B-9.01Broadcasting ActSI/96-118199612252013012820051013BROADCASTING ACTOrder Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting CJFP-FM Rivière-du-LoupP.C.1996-18851996125Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 96-632 on September 11, 1996 approving an application by Radio CJFP (1986) ltée to amend the broadcasting licence of the radio programming undertaking CJFP-FM Rivière-du-Loup, by adding an FM transmitter at Cabano, operating on the frequency 98.3 Mhz (channel 252A) with an effective radiated power of 3,000 watts;Whereas, subsequent to the rendering of Decision CRTC 96-632, the Governor in Council has received a petition requesting that the said decision be referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;And Whereas the Governor in Council, having considered the petition, is not satisfied that Decision CRTC 96-632 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 96-632 of September 11, 1996 back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
