reference-type="regulation" link="SOR-86-21">Atlantic Fishery Regulations, 1985</XRefExternal>; (<DefinedTermFr>division 3N</DefinedTermFr>)</Text></Definition><Definition (<DefinedTermFr>division 3O</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-06-06" lims:fid="555463" lims:id="555463" generate-in-text="no"><Text><DefinedTermEn>Fishing Zone 4</DefinedTermEn>, <DefinedTermEn>Fishing Zone 5</DefinedTermEn> or <DefinedTermEn>Fishing Zone 6</DefinedTermEn> means the area of the sea described as Fishing Zone 4, Fishing Zone 5 or Fishing Zone 6 in the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1548">Fishing Zones of Canada (Zones 4 and 5) Order</XRefExternal> and the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1549">Fishing Zones of Canada (Zone 6) Order</XRefExternal>; (<DefinedTermFr>Zone de pêche 4, Zone de pêche 5, Zone de pêche 6</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-06-06" lims:fid="555464" lims:id="555464" generate-in-text="no"><Text><DefinedTermEn>flag state</DefinedTermEn> of a foreign fishing vessel means the state in which the vessel is registered or, where the vessel is not registered, the state whose flag the vessel is entitled to fly; (<DefinedTermFr>État du pavillon</DefinedTermFr>)</Text></Definition><Definition reference-type="other">International Code of Signals</XRefExternal> published by the Department of Transport; (<DefinedTermFr>Code international de signaux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-06-06" lims:fid="555466" lims:id="555466" generate-in-text="no"><Text><DefinedTermEn>licence</DefinedTermEn> means 1</DefinedTermEn> means the signal prescribed in the <XRefExternal reference-type="other">International Code of Signals</XRefExternal> to mean “You should stop or heave to, otherwise I shall open fire on you.”; (<DefinedTermFr>signal SQ 1</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-06-06" lims:fid="555479" lims:id="555479" generate-in-text="no"><Text><DefinedTermEn>Signal SQ 3</DefinedTermEn> means the signal prescribed in the <XRefExternal reference-type="other">International Code of Signals</XRefExternal> to mean “You should stop, or heave to; I am going to board you”.; (<DefinedTermFr>signal SQ 3</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-06-06" lims:fid="555480" lims:id="555480" generate-in-text="no"><Text><DefinedTermEn>sport fishing</DefinedTermEn> means fishing for pleasure and not for sale or barter; (<DefinedTermFr>pêche lims:inforce-start-date="2014-06-06" lims:fid="555491" lims:id="555491"><Label>(1)</Label><Text>The Minister may, on receipt of an application for a licence, issue a licence authorizing</Text><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555492" lims:id="555492"><Label>(a)</Label><Text>a foreign fishing vessel and its crew to enter Canadian fisheries waters for any of the following purposes:</Text><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555493" lims:id="555493"><Label>(i)</Label><Text>to engage in commercial fishing,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555494" lims:id="555494"><Label>(ii)</Label><Text>to tranship or take on board any fish, outfit or supplies while at sea,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555495" lims:id="555495"><Label>(iii)</Label><Text>to process fish at sea,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555496" lims:id="555496"><Label>(iv)</Label><Text>to transport fish from fishing grounds,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555497" lims:id="555497"><Label>(v)</Label><Text>to provision, service, repair or maintain any other foreign fishing vessel while at sea,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555498" lims:id="555498"><Label>(vi)</Label><Text>to purchase or obtain bait, outfits or supplies at a Canadian port,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555499" lims:id="555499"><Label>(vii)</Label><Text>to effect repairs at a Canadian port,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555500" lims:id="555500"><Label>(viii)</Label><Text>to purchase, load, unload, transship, sell or process fish or fish products at a Canadian port,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555501" lims:id="555501"><Label>(ix)</Label><Text>to unload, land, re-embark or tranship at a Canadian port any equipment of that vessel or of any other fishing vessel of the same flag state,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555502" lims:id="555502"><Label>(x)</Label><Text>to grant shore leave to the crew of that vessel at a Canadian port, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555503" lims:id="555503"><Label>(xi)</Label><Text>to discharge or take on board at a Canadian port a member of the crew of that vessel or of any other fishing vessel of the same flag state;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555504" lims:id="555504"><Label>(b)</Label><Text>a foreign fishing vessel and its crew to pass through any of the following Canadian fisheries waters during the course of a voyage to a destination outside Canadian fisheries waters, namely,</Text><Subparagraph lims:inforce-start-date="2014-06-06" lims:fid="555505" lims:id="555505"><Label>(i)</Label><Text>the waters between Vancouver Island and the mainland of British Columbia bounded on the south by the 49th parallel of latitude and bounded on the north by a straight line from Cape Sutil on the northern end of Vancouver Island to Cape Caution on the mainland of British line from Yolk Point on Farrant Island to Sainty Point on the mainland of British Columbia and bounded on the north by a straight line from Rippon Point on Pitt Island to Buckley Point on the mainland of British Columbia; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555512" lims:id="555512"><Label>(c)</Label><Text>a foreign fishing vessel and its crew to enter Canadian fisheries waters to engage in fishing for purposes of scientific research or any activity described in any of subparagraphs (a)(ii) to (xi) or subsection (1.1) that relates to the scientific research.