B-9.01Broadcasting ActSI/87-2422013012820051014BROADCASTING ACTOrder Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting Racetrack Management (1983)P.C.1987-222019871029Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 87-701 on September 1, 1987, approving the application of Racetrack Management (1983), (Racetrack), a limited partnership, for a broadcasting licence to carry on an English language network operation;Whereas, subsequent to the rendering of Decision CRTC 87-701, the Governor in Council received a petition requesting that the said Decision be set aside;And Whereas the Governor in Council, having considered the petition, is of the opinion that it is not in the public interest to set aside or to refer back to the Commission for reconsideration and hearing by the Commission the said Decision CRTC 87-701.Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 23 of the Broadcasting Act, hereby declines to set aside or to refer back to the Commission for reconsideration and hearing Decision CRTC 87-701 of September 1, 1987.
