list-item="no"><Text>strengthen the special bonds of friendship and cooperation among their nations,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365681" lims:id="365681" format-ref="indent-0-0" language-align="no" list-item="no"><Text>contribute to the harmonious development and expansion of world trade and provide a catalyst to broader international cooperation,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365682" lims:id="365682" format-ref="indent-0-0" language-align="no" list-item="no"><Text>create an expanded and secure market for the goods and services produced in their territories,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365683" lims:id="365683" format-ref="indent-0-0" language-align="no" list-item="no"><Text>reduce distortions to trade,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365684" lims:id="365684" format-ref="indent-0-0" language-align="no" list-item="no"><Text>establish clear and mutually advantageous rules governing their trade,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365685" lims:id="365685" format-ref="indent-0-0" language-align="no" list-item="no"><Text>ensure a predictable commercial framework for business planning and investment,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365686" lims:id="365686" format-ref="indent-0-0" language-align="no" list-item="no"><Text>build on their rights and obligations under the <XRefExternal reference-type="other">General Agreement on Tariffs and Trade</XRefExternal> and other multilateral and bilateral instruments of cooperation,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365687" lims:id="365687" format-ref="indent-0-0" language-align="no" list-item="no"><Text>enhance the competitiveness of their firms in global markets,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365688" lims:id="365688" format-ref="indent-0-0" language-align="no" list-item="no"><Text>foster creativity and innovation, and promote trade in goods and services that are the subject of intellectual property rights,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365689" lims:id="365689" format-ref="indent-0-0" language-align="no" list-item="no"><Text>create new employment opportunities and improve working conditions and living standards in their respective territories,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365690" lims:id="365690" format-ref="indent-0-0" language-align="no" list-item="no"><Text>undertake each of the preceding in a manner consistent with environmental protection and conservation,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365691" lims:id="365691" format-ref="indent-0-0" language-align="no" list-item="no"><Text>preserve their flexibility to safeguard the public welfare,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365692" lims:id="365692" format-ref="indent-0-0" language-align="no" list-item="no"><Text>promote sustainable development,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365693" lims:id="365693" format-ref="indent-0-0" language-align="no" list-item="no"><Text>strengthen the development and enforcement of environmental laws and regulations, and</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365694" lims:id="365694" format-ref="indent-0-0" language-align="no" list-item="no"><Text>protect, enhance and enforce basic workers’ rights;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365695" lims:id="365695" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the Government of Canada has entered into the Agreement having further resolved to</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365696" lims:id="365696" format-ref="indent-0-0" language-align="no" list-item="no"><Text>strengthen Canada’s national identity while at the same time protecting vital national characteristics and qualities,</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365697" lims:id="365697" format-ref="indent-0-0" language-align="no" list-item="no"><Text>establish effective procedures for the review and resolution of disputes in antidumping and countervailing duty cases involving Canada and other NAFTA countries, and</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365698" lims:id="365698" format-ref="indent-0-0" language-align="no" list-item="no"><Text>strengthen the Canadian economy and Canada’s competitiveness as a trading nation;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365699" lims:id="365699" format-ref="indent-0-0" language-align="no" list-item="no"><Text>WHEREAS the Agreement applies generally throughout Canada;</Text></Provision><Provision lims:inforce-start-date="2002-12-31" lims:fid="365700" lims:id="365700" format-ref="indent-0-0" language-align="no" list-item="no"><Text>AND WHEREAS it is necessary, in order to give effect to the Agreement, to make related or consequential amendments to certain Acts;</Text></Provision></Preamble><Enacts lims:inforce-start-date="2002-12-31" lims:fid="365701" lims:id="365701"><Provision lims:inforce-start-date="2002-12-31" lims:fid="365702" lims:id="365702" format-ref="indent-0-0" language-align="no" list-item="no"><Text>NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:</Text></Provision></Enacts></Introduction><Body lims:inforce-start-date="2002-12-31" lims:fid="365703" lims:id="365703"><Heading lims:inforce-start-date="2002-12-31" lims:fid="365704" lims:id="365704" level="1"><TitleText>Short lims:fid="365706" lims:id="365706">Short title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="N-23.8">North American Free Trade Agreement Implementation Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365707" lims:id="365707" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365708" lims:id="365708"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365709" lims:id="365709">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365710" lims:id="365710"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="365711" lims:id="365711"><Text><DefinedTermEn>Agreement</DefinedTermEn> means the North American Free Trade Agreement entered into between the Government of Canada, the Government of the United Mexican States and the Government of the United States of America and signed on December 17, 1992, and includes any rectifications thereto made prior to its ratification by