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555513" lims:id="555513"><Label>(1.1)</Label><Text>The Minister may, on receipt of an application for a licence, issue a licence authorizing a foreign fishing vessel and its crew to enter Canadian fisheries waters for any of the following purposes:</Text><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555514" lims:id="555514"><Label>(a)</Label><Text>to provide supplies to a Canadian fishing vessel or a foreign fishing vessel while it is at sea; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555515" lims:id="555515"><Label>(b)</Label><Text>for the purpose described in paragraph (a), to purchase supplies at a Canadian port.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="555516" lims:id="1145804"><Label>(1.11)</Label><Text>The Minister shall not issue a licence under paragraph (1)(a) or subsection (1.1) unless the Minister determines that the Government of Canada has favourable fisheries relations with the government of the vessel’s flag state and, if the licence relates to a specific fishery, that the Government of Canada has favourable fisheries relations with the government of the vessel’s flag state with respect to that fishery.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555517" lims:id="555517"><Label>(1.12)</Label><Text>The Minister shall not issue a licence under paragraph (1)(a) or subsection (1.1) if there are reasonable grounds to believe that</Text><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555518" lims:id="555518"><Label>(a)</Label><Text>the vessel is not licensed or otherwise authorized by its flag state to engage in fisheries activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555519" lims:id="555519"><Label>(b)</Label><Text>the vessel is not in compliance with relevant conservation and management measures;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555520" lims:id="555520"><Label>(c)</Label><Text>the vessel is providing supplies to a foreign fishing vessel that is not in compliance with relevant conservation and management measures;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555521" lims:id="555521"><Label>(d)</Label><Text>the proposed activity is not compatible with or will undermine relevant conservation and management measures; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-06" lims:fid="555522" lims:id="555522"><Label>(e)</Label><Text>the proposed activity is not consistent with the sustainable use of fisheries resources or will contribute to excess harvesting or processing capacity.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555523" lims:id="555523"><Label>(1.2)</Label><Text>The Minister shall, on receipt of an application for a licence and in accordance with the <XRefExternal reference-type="other">Procès-Verbal applying the March 27, 1972 Agreement between Canada and France on their Mutual Fishing Relations</XRefExternal>, signed on December 2, 1994, issue a licence authorizing a French fishing vessel and its crew to enter Canadian fisheries waters for any of the purposes set out in that Procès-Verbal.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555524" lims:id="555524"><Label>(1.3)</Label><Text>The Minister shall, on receipt of an application for a licence and in accordance with the <XRefExternal reference-type="other">Treaty between the Government of Canada and the Government of the United States of America on Pacific Coast Albacore Tuna Vessels and Port Privileges</XRefExternal>, signed on May 26, 1981, issue a licence authorizing a United States fishing vessel and its crew to enter Canadian fisheries waters for any of the purposes set out in that Treaty.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555525" lims:id="555525"><Label>(1.4)</Label><Text>The Minister shall, on receipt of an application for a licence and in accordance with the <XRefExternal reference-type="other">Convention between Canada and the United States of America for the Extension of Port Privileges to Halibut Fishing Vessels on the Pacific Coasts of the United States of America and Canada</XRefExternal>, signed on March 24, 1950, issue a licence authorizing a United States fishing vessel and its crew to enter Canadian fisheries waters for any of the purposes set out in that Convention.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="555526" lims:id="1145805"><Label>(1.5)</Label><Text>The Minister may refuse to issue a licence referred to in any of subsections (1.2) to (1.4) if he or she determines that one of the circumstances set out in paragraphs (1.12)(a) to (e) applies and that the flag state has taken insufficient measures to remedy the situation.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555527" lims:id="555527"><Label>(1.6)</Label><Text><Repealed>[Repealed, SOR/99-474, s. 1]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555528" lims:id="555528"><Label>(2)</Label><Text>The fees payable for a licence issued pursuant to this section are as set out in Schedule I.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555529" lims:id="555529"><Label>(3)</Label><Text>The licence fees for foreign fishing vessels shall be paid within 45 days from the date of billing.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-06" lims:fid="555530" lims:id="555530"><Label>(4)</Label><Text>The Minister may, at the request of the master of a foreign fishing vessel that is in Canadian fisheries waters in the circumstances referred to in section 14 or 15, issue a licence authorizing that vessel and its crew to engage in all or any of the activities lims:id="1145808"><Label>5.1</Label><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145809" lims:id="1145809"><Label>(1)</Label><Text>The Minister may, further to an order made by the flag state, issue a permit authorizing a foreign fishing vessel and its crew to enter Canadian fisheries waters for the purpose of verifying compliance with a law, measure or treaty referred to in subparagraph 6(a)(iii) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145810" lims:id="1145810"><Label>(2)</Label><Text>If the Minister issues a permit under subsection (1), he or she must advise both the flag state and the foreign fishing vessel and inform them of the permit’s conditions.