lims:id="214340">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2007-08-03" lims:fid="214341" lims:id="214341"><Text><DefinedTermEn>emergency management</DefinedTermEn> means the prevention and mitigation of, preparedness for, response to and recovery from emergencies. (<DefinedTermFr>gestion</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-08-03" lims:fid="214342" lims:id="214342"><Text><DefinedTermEn>emergency management plan</DefinedTermEn> means a program, arrangement or other measure</Text><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214343" lims:id="214343"><Label>(a)</Label><Text>for dealing with an emergency by the civil population; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214344" lims:id="214344"><Label>(b)</Label><Text>for dealing with a civil emergency by the Canadian Forces in accordance with the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>. (<DefinedTermFr>plan de gestion des urgences</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-08-03" lims:fid="214345" lims:id="214345"><Text><DefinedTermEn>government institution</DefinedTermEn> means any department, branch, office, board, agency, commission, corporation or other body for the administration or affairs of which a minister of the Crown is accountable to Parliament. (<DefinedTermFr>institution fédérale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-08-03" lims:fid="214346" lims:id="214346"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Public Safety and Emergency Preparedness. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-08-03" lims:fid="214347" lims:id="214347"><Text><DefinedTermEn>provincial emergency</DefinedTermEn> means an emergency occurring in a province if the province or a local authority in the province has the primary responsibility for dealing with the emergency. (<DefinedTermFr>urgence provinciale</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2007-08-03" lims:fid="214348" lims:id="214348" level="1"><TitleText>Minister’s Responsibilities</TitleText></Heading><Section lims:inforce-start-date="2007-08-03" lims:lastAmendedDate="2007-08-03" lims:fid="214349" lims:id="214349"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214350" lims:id="214350">Ministerial responsibilities — general</MarginalNote><Label>3</Label><Text>The Minister is responsible for exercising leadership relating to emergency management in Canada by coordinating, among government institutions and in cooperation with the provinces and other entities, emergency management activities.</Text></Section><Section lims:inforce-start-date="2007-08-03" lims:lastAmendedDate="2007-08-03" lims:fid="214351" lims:id="214351"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214352" lims:id="214352">Responsibilities — Canada</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2007-08-03" lims:fid="214353" lims:id="214353"><Label>(1)</Label><Text>The Minister’s responsibilities under section 3 include</Text><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214354" lims:id="214354"><Label>(a)</Label><Text>establishing policies, programs and other measures respecting the preparation, maintenance, testing and implementation by a government institution of emergency management plans;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214355" lims:id="214355"><Label>(b)</Label><Text>providing advice to government institutions respecting the preparation, maintenance, testing and implementation of emergency management plans;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214356" lims:id="214356"><Label>(c)</Label><Text>analysing and evaluating emergency management plans prepared by government institutions;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214357" lims:id="214357"><Label>(d)</Label><Text>monitoring potential, imminent and actual emergencies and advising other ministers accordingly;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214358" lims:id="214358"><Label>(e)</Label><Text>coordinating the Government of Canada’s response to an emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214359" lims:id="214359"><Label>(f)</Label><Text>coordinating the activities of government institutions relating to emergency management with those of the provinces — and supporting the emergency management activities of the provinces — and through the provinces, those of local authorities;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214360" lims:id="214360"><Label>(g)</Label><Text>establishing arrangements with each province whereby any consultation with its lieutenant governor in council with respect to a declaration of an emergency under an Act of Parliament may be carried out effectively;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214361" lims:id="214361"><Label>(h)</Label><Text>coordinating the provision of assistance to a province in respect of a provincial emergency, other than the provision of financial assistance and the calling out of the Canadian Forces for service in aid of the civil power under Part VI of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214362" lims:id="214362"><Label>(i)</Label><Text>providing assistance other than financial assistance to a province if the province requests it;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214363" lims:id="214363"><Label>(j)</Label><Text>providing financial assistance to a province if</Text><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214364" lims:id="214364"><Label>(i)</Label><Text>a provincial emergency in the province has been declared to be of concern to the federal government under section 7,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214365" lims:id="214365"><Label>(ii)</Label><Text>the Minister is authorized under that section to provide the assistance, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214366" lims:id="214366"><Label>(iii)</Label><Text>the province has requested the assistance;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214367" lims:id="214367"><Label>(k)</Label><Text>participating, in accordance with Canada’s foreign relations policies, in international emergency management activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214368" lims:id="214368"><Label>(l)</Label><Text>establishing the necessary arrangements for the continuity of constitutional government in the event of an emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214369" lims:id="214369"><Label>(m)</Label><Text>establishing policies and programs respecting emergency management;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214370" lims:id="214370"><Label>(n)</Label><Text>conducting exercises and providing education and training related to emergency management;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214371" lims:id="214371"><Label>(o)</Label><Text>promoting a common approach to emergency management, including the adoption of standards and best practices;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214372" lims:id="214372"><Label>(p)</Label><Text>conducting research related to emergency management;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214373" lims:id="214373"><Label>(q)</Label><Text>promoting public awareness of matters related to emergency management; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214374" lims:id="214374"><Label>(r)</Label><Text>facilitating the authorized sharing of information in order to enhance emergency management.