Order Declining to Set Aside or to Refer Back to the CRTC Decision CRTC 2002-81

Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 2002-81 on April 8, 2002, which approved an application by Craig Broadcast Systems Inc., on behalf of a corporation to be incorporated, for a broadcasting licence to operate an English-language over-the-air television station to serve Toronto, on channel 52C, with an effective radiated power of 59,000 watts, with an additional transmitter in Hamilton, operating on channel 45B, with an effective radiated power of 10,000 watts;

Whereas, subsequent to the rendering of Decision CRTC 2002-81, the Governor in Council has received petitions requesting that the decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing of the matter by the Commission;

And whereas the Governor in Council, having considered the petitions, is not satisfied that the Decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting ActFootnote a;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Acting Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting ActFootnote a, hereby declines to set aside Decision CRTC 2002-81 of April 8, 2002 or to refer it back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing of the matter by the Commission.