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145812" lims:id="1145812" level="1"><TitleText>Application for Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="555534" lims:id="555534"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="555535" lims:id="555535"><Label>(1)</Label><Text>Subject to subsection (3), the representative of the flag state of a foreign fishing vessel mentioned in paragraph 7(f) may apply for a licence referred to in section 5 in respect of that vessel and its crew by filing an application, signed by the representative, at the regional headquarters of the Department of Fisheries and Oceans responsible for issuing such licences for that flag state.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="555536" lims:id="555536"><Label>(2)</Label><Text>An application referred to in subsection (1) shall be filed not less than 30 days prior to the first day on which the licence is required except that the Minister may, in order to prevent hardship, accept an application at any time.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="555537" lims:id="555537"><Label>(3)</Label><Text>Where an application for a licence is in respect of a foreign fishing vessel that is under a charter to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555538" lims:id="555538"><Label>(a)</Label><Text>an individual resident and domiciled in Canada,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555539" lims:id="555539"><Label>(b)</Label><Text>a corporation incorporated under the laws of Canada or a province, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555540" lims:id="555540"><Label>(c)</Label><Text>Her Majesty in right of Canada or a province,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="555541" lims:id="555541"><Text>the application shall be signed by the charterer who shall, in respect of that vessel, be regarded as the representative in respect of a foreign fishing vessel:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555545" lims:id="555545"><Label>(a)</Label><Text>the name and description of the vessel, its equipment and complement;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555546" lims:id="555546"><Label>(b)</Label><Text>the flag state and home port of the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555547" lims:id="555547"><Label>(c)</Label><Text>the name of the owner and master of the vessel and, where applicable, its charterer;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555548" lims:id="555548"><Label>(d)</Label><Text>the side number of the vessel, its radio frequencies and call sign;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555549" lims:id="555549"><Label>(e)</Label><Text>a description of the proposed purpose and the period for which the licence is required;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555550" lims:id="555550"><Label>(f)</Label><Text>the name and address of a person resident in Canada having a permanent office or establishment in Canada who is authorized by the flag state to represent that flag state for the purpose of providing liaison with the appropriate officials of the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="555551" lims:id="1146061"><Label>(f.1)</Label><Text>in the case of an application for a licence referred to in paragraph 5(1)(a) or subsection 5(1.1), any information or document that is relevant to the matters referred to in paragraphs 5(1.12)(a) to (e);</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145813" lims:id="1145813"><Label>(f.2)</Label><Text>any information that is required by Annex A to the Port State Measures Agreement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555552" lims:id="555552"><Label>(g)</Label><Text>any information the lims:inforce-start-date="2006-03-22" lims:fid="555556" lims:id="555556"><Label>(1)</Label><Text>An application for a licence may be made on behalf of pair trawlers and shall contain the information required by section 7 in respect of both vessels.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="555557" lims:id="555557"><Label>(2)</Label><Text>Where a licence is issued in respect of pair trawlers, it shall be issued in respect of the vessel designated in the application as the command vessel and shall be carried on board that lims:inforce-start-date="2017-04-13" lims:fid="555561" lims:id="555561"><Label>(1)</Label><Text>Every licence shall</Text><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555562" lims:id="555562"><Label>(a)</Label><Text>apply only to the foreign fishing vessel described therein and where applicable to the crew of that vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555563" lims:id="555563"><Label>(b)</Label><Text>be valid only for the period specified therein; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555564" lims:id="555564"><Label>(c)</Label><Text>cease to be valid on any change in the flag state registry or ownership of the vessel described in the licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555565" lims:id="555565"><Label>(2)</Label><Text><Repealed>[Repealed, SOR/85-527, s. 6]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555566" lims:id="555566"><Label>(3)</Label><Text>The Minister may amend any provision in the licence on receipt of an application from the person referred to in paragraph 7(f) or, if an error has been made in the licence, on his or her own initiative.