34.</Text><Definition lims:inforce-start-date="2013-09-02" lims:fid="222438" lims:id="222438"><Text><DefinedTermEn>Agency</DefinedTermEn> means the Financial Consumer Agency of Canada established under section 3. (<DefinedTermFr>Agence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-09-02" lims:fid="222439" lims:id="222439"><Text><DefinedTermEn>bank holding company</DefinedTermEn> means a bank holding company as defined in section 2 of the <XRefExternal reference-type="act" link="B-1.01">Bank Act</XRefExternal>; (<DefinedTermFr>société de portefeuille bancaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-09-02" lims:fid="222440" lims:id="222440"><Text><DefinedTermEn>Commissioner</DefinedTermEn> means the Commissioner of the Agency appointed under section 4. (<DefinedTermFr>commissaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-09-02" lims:fid="222441" lims:id="222441"><Text><DefinedTermEn>consumer provision</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2022-06-30" lims:enacted-date="2018-12-13" lims:fid="222442" lims:id="1370439"><Label>(a)</Label><Text>paragraph 157(2)(e), sections 195.1, 273.1, 627.02 to 627.998 and 979.1 to 979.4 of the <XRefExternal reference-type="act" link="B-1.01">Bank Act</XRefExternal> together with any regulations made under or for the purposes of those provisions;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222443" lims:id="222443"><Label>(a.1)</Label><Text>sections 992 to 1003 of the <XRefExternal reference-type="act" link="B-1.01">Bank Act</XRefExternal> as those sections apply to any notice, document or other information that is required under the provisions referred to in paragraph (a);</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222444" lims:id="222444"><Label>(b)</Label><Text>paragraphs 167(2)(f) and (g), subsection 382.2(3) and sections 385.05 to 385.28 of the <XRefExternal reference-type="act" link="C-41.01">Cooperative Credit Associations Act</XRefExternal> together with any regulations made under or for the purposes of those provisions;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222445" lims:id="222445"><Label>(b.1)</Label><Text>sections 487.01 to 487.12 of the <XRefExternal reference-type="act" link="C-41.01">Cooperative Credit Associations Act</XRefExternal> as those sections apply to any notice, document or other information that is required under the provisions referred to in paragraph (b);</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222446" lims:id="222446"><Label>(c)</Label><Text>paragraphs 165(2)(f) and (g), subsection 469.1(3), sections 479 to 489.3, subsection 542.061(3) and sections 598 to 607.2 of the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal> together with any regulations made under or for the purposes of those provisions;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222447" lims:id="222447"><Label>(c.1)</Label><Text>sections 1034 to 1045 of the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal> as those sections apply to any notice, document or other information that is required under the provisions referred to in paragraph (c);</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222448" lims:id="222448"><Label>(d)</Label><Text>paragraphs 161(2)(e) and (f), subsection 418.1(3) and sections 425.1 to 444.3 of the <XRefExternal reference-type="act" link="T-19.8">Trust and Loan Companies Act</XRefExternal> together with any regulations made under or for the purposes of those provisions;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222449" lims:id="222449"><Label>(d.1)</Label><Text>sections 539.01 to 539.12 of the <XRefExternal reference-type="act" link="T-19.8">Trust and Loan Companies Act</XRefExternal> as those sections apply to any notice, document or other information that is required under the provisions referred to in paragraph (d); and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222450" lims:id="222450"><Label>(e)</Label><Text>subsection 469.1(3) as set out in paragraph 17(1)(f) of the <XRefExternal reference-type="act">Green Shield Canada Act</XRefExternal> and the provisions referred to in paragraph 17(1)(f.1) of that Act as they apply to Green Shield Canada in accordance with section 17 of that Act together with any 8. (<DefinedTermFr>commissaire adjoint</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-09-02" lims:fid="222452" lims:id="222452"><Text><DefinedTermEn>external complaints body</DefinedTermEn> has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="B-1.01">Bank Act</XRefExternal>. (<DefinedTermFr>organisme externe de traitement des reference-type="act" link="B-1.01">Bank Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222455" lims:id="222455"><Label>(b)</Label><Text>an authorized foreign bank as defined in section 2 of the <XRefExternal reference-type="act" link="B-1.01">Bank Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222456" lims:id="222456"><Label>(c)</Label><Text>a company to which the <XRefExternal reference-type="act" link="T-19.8">Trust and Loan Companies Act</XRefExternal> applies;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222457" lims:id="222457"><Label>(d)</Label><Text>a retail association as defined in section 2 of the <XRefExternal reference-type="act" link="C-41.01">Cooperative Credit