Canada; (<DefinedTermFr>Accord</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365712" lims:id="365712"><Text><DefinedTermEn>federal law</DefinedTermEn> means the whole or any portion of any Act of Parliament or any regulation, order or other instrument issued, made or established in the exercise of a power conferred by or under an Act of Parliament; (<DefinedTermFr>texte législatif fédéral</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365713" lims:id="365713"><Text><DefinedTermEn>Free Trade Commission</DefinedTermEn> means the Free Trade Commission established under Article 2001 of the Agreement; (<DefinedTermFr>Commission du libre-échange</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365714" lims:id="365714"><Text><DefinedTermEn>Minister</DefinedTermEn>, in respect of any provision of this Act, means the member of the Queen’s Privy Council for Canada designated as the Minister for the purposes of that provision under section 11; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365715" lims:id="365715"><Text><DefinedTermEn>NAFTA country</DefinedTermEn> means a country that is a Party to the Agreement; (<DefinedTermFr>pays ALÉNA</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365716" lims:id="365716"><Text><DefinedTermEn>Secretariat</DefinedTermEn> means the Secretariat established pursuant to paragraph 1 of Article 2002 of the Agreement; (<DefinedTermFr>Secrétariat</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="365717" lims:id="365717"><Text><DefinedTermEn>territory</DefinedTermEn>, with respect to a NAFTA country, has the meaning set out with respect to that country in Annex 201.1 of the Agreement. (<DefinedTermFr>territoire</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365718" lims:id="365718"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365719" lims:id="365719">Publication of Agreement and Tariff Schedules</MarginalNote><Label>(2)</Label><Text>The Agreement, including the Schedules of Canada, of Mexico and of the United States referred to in Annex 302.2 of the Agreement, shall be published in the <XRefExternal reference-type="other">Canada Treaty Series</XRefExternal>.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365720" lims:id="365720"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365721" lims:id="365721">Interpretation consistent with Agreement</MarginalNote><Label>3</Label><Text>For greater certainty, this Act, any provision of an Act of Parliament enacted by Part II and any other federal law that implements a provision of the Agreement or fulfils an obligation of the Government of Canada under the Agreement shall be interpreted in a manner consistent with the Agreement.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365722" lims:id="365722" level="1"><TitleText>Purpose</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365723" lims:id="365723"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365724" lims:id="365724">Purpose</MarginalNote><Label>4</Label><Text>The purpose of this Act is to implement the Agreement, the objectives of which, as elaborated more specifically through its principles and rules, including national treatment, most-favoured-nation treatment and transparency, are to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365725" lims:id="365725"><Label>(a)</Label><Text>eliminate barriers to trade in, and facilitate the cross-border movement of, goods and services between the territories of the NAFTA countries;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365726" lims:id="365726"><Label>(b)</Label><Text>promote conditions of fair competition in the free-trade area established by the Agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365727" lims:id="365727"><Label>(c)</Label><Text>increase substantially investment opportunities in the territories of the NAFTA countries;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365728" lims:id="365728"><Label>(d)</Label><Text>provide adequate and effective protection and enforcement of intellectual property rights in the territory of each NAFTA country;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365729" lims:id="365729"><Label>(e)</Label><Text>create effective procedures for the implementation and application of the Agreement, for its joint administration and for the resolution of disputes; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365730" lims:id="365730"><Label>(f)</Label><Text>establish a framework for further trilateral, regional and multilateral cooperation to expand and enhance the benefits of the Agreement.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365731" lims:id="365731" level="1"><TitleText>Her Majesty</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365732" lims:id="365732"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365733" lims:id="365733">Binding on Her Majesty</MarginalNote><Label>5</Label><Text>This Act is binding on Her Majesty in right of Canada.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365734" lims:id="365734" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365735" lims:id="365735"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365736" lims:id="365736">Prohibition of private cause of action</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365737" lims:id="365737"><Label>(1)</Label><Text>No person has any cause of action and no proceedings of any kind shall be taken, without the consent of the Attorney General of Canada, to enforce or determine any right or obligation that is claimed or arises solely under or by virtue of Part I or any order or regulation made under Part I.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365738" lims:id="365738"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365739" lims:id="365739">Idem</MarginalNote><Label>(2)</Label><Text>Subject to Section B of Chapter Eleven of the Agreement, no person has any cause of action and no proceedings of any kind shall be taken, without the consent of the Attorney General of Canada, to enforce or determine any right or obligation that is claimed or arises solely under or by virtue of the Agreement.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365740" lims:id="365740"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365741" lims:id="365741">Non-application of Agreement to water</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365742" lims:id="365742"><Label>(1)</Label><Text>For greater certainty, nothing in this Act or the Agreement, except Article 302 of the Agreement, applies to water.