</Text></Subsection><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555567" lims:id="555567"><Label>(4)</Label><Text>An application referred to in subsection (3) shall be filed not less than 14 days prior to the first day on which the amendment is required except that the Minister may, in order to prevent hardship, accept an application at any time.</Text></Subsection><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555568" lims:id="555568"><Label>(5)</Label><Text>An amendment referred to in subsection (3) is not binding on the master of the vessel to which the licence applies until it is received by the representative in Canada designated pursuant to paragraph 7(f).</Text></Subsection><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555569" lims:id="555569"><Label>(6)</Label><Text>The lims:id="555573"><Label>(1)</Label><Text>Subject to subsection (2), every licence shall be kept on board the foreign fishing vessel described in the licence while that vessel is in Canadian fisheries waters and shall be produced for examination by a protection officer at his request.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="555574" lims:id="555574"><Label>(2)</Label><Text>Where a licence has been issued but not delivered, a Regional Director-General shall authorize the foreign fishing vessel described in the licence to enter Canadian fisheries waters and proceed directly to the Canadian port designated by him for the purpose of obtaining the licence if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555575" lims:id="555575"><Label>(a)</Label><Text>all fishing gear on board the vessel is stowed below deck or otherwise removed from the place where it is normally used for fishing and placed where it is not readily available for fishing; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="555576" lims:id="555576"><Label>(b)</Label><Text>the master of the lims:enacted-date="2019-06-17" lims:fid="555584" lims:id="1145819"><Label>(b)</Label><Text>the vessel and its crew shall engage only in the activities that are authorized by the licence or permit;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="555585" lims:id="1145820"><Label>(c)</Label><Text>the activities authorized by the licence or permit shall be carried out only at the times and in the areas of Canadian fisheries waters or ports specified in the licence or permit;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555586" lims:id="555586"><Label>(d)</Label><Text>where fishing is authorized by the licence</Text><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555587" lims:id="555587"><Label>(i)</Label><Text>the crew of the vessel shall fish only for a species of fish specified in the licence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555588" lims:id="555588"><Label>(ii)</Label><Text>the crew of the vessel shall not catch and retain any fish of a species, size or age specified in the licence as prohibited catch and any prohibited catch shall be returned to the water, alive if possible,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555589" lims:id="555589"><Label>(iii) and (iv)</Label><Text><Repealed>[Repealed, SOR/79-713, s. 8]</Repealed></Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555590" lims:id="555590"><Label>(v)</Label><Text>the crew of the vessel shall fish only by means of fishing equipment and gear of a type specified in the licence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555591" lims:id="555591"><Label>(vi)</Label><Text>if a quantity of gear and equipment is specified in the licence, the crew of the vessel shall not fish with a quantity of gear and equipment that exceeds that specified quantity;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555592" lims:id="555592"><Label>(e)</Label><Text>where the transporting of fish from fishing grounds is authorized by the licence</Text><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555593" lims:id="555593"><Label>(i)</Label><Text>only the species and quantities of fish specified in the licence shall be taken on board the vessel for that purpose,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555594" lims:id="555594"><Label>(ii)</Label><Text>the fish may be taken on board only from vessels of a class specified in the licence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555595" lims:id="555595"><Label>(iii)</Label><Text>the master of the vessel shall cause written records to be maintained on a daily basis of the fish taken on board the vessel for transportation;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555596" lims:id="555596"><Label>(f) and (g)</Label><Text><Repealed>[Repealed, SOR/85-527, s. 8]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="555597" lims:id="1145821"><Label>(h)</Label><Text>the vessel shall have on board at all times during the period it is in Canadian fisheries waters equipment and gear, including communications equipment, described in the licence or permit as “required equipment”;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555598" lims:id="555601"><Label>(m)</Label><Text>where the Minister requests the flag state of the vessel to carry out, from time to time, a program of sampling, observation or research in connection with fisheries in Canadian fisheries waters, the master shall comply with instructions issued to him by the authorized officials of that flag state in respect of that program;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555602" lims:id="555602"><Label>(n) to (t)</Label><Text><Repealed>[Repealed, SOR/85-527, s. 8]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555603" lims:id="555603"><Label>(u)</Label><Text>the master or crew of the vessel shall not carry out any activity in any area of Canadian fisheries waters that is contrary to the <XRefExternal reference-type="act" link="F-14">Fisheries Act</XRefExternal> or regulations made under that Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="555604" lims:id="1145822"><Label>(2)</Label><Text>The master of a foreign vessel in respect of which a licence or permit lims:id="555611"><Label>12</Label><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555612" lims:id="555612"><Label>(1)</Label><Text>The master of a foreign fishing vessel operating under the authority of a licence shall</Text><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555613" lims:id="555613"><Label>(a)</Label><Text>at least 24 hours or such shorter period as may be approved by the Regional Director-General prior to the entry of that vessel into Canadian fisheries waters notify the Regional Director-General designated in the licence of</Text><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555614" lims:id="555614"><Label>(i)</Label><Text>the estimated time of entry of the vessel into such waters,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555615" lims:id="555615"><Label>(ii)</Label><Text>the location of such entry,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555616" lims:id="555616"><Label>(iii)</Label><Text>the approximate schedule of activities to be conducted while in such waters, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555617" lims:id="555617"><Label>(iv)</Label><Text>the quantity in metric tons of fish by species and product form on board the vessel;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555618" lims:id="555618"><Label>(b)</Label><Text>when authorized by the licence to enter a Canadian port, notify the Regional Director-General of the estimated time of entry into and departure from that port not less than 24 hours prior to those estimated times;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555619" lims:id="555619"><Label>(c)</Label><Text>where the vessel is in Canadian fisheries waters, notify the Regional Director-General of the estimated time of departure from such waters not less than 72 hours prior to that estimated time or such shorter period as may be approved by the Regional Director-General;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555620" lims:id="555620"><Label>(d)</Label><Text>where the vessel is in an area of Canadian fisheries waters and is not authorized by the licence to engage in fishing at that time in that area, ensure that all fishing gear on board the vessel is stored below deck or otherwise removed from the place where it is normally used for fishing and placed where it is not readily available for fishing;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555621" lims:id="555621"><Label>(e)</Label><Text>permit, when requested by the Regional Director-General, observers to go on board and remain on board the vessel at a time and for a period specified in the request for the purposes of recording scientific data, making observations and taking samples;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555622" lims:id="555622"><Label>(f)</Label><Text>embark or disembark the observers at a time and place specified in a request made under paragraph (e);</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555623" lims:id="555623"><Label>(g)</Label><Text>take all reasonable precautions to ensure the safety of any protection officer or observer boarding or leaving the vessel at sea including the observance of practices of good seamanship and, where necessary, the placing of a pilot ladder over the side of the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555624" lims:id="555624"><Label>(h)</Label><Text>where a protection officer or an observer is on board the vessel and remains on board the vessel for a period of more than four consecutive hours, provide the protection officer or observer with food and accommodation equivalent to that received by officers of the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555625" lims:id="555625"><Label>(i)</Label><Text>provide all reasonable assistance in his power to enable a protection officer or an observer on board the vessel to carry out his duties and in particular, but without restricting the generality of the foregoing, shall</Text><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555626" lims:id="555626"><Label>(i)</Label><Text>provide him with a suitable work area including a table and sufficient lighting to carry out his work,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555627" lims:id="555627"><Label>(ii)</Label><Text>provide him with access to the vessel records and logs pertaining to its fishing activities,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555628" lims:id="555628"><Label>(iii)</Label><Text>provide him, on request, with the position of the vessel in latitude and longitude,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555629" lims:id="555629"><Label>(iv)</Label><Text>send and receive messages on his behalf by means of the communications equipment on board the vessel,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555630" lims:id="555630"><Label>(v)</Label><Text>provide him with access to all areas of the vessel involved in the fishing, processing and storage operations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555631" lims:id="555631"><Label>(vi)</Label><Text>permit him to take samples and provide him with all reasonable assistance in his doing so,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555632" lims:id="555632"><Label>(vii)</Label><Text>provide him with suitable storage facilities for his samples,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555633" lims:id="555633"><Label>(viii)</Label><Text>permit him to examine and measure any fishing gear on board the vessel and provide him with all reasonable assistance in his doing so,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555634" lims:id="555634"><Label>(ix)</Label><Text>permit him to take photographs of the fisheries operations, including fishing gear and