B-9.01Broadcasting ActSI/87-342013012820051014BROADCASTING ACTOrder Referring Back to the CRTC a Decision Respecting the Approval of an Application for a Licence by Ian MackayP.C.1987-851987122Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 86-1139 on November 27, 1986 approving the application of Ian Mackay representing a company to be incorporated for a licence to carry on a broadcasting receiving undertaking (subscription television);Whereas subsequent to the rendering of Decision CRTC 86-1139 the Governor in Council has received a petition requesting that the said Decision CRTC 86-1139 be set aside or referred back to the CRTC for reconsideration and hearing;And Whereas the Governor in Council is of the opinion that the application by Ian Mackay on behalf of a company to be incorporated and the scheduled public hearing on this application were not sufficiently publicized in the area to be served, to allow all interested parties the opportunity to comment on the said application or to prepare competing applications;Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 23 of the Broadcasting Act, hereby refers Decision CRTC 86-1139 of November 27, 1986 approving the application for a licence of Ian Mackay representing a company to be incorporated back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing.
