list-item="no"><Text>achieving reconciliation with First Nations, the Métis and the Inuit through renewed nation-to-nation, government-to-government and Inuit-Crown relationships based on affirmation and implementation of rights, respect, cooperation and partnership,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169341" lims:id="1169341" format-ref="indent-1-1" language-align="no" list-item="no"><Text>promoting respect for the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>, and</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169342" lims:id="1169342" format-ref="indent-1-1" language-align="no" list-item="no"><Text>implementing the United Nations Declaration on the Rights of Indigenous Peoples;</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169343" lims:id="1169343" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas it is appropriate to establish a Department of Crown-Indigenous Relations and Northern Affairs and that the Department, in carrying out its activities,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169344" lims:id="1169344" format-ref="indent-1-1" language-align="no" list-item="no"><Text>collaborates and cooperates with Indigenous peoples and with the provinces and territories in relation to entering into and implementing agreements,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169345" lims:id="1169345" format-ref="indent-1-1" language-align="no" list-item="no"><Text>recognizes and implements treaties concluded between the Crown and Indigenous peoples,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169346" lims:id="1169346" format-ref="indent-1-1" language-align="no" list-item="no"><Text>promotes self-reliance, prosperity and well-being for the residents and communities of the Canadian North, taking into account their respective needs and challenges,</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169347" lims:id="1169347" format-ref="indent-1-1" language-align="no" list-item="no"><Text>recognizes and promotes Indigenous ways of knowing, being and doing, and</Text></Provision><Provision lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169348" lims:id="1169348" format-ref="indent-1-1" language-align="no" list-item="no"><Text>promotes public awareness and understanding of the importance of working toward and contributing to reconciliation with Indigenous lims:id="1169357">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169358" lims:id="1169358"><Text><DefinedTermEn>Department</DefinedTermEn> means the department established under section 3. (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169359" lims:id="1169359"><Text><DefinedTermEn>Indigenous governing body</DefinedTermEn> means a council, government or other entity that is authorized to act on behalf of an Indigenous group, community or people that holds rights recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>corps dirigeant autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169360" lims:id="1169360"><Text><DefinedTermEn>Indigenous organization</DefinedTermEn> means an Indigenous governing body or any other entity that represents the interests of an Indigenous group and its members. (<DefinedTermFr>organisation autochtone</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169361" lims:id="1169361"><Text><DefinedTermEn>Indigenous peoples</DefinedTermEn> has the meaning assigned by the definition <DefinitionRef>aboriginal peoples of Canada</DefinitionRef> in subsection 35(2) of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>peuples autochtones</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169362" lims:id="1169362"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Crown-Indigenous level="1"><TitleText>Department of Crown-Indigenous Relations and Northern Affairs</TitleText></Heading><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169364" lims:id="1169364" level="2"><TitleText>Establishment of Department</TitleText></Heading><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169365" lims:id="1169365"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169366" lims:id="1169366">Department established</MarginalNote><Label>3</Label><Text>There is established a department of the Government of Canada, called the Department of Crown-Indigenous Relations and Northern Affairs, over which the Minister presides.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169367" lims:id="1169367"><MarginalNote Great Seal, holds office during pleasure and has the management and direction of the Department.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" Minister</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169371" lims:id="1169371"><Label>(1)</Label><Text>The Governor in Council may appoint a Deputy Minister of Crown-Indigenous Relations to hold office during pleasure and to be the deputy head of the Department.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169372" lims:id="1169372"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169373" lims:id="1169373">Associate Deputy Minister</MarginalNote><Label>(2)</Label><Text>The Governor in Council may appoint an Associate Deputy Minister of Crown-Indigenous Relations to hold office during pleasure and, under the Deputy Minister of Crown-Indigenous Relations, to exercise the powers and perform the duties and functions — as a deputy of the Minister or otherwise — that the Minister may specify.</Text></Subsection></Section><Heading lims:inforce-start-date="2019-06-21" lims:enacted-date="2019-06-21" lims:fid="1169374" lims:id="1169374" level="2"><TitleText>Powers, Duties and Functions of Minister</TitleText></Heading><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169375" lims:id="1169375"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169376" lims:id="1169376">Powers, duties and functions</MarginalNote><Label>6</Label><Text>The Minister’s powers, duties and functions extend to and include all matters over which Parliament has jurisdiction — and that are not by law assigned to any other department, board or agency of the Government of Canada — relating to relations with Indigenous peoples.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169377" lims:id="1169377"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169378" lims:id="1169378">Responsibilities</MarginalNote><Label>7</Label><Text>The Minister is responsible for</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169379" lims:id="1169379"><Label>(a)</Label><Text>exercising leadership within the Government of Canada in relation to the affirmation and implementation of the rights of Indigenous peoples recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal> and the implementation of treaties and other agreements with Indigenous peoples;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169380" lims:id="1169380"><Label>(b)</Label><Text>negotiating treaties and other agreements to advance the self-determination of Indigenous peoples; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169381" lims:id="1169381"><Label>(c)</Label><Text>advancing reconciliation with Indigenous peoples, in collaboration with Indigenous peoples and through renewed nation-to-nation, government-to-government and Inuit-Crown relationships.