B-9.01Broadcasting ActSI/94-11219949212013012820051013BROADCASTING ACTOrder Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting the Canadian Broadcasting CorporationP.C.1994-14371994830Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 94-285 on June 6, 1994, approving the application by the Canadian Broadcasting Corporation for a broadcasting licence to carry on a specialty programming undertaking (Rèseau de l’information — RDI) to provide a national French-language television news service;Whereas subsequent to the rendering of Decision CRTC 94-285, the Governor in Council has received petitions requesting that the said decision be set aside or referred back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing;And Whereas the Governor in Council, having considered these petitions, is not satisfied that Decision CRTC 94-285 derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or to refer Decision CRTC 94-285 of June 6, 1994, back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission.
