Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 95-569 on August 18, 1995, approving the application by CTEQ Télévision Inc. for a broadcasting licence for a multilingual television programming undertaking at Montreal, on channel 62B, with an effective radiated power of 11,000 watts;
Whereas, subsequent to the rendering of Decision CRTC 95-569, the Governor in Council has received petitions requesting that the said decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;
And Whereas the Governor in Council, having considered these petitions, is not satisfied that Decision CRTC 95-569 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 95-569 of August 18, 1995, back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