equipment, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555635" lims:id="555635"><Label>(x)</Label><Text>permit him to remove from the vessel samples, information, photographs or film taken or made during his time on board the vessel;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555636" lims:id="555636"><Label>(j)</Label><Text>where supplied with a log book requiring the recording of the fishing activities, catch, production and transfer of fish and fish products in accordance with the instructions contained in that log book</Text><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555637" lims:id="555637"><Label>(i)</Label><Text>fully and accurately complete that log book on a daily basis, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555638" lims:id="555638"><Label>(ii)</Label><Text>provide the Regional Director-General with a copy of the information entered in that log book;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555639" lims:id="555639"><Label>(k)</Label><Text>send the original of the log book required to be completed under paragraph (j)</Text><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555640" lims:id="555640"><Label>(i)</Label><Text>upon request, to a protection officer or a Regional Director-General as soon as the request is made, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2017-04-13" lims:fid="555641" lims:id="555641"><Label>(ii)</Label><Text>where a request has not been made under subparagraph (i), to the Regional Director-General designated in the licence not later than 60 days after the expiration date of the licence;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555642" lims:id="555642"><Label>(l)</Label><Text>cause reports to be made containing the information specified, at the times specified, to the persons specified and by the means specified in the licence;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555643" lims:id="555643"><Label>(m)</Label><Text>while in Canadian fisheries waters, at the request of a Regional Director-General or a protection officer proceed forthwith to the place at sea or the port specified in the request for the purpose of inspection; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555644" lims:id="555644"><Label>(n)</Label><Text>ensure that the vessel at all times while in Canadian fisheries waters is flying the flag of its flag state.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-04-13" lims:fid="555645" lims:id="555645"><Label>(2)</Label><Text>The master of a foreign fishing vessel in respect of which a licence has been issued shall not operate that vessel for fishing or cause it to be operated for fishing unless the side number specified in the licence is painted on the vessel or affixed permanently to the vessel by some other means and</Text><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555646" lims:id="555646"><Label>(a)</Label><Text>is legible and visible from an aircraft in flight, another vessel or the shore;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555647" lims:id="555647"><Label>(b)</Label><Text>is in solid block Arabic numerals without ornamentation;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555648" lims:id="555648"><Label>(c)</Label><Text>is white on a black background or black on a white background;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555649" lims:id="555649"><Label>(d)</Label><Text>is in alignment and in a horizontal line; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-13" lims:fid="555650" lims:id="555650"><Label>(e)</Label><Text>is located on the vessel and in dimensions specified in the table to this subsection.</Text><TableGroup subsection 5.6(3) of the Act, any of the following fish that is subject to measures established by the International Commission for the Conservation of Atlantic Tunas (ICCAT) and that is imported must be accompanied by:</Text><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145830" lims:id="1145830"><Label>(a)</Label><Text>in the case of Atlantic bluefin tuna, a catch document or re-export certificate, as the case may be, that complies with the ICCAT <XRefExternal reference-type="other">Bluefin Tuna Catch Documentation Program</XRefExternal> that is current at the time that the fish are caught;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145831" lims:id="1145831"><Label>(b)</Label><Text>in the case of Atlantic bigeye tuna, a statistical document or a re-export certificate, as the case may be, that complies with the ICCAT <XRefExternal reference-type="other">Bigeye Tuna Statistical Document Program</XRefExternal> that is current at the time that the fish are caught; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145832" lims:id="1145832"><Label>(c)</Label><Text>in the case of Atlantic swordfish meat, a statistical document or a re-export certificate, as the case may be, that complies with the ICCAT <XRefExternal reference-type="other">Swordfish Statistical Document Program</XRefExternal> that is current at the time that the fish are caught.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145833" lims:id="1145833"><Label>(2)</Label><Text>The documents referred to in paragraph (1)(b) are not required in the case of Atlantic bigeye tuna that was caught by purse seiners or pole and line bait vessels and is destined principally for a cannery located in Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145835" lims:id="1145835" caught.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-17" lims:enacted-date="2019-06-17" lims:fid="1145847" lims:id="1145847"><Label>(2)</Label><Text>The documents referred to in subsection (1) are not required in the case of Indian Ocean bigeye tuna that was caught by purse seiners or pole and line bait vessels and is destined principally for a cannery located in level="1"><TitleText>Suspension or Cancellation of Licences and Permits</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="555674"
