I-19, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2012-03-16" lims:fid="270729" lims:id="270729" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2012-03-16" lims:lastAmendedDate="2012-03-16" lims:fid="270730" lims:id="270730"><MarginalNote lims:inforce-start-date="2012-03-16" lims:fid="270731" lims:id="270731">Definitions</MarginalNote><Label>2</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2012-03-16" lims:fid="270732" lims:id="270732"><Text><DefinedTermEn>boundary</DefinedTermEn> means the international boundary between Canada and the United States as determined and marked by the Commission; (<DefinedTermFr>frontière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="270733" lims:id="270733"><Text><DefinedTermEn>boundary monument</DefinedTermEn> means a buoy, post, tablet, cairn or other object or structure placed, erected or maintained by the Commission to mark the boundary and includes a reference monument, triangulation station or other marker or structure placed, erected or maintained by the Commission to assist in determining the boundary; (<DefinedTermFr>borne frontière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="270734" lims:id="270734"><Text><DefinedTermEn>Commission</DefinedTermEn> means the International Boundary Commission established pursuant to the treaty of 1908; (<DefinedTermFr>Commission</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="270735" lims:id="270735"><Text><DefinedTermEn>Surveyor General</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="act" link="L-6">Canada Lands Surveys Act</XRefExternal>; (<DefinedTermFr>arpenteur général</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="270736" lims:id="270736"><Text><DefinedTermEn>treaty of 1908</DefinedTermEn> means the treaty between His Majesty King Edward VII and the United States respecting the demarcation of the international boundary between the United States and Canada signed at Washington on April 11, 1908; (<DefinedTermFr>traité de 1908</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-03-16" lims:fid="270737" lims:id="270737"><Text><DefinedTermEn>work</DefinedTermEn> means any ditch, earthwork, building or structure of any description or any lines of telephone, telegraph or power, including posts, piers or abutments for sustaining or protecting the wires or cables of those lines. (<DefinedTermFr>ouvrage</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2012-03-16" lims:fid="270739" lims:id="270739">R.S., 1985, c. I-16, s. 2; 2010, c. 12, s. 1743</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2012-03-16" lims:fid="270740" lims:id="270740" level="1"><TitleText>Powers of the Commission</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="270741" lims:id="270741"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="270742" lims:id="270742">Commission’s powers</MarginalNote><Label>3</Label><Text>For the purpose of maintaining an effective boundary line between Canada and the United States, the Commission and its members, officers, employees and agents may at any time</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="270743" lims:id="270743"><Label>(a)</Label><Text>enter on and pass over the land of any person in order to gain access to the boundary or to survey the boundary;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="270744" lims:id="270744"><Label>(b)</Label><Text>erect and maintain boundary monuments on the land of any person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="270745" lims:id="270745"><Label>(c)</Label><Text>clear from the land of any person such trees and underbrush as the Commission deems necessary to maintain a vista ten feet in width from the boundary.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="270747" lims:id="270747">R.S., c. I-19, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="270748" lims:id="270748"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="270749" lims:id="270749">Removal of unauthorized works</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="270750" lims:id="270750"><Label>(1)</Label><Text>Any work or any addition to a work that is, after July 6, 1960, constructed or placed within ten feet of the boundary without the permission of the Commission may be removed and destroyed by the Commission or its members, officers, employees or agents, and the materials contained in the work or addition may be sold, given away or otherwise disposed of.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="270751" lims:id="270751"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="270752" lims:id="270752">Costs recoverable</MarginalNote><Label>(2)</Label><Text>The costs of and incidental to any removal, destruction or disposition of a work or addition pursuant to subsection (1), after deducting therefrom any sum that may be realized by the sale or other disposition, are recoverable with costs by Her Majesty from the owner as a debt due to Her Majesty.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="270753" lims:id="270753"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="270754" lims:id="270754">Definition of “owner”</MarginalNote><Label>(3)</Label><Text>In this section, <DefinedTermEn>owner</DefinedTermEn> includes the person authorizing or otherwise responsible for the construction or placement of any work or any addition to a work referred to in subsection (1), and the actual or reputed owner or person in possession or claiming ownership thereof for the time being, and all or any of those persons jointly and severally.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="270756" lims:id="270756">R.S., c. I-19, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2012-03-16" lims:fid="270757" lims:id="270757" level="1"><TitleText>Prohibition</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="270758" lims:id="270758"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="270759" lims:id="270759">Construction of works</MarginalNote><Label>5</Label><Text>Except with the permission of the Commission, no person shall</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="270760" lims:id="270760"><Label>(a)</Label><Text>construct or place within ten feet of the boundary any work or any addition to a work; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="270761" lims:id="270761"><Label>(b)</Label><Text>enlarge any work that was on July 6, 1960 within ten feet of the boundary.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="270763" lims:id="270763">R.S., c.