Associations Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222458" lims:id="222458"><Label>(e)</Label><Text>a company or foreign company to which the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal> applies; lims:id="1124563"><Text><DefinedTermEn>Financial Literacy Leader</DefinedTermEn><Repealed>[Repealed, 2018, c. 27, s. 336]</Repealed></Text></Definition><Definition lims:inforce-start-date="2013-09-02" lims:fid="222461" lims:id="222461"><Text><DefinedTermEn>governing statute</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222462" lims:id="222462"><Label>(a)</Label><Text>in relation to a bank or authorized foreign bank as defined in the <XRefExternal reference-type="act" link="B-1.01">Bank Act</XRefExternal>, that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222463" lims:id="222463"><Label>(b)</Label><Text>in relation to a retail association to which the <XRefExternal reference-type="act" link="C-41.01">Cooperative Credit Associations Act</XRefExternal> applies, that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222464" lims:id="222464"><Label>(c)</Label><Text>in relation to a company or foreign company to which the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal> applies, that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222465" lims:id="222465"><Label>(d)</Label><Text>in relation to a company to which the <XRefExternal reference-type="act" link="T-19.8">Trust and Loan Companies Act</XRefExternal> applies, that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222466" lims:id="222466"><Label>(e)</Label><Text>in relation to Green Shield Canada, the <XRefExternal reference-type="act">Green Shield Canada Act</XRefExternal>. (<DefinedTermFr>loi company</DefinedTermEn> means an insurance holding company as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies lims:inforce-start-date="2024-06-20" lims:enacted-date="2024-06-20" lims:fid="1480288" lims:id="1480288"><Text><DefinedTermEn>participating entity</DefinedTermEn> means a participating entity under the <XRefExternal reference-type="act" link="C-36.75">Consumer-Driven Banking Act</XRefExternal>. (<DefinedTermFr>entité participante</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-09-02" lims:fid="222469" lims:id="222469"><Text><DefinedTermEn>payment card network operator</DefinedTermEn> means an entity, as defined in section 3 of the <XRefExternal reference-type="act" link="P-4.3">Payment Card Networks Act</XRefExternal>, that operates or manages a payment card network, as defined in that section, including by establishing standards and procedures for the acceptance, transmission or processing of payment transactions and by facilitating the electronic transfer of information and funds. (<DefinedTermFr>exploitant de réseau de cartes financial products and services and the public and to the safety and security of consumer-driven banking, including by strengthening the financial literacy of hereby established an agency of the Government of Canada called the Financial Consumer Agency of Canada over which the Minister shall preside and for which the Minister shall be responsible.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222478" lims:id="222478"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222479" lims:id="222479">Objects</MarginalNote><Label>(2)</Label><Text>The objects of the Agency are to</Text><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222480" lims:id="222480"><Label>(a)</Label><Text lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="1412041" lims:id="1415045">supervise financial institutions and the external complaints body to determine whether they are in compliance with</Text><Subparagraph lims:inforce-start-date="2013-09-02" lims:fid="222481" lims:id="222481"><Label>(i)</Label><Text>the consumer provisions applicable to them, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-09-02" lims:fid="222482" lims:id="222482"><Label>(ii)</Label><Text>the terms and conditions or undertakings with respect to the protection of customers of financial institutions that the Minister imposes or requires, as the case may be, under an Act listed in Schedule 1 and the directions that the Minister imposes under this Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2020-04-30" lims:enacted-date="2018-12-13" lims:fid="222483" lims:id="1245292"><Label>(b)</Label><Text>strive to protect the rights and interests of consumers of financial products and services and the public, taking into account the need of financial institutions to efficiently manage their business operations;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-04-30" lims:enacted-date="2018-12-13" lims:fid="222484" lims:id="1245293"><Label>(b.1)</Label><Text><Repealed>[Repealed, 2018, c. 27, s. 338]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2020-04-30" lims:enacted-date="2018-12-13" lims:fid="222487" lims:id="1245294"><Label>(c)</Label><Text>promote the adoption by financial institutions of policies and procedures designed to implement provisions, terms and conditions, undertakings or directions referred to in paragraph (a) — as well as voluntary codes of conduct that are adopted by financial institutions, and any public commitments made by them, that are designed to protect the rights and interests of their customers — and monitor the implementation of those voluntary codes and public