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169382" lims:id="1169382"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169383" lims:id="1169383">Provision of services between departments</MarginalNote><Label>8</Label><Text>The Department may provide services to and receive services from the Department of Indigenous Services — including services to support policy and program implementation — as provided in a written agreement between the Minister or the Minister of Northern Affairs, as the case may be, and the Minister of Indigenous Services.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169384" lims:id="1169384"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169385" lims:id="1169385">Delegation</MarginalNote><Label>9</Label><Text>The Minister may delegate any of his or her powers, duties and functions under this Act or any other Act of Parliament, except the power to delegate under this section, to the Minister of Indigenous Services, for any period and under any terms that the Minister considers suitable.</Text></Section><Section lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:lastAmendedDate="2019-07-15" lims:fid="1169386" lims:id="1169386"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169387" lims:id="1169387">Annual report to Parliament</MarginalNote><Label>10</Label><Text>The Minister must cause to be tabled in each House of Parliament, within three months after the end of the fiscal year or, if the House is not then sitting, on any of the first 15 days of the next sitting of the House, a report on the measures taken to advance the self-determination of Indigenous peoples and reconciliation with Indigenous lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169390" lims:id="1169390">Appointment</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169391" lims:id="1169391"><Label>(1)</Label><Text>A Minister of Northern Affairs may be appointed by commission under the Great Seal to hold office during pleasure.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169392" lims:id="1169392"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169393" lims:id="1169393">If no Minister of Northern Affairs appointed</MarginalNote><Label>(2)</Label><Text>If no Minister of Northern Affairs is appointed under subsection (1),</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169394" lims:id="1169394"><Label>(a)</Label><Text>the Minister is to exercise the lims:id="1169395"><Label>(b)</Label><Text>every reference to the Minister of Northern Affairs in any Act of Parliament or in any order, regulation or other instrument made under an Act of Parliament lims:fid="1169398" lims:id="1169398"><Label>(1)</Label><Text>The Governor in Council may designate the Associate Deputy Minister appointed under subsection 5(2) to be Deputy Minister of Northern Affairs and, under the Minister of Northern Affairs, to exercise the powers and perform the duties and functions — as a deputy of the Minister of Northern Affairs or otherwise — that the Minister of Northern Affairs may specify.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169399" lims:id="1169399"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169400" lims:id="1169400">If no Deputy Minister of Northern Affairs designated</MarginalNote><Label>(2)</Label><Text>If Minister of Northern Affairs is to</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169409" lims:id="1169409"><Label>(a)</Label><Text>coordinate the activities of the departments, boards and agencies of the Government of Canada in the territories;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169410" lims:id="1169410"><Label>(b)</Label><Text>develop and implement policies and programs to promote the social, economic and political development of the territories; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169411" lims:id="1169411"><Label>(c)</Label><Text>foster, through scientific research and technology, knowledge of the Canadian North and the taking of various measures to support its development.</Text></Paragraph></Section><Section lims:inforce-start-date="2019-07-15" lims:fid="1169413" lims:id="1169413">Administration of lands — Nunavut</MarginalNote><Label>15</Label><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169414" lims:id="1169414"><Label>(1)</Label><Text>The Minister of Northern Affairs has the administration of lands situated in Nunavut belonging to Her Majesty in right of Canada except those lands that are Government of Canada or any <DefinitionRef>agent corporation</DefinitionRef> as defined in subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration lims:id="1169430"><Label>(1)</Label><Text>The Minister or the Minister of Northern Affairs, as the case may be, may appoint special representatives to provide him or her with advice on any matter relating to his or her powers, duties and functions under this Act or to any other matter relating to this Act, or to represent him or her in the context of, among other things, any consultation or engagement with an Indigenous organization or Indigenous group, community or people with respect to such a matter.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169431" lims:id="1169431"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169432" lims:id="1169432">Committees</MarginalNote><Label>(2)</Label><Text>The Minister or the Minister of Northern Affairs, as the case may be, may also establish advisory and other committees to provide him or her with advice on any matter referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169433" lims:id="1169433"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169434" lims:id="1169434">Remuneration and expenses</MarginalNote><Label>(3)</Label><Text>The Minister or the Minister of Northern Affairs, as the case may be, is to fix the remuneration and expenses to be paid to special representatives and the Minister of Northern Affairs, as the case may be, may, in exercising his or her powers and performing his or her duties or functions under this Act, collect, analyze and interpret documents, information or data in respect of matters under his or her administration.</Text></Subsection><Subsection lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169438" lims:id="1169438"><MarginalNote lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169439" lims:id="1169439">Disclosure of information</MarginalNote><Label>(2)</Label><Text>The Minister or the Minister of Northern Affairs, as the case may be, may, in exercising his or her powers and performing his or her duties or functions under this Act, disclose or permit to be disclosed, in whole or in part, those documents and that information or data to, among others,</Text><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169440" lims:id="1169440"><Label>(a)</Label><Text>the Department of Indigenous Services;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169441" lims:id="1169441"><Label>(b)</Label><Text>a department named in Schedule I to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, a division or branch of the federal public administration set out in column I of Schedule I.1 to that Act, a corporation named in Schedule II to that Act or a <DefinitionRef>Crown corporation</DefinitionRef> as defined in subsection 83(1) of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169442" lims:id="1169442"><Label>(c)</Label><Text>an Indigenous organization; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-07-15" lims:enacted-date="2019-06-21" lims:fid="1169443" lims:id="1169443"><Label>(d)</Label><Text>a not-for-profit entity controlled by Indigenous individuals.</Text></Paragraph></Subsection><Subsection
