Edition of the Mercy Bay, White Sand Creek, Deans Dundas Bay, Jesse Harbour and Bernard River map sheets, 98E, 88F, 88C, 88B, 98A and 98D and C of the National Topographic System, produced at a scale of 1:250,000 by the Department of Energy, Mines and Resources at Ottawa (map sheets 98E, 88B and 88C being produced by the Army Survey Establishment, R.C.E.).