commitments;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="1245295" lims:id="1415050"><Label>(c.1)</Label><Text>promote the adoption by the external complaints body of policies and procedures designed to implement the provisions, terms and conditions, undertakings or directions referred to in paragraph (a);</Text></Paragraph><Paragraph lims:inforce-start-date="2020-04-30" lims:enacted-date="2018-12-13" lims:fid="1245296" lims:id="1245296"><Label>(c.2)</Label><Text>monitor and evaluate trends and emerging issues that may have an impact on consumers of financial products and services, and make information on those trends and issues public;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="222488" lims:id="1415052"><Label>(d)</Label><Text>strengthen the financial literacy of Canadians and promote consumer awareness about the obligations of financial institutions and the external complaints body under the consumer provisions applicable to them and about all matters connected with the protection of consumers of financial products and services; and</Text></Paragraph><Paragraph lims:inforce-start-date="2020-04-30" lims:enacted-date="2018-12-13" lims:fid="222489" lims:id="1245298"><Label>(e)</Label><Text>foster, in co-operation with any department, agency or agent corporation of the Government of Canada or of a province, financial institutions and consumer and other organizations, an understanding of financial services and issues relating to financial monitor any public commitments made by them regarding their commercial practices in relation to payment card networks; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222497" lims:id="222497"><Label>(d)</Label><Text>promote public awareness about the obligations of payment card network operators under a voluntary code of conduct or under the <XRefExternal reference-type="act" link="P-4.3">Payment Card Networks Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-06-20" lims:enacted-date="2024-06-20" banking</MarginalNote><Label>(4)</Label><Text>The objects of the Agency in relation to consumer-driven banking are to</Text><Paragraph lims:inforce-start-date="2024-06-20" lims:enacted-date="2024-06-20" lims:fid="1480881" lims:id="1480881"><Label>(a)</Label><Text>supervise the participating entities, the external complaints body and the technical standards body to determine whether they are in compliance with</Text><Subparagraph lims:inforce-start-date="2024-06-20" lims:enacted-date="2024-06-20" lims:fid="1480882" lims:id="1480882"><Label>(i)</Label><Text>the provisions of the <XRefExternal reference-type="act" link="C-36.75">Consumer-Driven Banking Act</XRefExternal> that are applicable to them, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2024-06-20" lims:enacted-date="2024-06-20" lims:fid="1480883" lims:id="1480883"><Label>(ii)</Label><Text>any terms and conditions or undertakings with respect to consumer-driven banking that the Minister imposes or requires, as the case may be, under an Act listed in Schedule 1 and the directions that the Minister imposes under this Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2024-06-20" lims:enacted-date="2024-06-20" lims:fid="1480884" lims:id="1480884"><Label>(b)</Label><Text>monitor and evaluate trends and emerging issues that may have an impact on consumers of consumer-driven banking, including the trends and issues in respect of products, services and market developments, and make adopted a voluntary code of conduct referred to in paragraph 3(2)(c) or made a commitment designed to protect the interests of its customers, may make or cause to be made any review that he or she considers necessary to monitor compliance with the code or the commitment, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2010-07-12" lims:fid="222547" lims:id="222547"><MarginalNote lims:inforce-start-date="2010-07-12" lims:fid="222548" lims:id="222548">Review</MarginalNote><Label>(3.1)</Label><Text>If a payment card network operator has adopted a voluntary code of conduct or made a public commitment referred to in paragraph 3(3)(c), the Commissioner may make or cause to be made any review that he or she considers necessary to monitor compliance with the code or the commitment, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2010-07-12" lims:fid="222549" lims:id="222549"><MarginalNote due regard for the role of any department, agency or agent corporation of the Government of Canada or of a province or any organization that has a role in monitoring compliance by financial lims:fid="222662" lims:id="222662">Confidential information — payment card network operators</MarginalNote><Label>(3)</Label><Text>Subject to subsection (4) and except as otherwise provided in this Act, information regarding the business or affairs of a payment card network operator, or regarding persons dealing with one, that is obtained by the Commissioner or by a person acting under the direction of the Commissioner, in the course of the exercise or performance of powers, duties and functions under subsection 5(1.1) or (2.1), and any information prepared from that information, is confidential and shall be treated accordingly.