Order Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting CHUM Limited

Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 94-281 on June 6, 1994 (as corrected by CRTC Decision 94-281-1 of July 11, 1994) approving the application by CHUM Limited for a broadcasting licence to carry on a national English-language programming undertaking (Specialty Television Service) to be known as “Bravo!";

Whereas, subsequent to the rendering of the said decision, the Governor in Council has received a petition requesting that it be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;

And Whereas the Governor in Council, having considered the petition, is not satisfied that the said decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 94-281 of June 6, 1994 (as corrected by Decision CRTC 94-281-1 of July 11, 1994), back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