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365743" lims:id="365743"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365744" lims:id="365744">Definition of <DefinedTermEn>water</DefinedTermEn></MarginalNote><Label>(2)</Label><Text>In this section, <DefinedTermEn>water</DefinedTermEn> means natural surface and ground water in liquid, gaseous or solid state, but does not include water packaged as a beverage or in tanks.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365745" lims:id="365745"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365746" lims:id="365746">Application of <XRefExternal reference-type="act" link="I-21">Interpretation Act</XRefExternal></MarginalNote><Label>8</Label><Text>Where the operation of a provision of an Act of Parliament is suspended pursuant to a provision of that Act enacted by Part II, section 43 of the <XRefExternal reference-type="act" link="I-21">Interpretation Act</XRefExternal> applies, with such modifications as the circumstances require, as if the suspended provision had been repealed.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365747" lims:id="365747"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365748" lims:id="365748">For greater certainty</MarginalNote><Label>9</Label><Text>For greater certainty, nothing in this Act, by specific mention or omission, limits in any manner the right of Parliament to enact legislation to implement any provision of the Agreement or fulfil any of the obligations of the Government of Canada under the Agreement.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365749" lims:id="365749" level="1"><Label>PART I</Label><TitleText>Implementation of Agreement Generally</TitleText></Heading><Heading lims:inforce-start-date="2002-12-31" lims:fid="365750" lims:id="365750" level="2"><TitleText>Approval of Agreement</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365751" lims:id="365751"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365752" lims:id="365752">Agreement approved</MarginalNote><Label>10</Label><Text>The Agreement is hereby approved.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365753" lims:id="365753" level="2"><TitleText>Designation of Minister</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365754" lims:id="365754"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365755" lims:id="365755">Order designating Minister</MarginalNote><Label>11</Label><Text>The Governor in Council may, by order, designate any member of the Queen’s Privy Council for Canada to be the Minister for the purposes of any provision of this Act.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365756" lims:id="365756" level="2"><TitleText>Free Trade Commission</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365757" lims:id="365757"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365758" lims:id="365758">Free Trade Commission</MarginalNote><Label>12</Label><Text>The Governor in Council may appoint any member of the Queen’s Privy Council for Canada to be a representative of Canada on the Free Trade Commission.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365759" lims:id="365759"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365760" lims:id="365760">Payment of expenditures</MarginalNote><Label>13</Label><Text>The Government of Canada shall pay its appropriate share of the aggregate of any expenditures incurred by or on behalf of the Free Trade Commission.</Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365761" lims:id="365761" level="2"><TitleText>Canadian Section of Secretariat</TitleText></Heading><Section lims:inforce-start-date="2013-06-26" lims:lastAmendedDate="2013-06-26" lims:fid="365762" lims:id="365762"><MarginalNote lims:inforce-start-date="2013-06-26" lims:fid="365763" lims:id="365763">Canadian Section of Secretariat</MarginalNote><Label>14</Label><Text>The Canadian Section of the Secretariat is established within the Department of Foreign Affairs, Trade and Development for the purpose of facilitating the operation of the Agreement, including the work of panels, committees and scientific review boards that may be established in accordance with the 195</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2010-08-27" lims:lastAmendedDate="2010-08-27" lims:fid="365766" lims:id="365766"><MarginalNote lims:inforce-start-date="2010-08-27" lims:fid="365767" lims:id="365767">Secretary</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2010-08-27" lims:fid="365768" lims:id="365768"><Label>(1)</Label><Text>There shall be a Secretary of the Canadian Section of the Secretariat to be appointed in accordance with the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2010-08-27" lims:fid="365769" lims:id="365769"><MarginalNote lims:inforce-start-date="2010-08-27" lims:fid="365770" lims:id="365770">Duties</MarginalNote><Label>(2)</Label><Text>The Secretary is responsible for fulfilling the mandate of the Section. In doing so, the Secretary shall</Text><Paragraph lims:inforce-start-date="2010-08-27" lims:fid="365771" lims:id="365771"><Label>(a)</Label><Text>provide assistance to the Free Trade Commission;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-08-27" lims:fid="365772" lims:id="365772"><Label>(b)</Label><Text>provide administrative assistance to panels and committees established under Chapter Nineteen of the Agreement and panels established under Chapter Twenty of the Agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-08-27" lims:fid="365773" lims:id="365773"><Label>(c)</Label><Text>support — as the Free Trade Commission may direct — the work of other committees and groups established under the Agreement;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-08-27" lims:fid="365774" lims:id="365774"><Label>(d)</Label><Text>otherwise facilitate — as the Free Trade Commission may direct — the operation of the Agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-08-27" lims:fid="365775" lims:id="365775"><Label>(e)</Label><Text>supervise and direct the work of the any person to be a representative of Canada on any committee referred to in Section A of Annex 2001.2 of the Agreement.</Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365785" lims:id="365785"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365786" lims:id="365786">Costs of panels, committees and scientific review boards</MarginalNote><Label>19</Label><Text>The Government of Canada shall, in accordance with Annex 2002.2 of the Agreement, pay the costs of or its appropriate share of the costs of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365787" lims:id="365787"><Label>(a)</Label><Text>the remuneration and expenses payable to panelists, members of committees, including persons appointed under section 18, and members of scientific review boards;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365788" lims:id="365788"><Label>(b)</Label><Text>the remuneration and expenses payable to assistants; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365789" lims:id="365789"><Label>(c)</Label><Text>the general expenses incurred by panels, committees and scientific review boards.</Text></Paragraph></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="365790" lims:id="365790" level="2"><TitleText>Orders and Regulations</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365791" lims:id="365791"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365792" lims:id="365792">Regulations re Articles 312 and 313</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365793" lims:id="365793"><Label>(1)</Label><Text>The Governor in Council may, where the Governor in Council is of the opinion that, for the purpose of giving effect in a province to Articles 312 and 313 of the Agreement, regulations are necessary in relation to any matter dealt with by those Articles, make regulations for that purpose including, without limiting the generality of the foregoing, regulations requiring or prohibiting the doing of anything in relation to which a regulation may be made under this subsection and prescribing penalties for the contravention of any such regulation.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365794" lims:id="365794"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365795" lims:id="365795">Applicability of regulations in respect of a province</MarginalNote><Label>(2)</Label><Text>A regulation made under subsection (1) shall not come into force in respect of a province if the Governor in Council is of the opinion that the province has, by or under provincial law, enacted provisions or is carrying on practices that are in conformity with the portion of Articles 312 and 313 of the Agreement in respect of which the regulation is made.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365796" lims:id="365796"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365797" lims:id="365797">Consultation with provincial governments</MarginalNote><Label>(3)</Label><Text>The Minister shall consult with the government of a province prior to the making of a regulation under subsection (1) in respect of that province.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365798" lims:id="365798"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365799" lims:id="365799">Expiration</MarginalNote><Label>(4)</Label><Text>A regulation made under subsection (1) or any provision thereof shall cease to be in force in respect of a province on a day or days to be fixed, in respect of that province, by order of the Governor in Council.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365800" lims:id="365800"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365801" lims:id="365801">Binding on province</MarginalNote><Label>(5)</Label><Text>A regulation made under subsection (1) in respect of a province is binding on Her Majesty in right of that province.</Text></Subsection></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="365802" lims:id="365802"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="365803" lims:id="365803">Orders re Article 2019</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365804" lims:id="365804"><Label>(1)</Label><Text>The Governor in Council may, for the purpose of suspending in accordance with the Agreement the application to a NAFTA country of benefits of equivalent effect pursuant to Article 2019 of the Agreement, by order, do any one or more of the following:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365805" lims:id="365805"><Label>(a)</Label><Text>suspend rights or privileges granted by Canada to that country or to goods, service providers, suppliers, investors or investments of that country under the Agreement or any federal law, except under Chapter Nineteen of the Agreement or under any provision of the <XRefExternal reference-type="act" link="S-15">Special Import Measures Act</XRefExternal> enacted by Part II;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365806" lims:id="365806"><Label>(b)</Label><Text>modify or suspend the application of any federal law, except any provision of the <XRefExternal reference-type="act" link="S-15">Special Import Measures Act</XRefExternal> enacted by Part II, with respect to that country or to goods, service providers, suppliers, investors or investments of that country;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365807" lims:id="365807"><Label>(c)</Label><Text>extend the application of any federal law to that country or to goods, service providers, suppliers, investors or investments of that country; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="365808" lims:id="365808"><Label>(d)</Label><Text>take any other measure that the Governor in Council considers necessary for that purpose.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="365809" lims:id="365809"><MarginalNote Any other power, duty or function that is vested in or exercisable by the Secretary of the former Section immediately before that day is, as of that day, vested in and exercisable by the Deputy Minister of Foreign Affairs.</Text></Subsection><Subsection><MarginalNote>Transfer of powers, duties and functions — officers and employees</MarginalNote><Label>(6)</Label><Text>Any power, duty or function exercisable by an officer or employee of the former Section, immediately before the day on which section <XRefInternal>1776</XRefInternal> comes into force is, as of that day, exercisable by that officer or employee as officer or employee of the new Section.</Text></Subsection></Section></RelatedOrNotInForce></BillPiece></Schedule></Statute>