</Text></Subsection><Subsection lims:inforce-start-date="2021-06-29" lims:enacted-date="2021-06-29" lims:fid="222663" lims:id="1311665"><MarginalNote described in subsection 3(3) — and the amounts of any prescribed categories of those expenses in relation to any prescribed group of financial institutions and the external complaints lims:id="222672">Commissioner to ascertain expenses — direction</MarginalNote><Label>(1.1)</Label><Text>After the publication of a notice under subsection <XRefInternal>5.1</XRefInternal>(5), the Commissioner shall ascertain the amount of expenses that the Agency incurred in complying with the direction.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222673" lims:id="222673"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222674" lims:id="222674">Amount conclusive</MarginalNote><Label>(2)</Label><Text>The amounts ascertained under subsections (1) and (1.1) are final and conclusive for the purposes of this section.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="222675" lims:id="1415224"><MarginalNote lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="1415225" lims:id="1415225">Assessment</MarginalNote><Label>(3)</Label><Text>As soon as possible after ascertaining the amounts under subsections (1) and (1.1), the Commissioner shall assess a portion of the total amount of expenses against each financial institution and the external complaints body to the extent and in the manner that the Governor in Council may, by regulation, prescribe.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222677" lims:id="222677"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222678" lims:id="222678">Exception</MarginalNote><Label>(3.1)</Label><Text>No assessment is to be made in respect of</Text><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222679" lims:id="222679"><Label>(a)</Label><Text>a company to which the <XRefExternal reference-type="act" link="I-11.8">Insurance Companies Act</XRefExternal> applies that was exempt from the application of paragraphs 165(2)(f) and (g) and sections 479 to 489.2 of that Act during the entire fiscal year to which the assessment relates; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-09-02" lims:fid="222680" lims:id="222680"><Label>(b)</Label><Text>a foreign company to which that Act applies that was exempt assessment</MarginalNote><Label>(4)</Label><Text>The Commissioner may, during each fiscal year, prepare an interim assessment against any financial institution or the external complaints body.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222683" lims:id="222683"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222684" lims:id="222684">Assessment for financial literacy</MarginalNote><Label>(4.1)</Label><Text>The Commissioner may, during a fiscal year, impose an assessment against any financial institution to cover some or all of the expenses related to initiatives to strengthen the financial literacy of Canadians.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="222685" lims:id="1415229"><MarginalNote lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="1415230" lims:id="1415230">Assessment is binding</MarginalNote><Label>(5)</Label><Text>Every assessment and interim assessment is final and conclusive and binding on the financial institution against which it is made or the external complaints body, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222687" lims:id="222687"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222688" lims:id="222688">Commissioner to ascertain expenses — payment card network operators</MarginalNote><Label>(5.1)</Label><Text>The Commissioner shall, before December 31 in each year, lims:id="222692">Assessment</MarginalNote><Label>(5.3)</Label><Text>As soon as possible after ascertaining the amount under subsection (5.1), the Commissioner shall assess a portion of the total amount of expenses against each payment card network operator to the extent and in the manner that may be prescribed.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" may, during each fiscal year, prepare an interim assessment against any payment card network operator.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222695" lims:id="222695"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222696" lims:id="222696">Assessment is binding</MarginalNote><Label>(5.5)</Label><Text>Every assessment and interim assessment is final and conclusive and binding on the payment card network operator against which it is made.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222697" lims:id="222697"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222698" lims:id="222698">Recovery</MarginalNote><Label>(6)</Label><Text>Every assessment and interim assessment constitutes a debt due to Her Majesty, is immediately payable and may be recovered as a debt in any court of competent jurisdiction.</Text></Subsection><Subsection lims:inforce-start-date="2013-09-02" lims:fid="222699" lims:id="222699"><MarginalNote lims:inforce-start-date="2013-09-02" lims:fid="222700" lims:id="222700">Interest</MarginalNote><Label>(7)</Label><Text>Interest may be charged on the unpaid amount of an assessment or interim assessment at a rate equal to the rate prescribed under the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> for amounts payable within 30 days after the notice is served, or within any longer period that the Commissioner specifies, to pay the penalty or to make representations to the Commissioner with respect to the violation