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-08-03" lims:fid="214375" lims:id="214375"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214376" lims:id="214376">Other responsibilities</MarginalNote><Label>(2)</Label><Text>The Minister has any other responsibilities in relation to emergency management that the Governor in Council may specify.</Text></Subsection></Section><Section lims:inforce-start-date="2007-08-03" lims:lastAmendedDate="2007-08-03" lims:fid="214377" lims:id="214377"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214378" lims:id="214378">Responsibilities — United States</MarginalNote><Label>5</Label><Text>In consultation with the Minister of Foreign Affairs, the Minister may develop joint emergency management plans with the relevant United States’ authorities and, in accordance with those plans, coordinate Canada’s response to emergencies in the United States and provide assistance in response to those emergencies.</Text></Section><Heading lims:inforce-start-date="2007-08-03" lims:fid="214379" lims:id="214379" level="1"><TitleText>Ministers’ Responsibilities</TitleText></Heading><Section lims:inforce-start-date="2007-08-03" lims:lastAmendedDate="2007-08-03" lims:fid="214380" lims:id="214380"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214381" lims:id="214381">Ministers’ responsibilities</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2007-08-03" lims:fid="214382" lims:id="214382"><Label>(1)</Label><Text>The emergency management responsibilities of each minister accountable to Parliament for a government institution are to identify the risks that are within or related to his or her area of responsibility — including those related to critical infrastructure — and to do the following in accordance with the policies, programs and other measures established by the Minister:</Text><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214383" lims:id="214383"><Label>(a)</Label><Text>prepare emergency management plans in respect of those risks;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214384" lims:id="214384"><Label>(b)</Label><Text>maintain, test and implement those plans; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214385" lims:id="214385"><Label>(c)</Label><Text>conduct exercises and training in relation to those plans.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-08-03" lims:fid="214386" lims:id="214386"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214387" lims:id="214387">Contents of emergency management plans</MarginalNote><Label>(2)</Label><Text>Each minister shall include in an emergency management plan</Text><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214388" lims:id="214388"><Label>(a)</Label><Text>any programs, arrangements or other measures to assist provincial governments and, through the provincial governments, local authorities;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214389" lims:id="214389"><Label>(b)</Label><Text>any federal-provincial regional plans;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214390" lims:id="214390"><Label>(c)</Label><Text>any programs, arrangements or other measures to provide for the continuity of the operations of the government institution in the event of an emergency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214391" lims:id="214391"><Label>(d)</Label><Text>in the case of war or other armed conflict, the programs, arrangements or other measures that</Text><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214392" lims:id="214392"><Label>(i)</Label><Text>support the overall defence effort,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214393" lims:id="214393"><Label>(ii)</Label><Text>support the Canadian Forces and the armed forces of Canada’s allies in the conduct of military operations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214394" lims:id="214394"><Label>(iii)</Label><Text>contribute to meeting Canada’s military and civil wartime obligations to its allies, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-08-03" lims:fid="214395" lims:id="214395"><Label>(iv)</Label><Text>mitigate the effects of foreign armed conflict on Canada.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-08-03" lims:fid="214396" lims:id="214396"><MarginalNote lims:inforce-start-date="2007-08-03" lims:fid="214397" lims:id="214397">Provincial emergencies</MarginalNote><Label>(3)</Label><Text>A government institution may not respond to a provincial emergency unless the government of the province requests assistance or there is an agreement with the province that requires or permits the assistance.</Text></Subsection></Section><Heading lims:inforce-start-date="2007-08-03" lims:fid="214398" recommendation of the Minister make orders or regulations</Text><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214401" lims:id="214401"><Label>(a)</Label><Text>respecting the preparation, maintenance, testing and implementation of emergency management plans;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214402" lims:id="214402"><Label>(b)</Label><Text>respecting the use of federal civil resources in response to civil emergencies;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214403" lims:id="214403"><Label>(c)</Label><Text>declaring a provincial emergency to be of concern to the federal government; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-08-03" lims:fid="214404" lims:id="214404"><Label>(d)</Label><Text>authorizing the Minister to provide financial assistance to a province under paragraph
