Order declining to set aside or to refer back to the CRTC Decision CRTC 2000-205

Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 2000-205 on June 16, 2000 approving an application by CHWO Ontario Inc., on behalf of 1210361 Ontario Inc. (the general partner), and Ken Harrigan, George Patton, Terry Patterson and Peter Gilgan (the limited partners), in a limited partnership known as AM 740 PrimeTime Radio, for a broadcasting licence to carry on an English-language AM radio programming undertaking at Toronto, operating on the frequency 740 kHz with a transmitter power of 50,000 watts;

Whereas, subsequent to the rendering of Decision CRTC 2000-205, the Governor in Council has received petitions requesting that the said decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;

And whereas the Governor in Council, having considered these petitions, is not satisfied that Decision CRTC 2000-205 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 2000-205 of June 16, 2000 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
